of 6 June 2008
amending certain laws relating to the area of population registration
Parliament has decided on this law of the Czech Republic:
Amendment of the Act on the Jurisdiction of the Bodies of the Czech Republic in non-judicial rehabilitation
In Act No. 231 / 1991 Coll., on the jurisdiction of the authorities of the Czech Republic in extrajudicial rehabilitation, as amended by Act No. 544 / 1991 Coll., Legislative measure of the Czech National Council No. 345 / 1992 Coll., Act No. 133 / 1993 Coll. and Act No. 320 / 2002 Coll., the following Section 15a is inserted after § 15, which includes footnotes No 15a to 15c:
(1) The Ministry of the Interior provides the Ministry of Finance, for the purposes of the detection and verification of data on natural persons necessary for the assessment of the eligibility of the claim for financial compensation as referred to in Article 1, data from the registration system to the population 15a) in electronic form enabling remote access; a resident means a natural person under special legislation15b.
(2) The data provided under paragraph 1 shall be those relating to:
(a) State citizens of the Czech Republic15c)
1. name (s), names (s), surname (s), change thereof, surname (s),
2. date of birth,
3rd birth number,
4. citizenship and, where appropriate, multiple citizenship,
5. the address of the place of permanent residence, including previous addresses of the place of permanent residence,
6. the beginning of the permanent residence or, where applicable, the date of cancellation of the permanent residence or the date of termination of the permanent residence in the Czech Republic,
7. the marital status, the date and place of the marriage, the date on which the court's decision to declare the marriage void, the date on which the court's decision on the absence of marriage became final, the date of the death of one of the spouses, or the date on which the court's decision to declare one of the spouses as dead became final, and the date on which the court's decision on the death was referred to as the date of death, or, where appropriate, the date on which the court's decision on divorce was taken,
8. Date and place of establishment of a registered partnership (hereinafter referred to as "partnership"), date on which the court's decision on invalidity or absence of partnership is acquired, date on which the partnership is terminated by the death of one of the partners, or date on which the court's decision on the declaration of death was taken and the date on which the court's decision on death was declared as the date of death or, where appropriate, the date on which it did not survive, or the date on which the court's decision on the annulment of the partnership was acquired;
9. date, place and district of death; if the death of a citizen is outside the territory of the Czech Republic, the date and State on whose territory the death occurred,
Day 10, which was listed in the court's decision on the death declaration as the day of death, or the day which he did not survive,
(b) foreigners resident;
1. name (s), names (s), surname (s), change thereof, surname (s),
2. date of birth,
3rd birth number,
4. place and state where the alien was born; where the alien was born in the territory of the Czech Republic, the place and district of birth,
5. Citizenship or multiple citizenship,
6. type and address of residence,
7. the marital status, the date and place of the marriage, the date on which the court's decision to declare the marriage void, the date on which the court's decision on the absence of marriage became final, the date of the death of one of the spouses, or the date on which the court's decision to declare one of the spouses as dead became final, and the date on which the court's decision on the death was referred to as the date of death, or, where appropriate, the date on which the court's decision on divorce was taken,
8. the date and place of establishment of the partnership, the date of the acquisition of legal power of the decision of the court of invalidity or of the absence of a partnership, the date of the termination of the partnership by the death of one of the partners, or the date of the acquisition of legal power by the court of the decision of the court of annulment and the date of the final decision of the court of death as the date of death, or the date of the acquisition of legal power by the court of annulment of the partnership;
9. date, place and district of death; if there is a death outside the territory of the Czech Republic, the State in whose territory the death occurred or the date of death,
Day 10, which was listed in the court's decision to declare himself dead as the day of death, or the day that he did not survive.
(3) Only such data as are necessary to fulfil the task may be used from the data provided in a particular case.

Amendment of the Road Transport Act
Act No. 111 / 1994 Coll., on Road Transport, as amended by Act No. 38 / 1995 Coll., Act No. 304 / 1997 Coll., Act No. 132 / 2000 Coll., Act No. 150 / 2000 Coll., Act No. 361 / 2000 Coll., Act No. 175 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 577 / 2002 Coll., Act No. 103 / 2004 Coll., Act No. 186 / 2004 Coll., Act No. 1 / 2005 Coll., Act No. 229 / 2005 Coll., Act No. 253 / 2005 Coll., Act No. 411 / 2005 Coll., Act No. 226 / 2006 Coll. and Act No. 374 / 2007 Coll., is amended as follows:
1. in Paragraph 18a (1) (c), "paragraph 3" is replaced by "paragraph 2."
2. Paragraph 18a (2), including footnotes 10a and 10b, is deleted.
Paragraphs 3 to 5 shall be renumbered paragraphs 2 to 4.
3. in Paragraph 18a (2) (c), the words "the birth number or" and the words "the number of this personal document and, in the case of a passenger who has not yet reached the age of 18, the name, surname and address of his legal representative," shall be deleted.
4. In Paragraph 18a (4), "paragraph 3 'is replaced by" paragraph 2';
Amendment of the Act on intelligence services of the Czech Republic
In Section 11a of Act No. 153 / 1994 Coll., on Intelligence Services of the Czech Republic, as amended by Act No. 342 / 2006 Coll., paragraphs 3 and 4 including footnote 3j read:
"(3) The data provided under paragraph 1 shall be those relating to:
(a) State citizens of the Czech Republic 3i)
1. name (s), names (s), surname (s), change thereof, surname (s),
2. date of birth,
3rd sex,
4. place and district of birth and with a citizen who was born abroad, place and state where the citizen was born,
5th birth number,
6. citizenship and, where appropriate, multiple citizenship,
7. the address of the place of residence, including previous addresses of the place of residence,
8. the beginning of the permanent residence, or the date of cancellation of the permanent residence or the date of termination of the permanent residence in the Czech Republic,
9. Waiver or limitation of legal capacity;
10. residence and residence and duration;
11. The birth number of the father, mother or other legal representative, if any; where one of the parents or other legal representative is not assigned the birth number, the name or, where applicable, the names, surnames, their change and date of birth;
12. Family status, date and place of marriage, date on which the court's decision to declare a marriage null and void, date on which the court's decision on the absence of a marriage was taken, date on which the marriage was terminated by the death of one of the spouses, or date on which the court's decision on the death of one of the spouses was brought to law and the date on which the court's decision on divorce was referred to as the date of death, or, where appropriate, the date on which the court's decision on divorce was taken,
13. Date and place of establishment of a registered partnership (hereinafter referred to as "partnership"), date on which the court's decision on invalidity or absence of partnership is acquired, date on which the partnership is terminated by the death of one of the partners, or date on which the court's decision to declare one of the partners dead is acquired, and the date on which the court's final decision on the death declaration was referred to as the date of death, or, where appropriate, the date on which it did not survive, or the date on which the court's decision on the annulment of the partnership was acquired,
14. Husband or partner's birth number; if the spouse or partner is a natural person who is not assigned a birth number, name or, where applicable, name, surname and change of spouse and date of birth;
15. The birth number of the child; if the child is a foreigner who is not assigned a birth number, the name and, where applicable, the names, surnames and their change of name and date of birth;
16. on an adopted child
(a) the degree of adoption, even though this information is kept as blocked data in the population registration information system (j);
(b) the original and new names, names, surnames of the child, where appropriate;
(c) the original and new birth number of the child,
(d) date and place of birth;
(e) the birth numbers of the adopters; in the event that the transferee has not been assigned a birth number, the name and, where applicable, the names, surnames, their change and the date of birth of the transferee;
(f) birth numbers of the father and mother; where they have not been allocated, their name and, where appropriate, their names, surnames and amendments; this data is not provided when it is a child born to a woman with a permanent residence in the Czech Republic who has given birth to a child and has applied in writing for the secrecy of her person in connection with the birth,
(g) the date on which the decision to adopt or revoke the adoption of the child becomes final;
17. Date, place and district of death; if there is a death of a citizen outside the Czech Republic, the date of death and the State in whose territory the death occurred,
On the 18th day in the court's decision to declare himself dead as the day of death, or the day that he did not survive,
19. Record of data provision,
(b) foreigners resident;
1. name (s), names (s), surname (s), change thereof, surname (s),
2. date of birth,
3rd sex,
4. place and state where the alien was born; where the alien was born on the territory of the Czech Republic, the place and district of birth shall be provided;
5th birth number,
6. citizenship and, where appropriate, multiple citizenship,
7. Nature and address of residence,
8. Number and validity of residence permit,
9. the beginning of the stay or, where applicable, the date of termination of the stay;
10. Waiver or limitation of legal capacity;
11. administrative expulsion and the period during which entry into the Czech Republic is not allowed,
12. Family status, date and place of marriage, date on which the court's decision to declare a marriage null and void, date on which the court's decision on the absence of a marriage was taken, date on which the marriage was terminated by the death of one of the spouses, or date on which the court's decision on the death of one of the spouses was brought to law and the date on which the court's decision on divorce was referred to as the date of death, or, where appropriate, the date on which the court's decision on divorce was taken,
13. Date and place of establishment of the partnership, date of acquisition of legal authority of the court of invalidity or absence of partnership, date of termination of partnership of the death of one of the partners, or date of acquisition of legal authority of the court of declaration of death of one of the partners and of the date of final decision of the court of death as the date of death, or of the date of acquisition of legal authority of the decision of the court of annulment of the partnership,
14. the name and, where applicable, the name, the name, the change of the spouse or partner and its birth number; if the spouse or partner is a foreigner who is not assigned a birth number, the name and, where applicable, the names, surnames, their change and date of birth;
15. the name and, where applicable, the name, the surname, the change of the child if he is a resident, and his / her birth number; where the child has not been assigned a birth number, the name or, where applicable, the names, surnames, their change and date of birth;
16. the name, names, surnames, their change of father, mother or other legal representative, if any, if any, and their birth number; where one of the parents or other legal representative is not assigned the birth number, the name or, where applicable, the names, surnames, their change and date of birth;
17. about an adopted child, if he is a resident,
(a) the degree of adoption, even though this information is kept as blocked data in the population registration information system (j);
(b) the original and new names, names, surnames of the child, where appropriate;
(c) the original and new birth number of the child,
(d) date and place of birth;
(e) the birth numbers of the adopters; in the event that the transferee has not been assigned a birth number, the name and, where applicable, the names, surnames, their change and the date of birth of the transferee;
(f) birth numbers of the father and mother; where they have not been allocated, their name and, where appropriate, their names, surnames and amendments; this data is not provided when it is a child born to a woman with a permanent residence in the Czech Republic who has given birth to a child and has applied in writing for the secrecy of her person in connection with the birth,
(g) the date on which the decision to adopt or revoke the adoption of the child becomes final;
18. expulsion and the period during which entry into the Czech Republic is not allowed,
19. Date, place and district of death; if there is a death outside the territory of the Czech Republic, the State in whose territory the death occurred or the date of death,
On the 20th day in the court's ruling on the death declaration as the day of death, or the day which he did not survive,
21. Name (s), names (s), surname (s), change (s)
(a) an elderly child of a stranger with a residence permit in the Czech Republic,
(b) a minor alien who has been entrusted by decision of the competent authority with a residence permit in the territory of the Czech Republic or his spouse to alternative family care, or who has been granted a residence permit in the territory of the Czech Republic or his spouse, or whose guardian or spouse is a stranger with a residence permit in the Czech Republic;
(c) a lonely stranger over 65 years of age or regardless of the age of a stranger who is unable to take care of himself for health reasons if the family is merged with a parent or child with a residence permit in the Czech Republic,
(d) a stranger who is an unprovided direct relative in the ascending or descending line or such a spouse of a citizen of the European Union;
(e) parents of a minor alien who has been granted asylum under special legislation and his / her birth number; if there are foreigners who are not assigned a birth number, the name and, where applicable, the names, surnames and date of birth.
22. record of data provision.
(4) The data provided under paragraph 2 shall be:
(a) the reason for the assignment of the birth number;
(b) the indication of the place of issue which the birth number has been assigned,
(c) the name and / or surname, surname and / or maiden name of the carrier of the birth number;
(d) birth number,
(e) in the event of a change in the birth number of the original birth number, even if the claim is blocked),
(f) the reason for the change in the birth number;
(g) the date on which the birth number was assigned; for birth numbers allocated before the law is effective, this information shall be provided only if it can be obtained from archive materials;
(h) the date, place and district of birth and, in the case of the carrier of the birth number born abroad, the State in whose territory he was born;
(i) current unallocated specified birth numbers.
3j) § 4 (h) of Act No. 101 / 2000 Coll., on the protection of personal data and on the amendment of certain laws, as amended. '
Amendment to the Capital Market Supervisory Act
In Article 13a (1) of Act No. 15 / 1998 Coll., on supervision in the field of capital market and amending and supplementing other laws, as amended by Act No. 342 / 2006 Coll., the word "Commission 'is replaced by" Czech National Bank' and the word "Commission 'is replaced by" Czech National Bank'.
Amendment to the Act on the Protection of classified information
In Act No. 148 / 1998 Coll., on the protection of classified information and on the amendment of certain laws, as amended by Act No. 164 / 1999 Coll., Act No. 18 / 2000 Coll., Act No. 29 / 2000 Coll., Act No. 30 / 2000 Coll., Act No. 363 / 2000 Coll., Act No. 60 / 2001 Coll., Act No. 322 / 2001 Coll., Act No. 151 / 2002 Coll., Act No. 310 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 436 / 2003 Coll., Act No. 442 / 2006 Coll., Act No. 8 incl.
Amendment to the Act on the Protection of classified information
In Act No. 412 / 2005 Coll., on the Protection of Classified Information and Security Capability, as amended by Act No. 119 / 2007 Coll., Act No. 177 / 2007 Coll., Act No. 296 / 2007 Coll. and Act No. 32 / 2008 Coll., the following Section 138a is inserted after § 138, which includes footnotes Nos 43a to 43f:
(1) The Ministry of the Interior, the Regional Authorities and the municipal authorities of the municipalities with extended competence provide population data to the Office of Enforcement under this Act from the information system of registration; a resident means a natural person under special legislation43b). The Ministry of the Interior shall provide these data in electronic form in a way that allows remote access.
(2) Furthermore, the Ministry of the Interior shall provide the Office of Enforcement under this Act, upon request, from the register of natural persons to whom the birth number has been assigned but not mentioned in paragraph 1. Where the technical status of the birth register so permits, such data shall only be provided in electronic form in a way that allows remote access.
(3) The data provided under paragraph 1 shall be those relating to:
a) Czech Republic citizens 43d)
1. name (s), names (s), surname (s), change thereof, surname (s),
2. date of birth,
3rd sex,
4. place and district of birth; a citizen born abroad, the place and state where the citizen was born,
5th birth number,
6. citizenship,
7. the address of the place of residence, including previous addresses of the place of residence,
8. the beginning of the permanent residence, or the date of cancellation of the permanent residence or the date of termination of the permanent residence in the Czech Republic,
9. Waiver or limitation of legal capacity;
10. residence and residence and duration;
11. The birth number of the father, mother or other legal representative, if any; where one of the parents or other legal representative does not have a birth number, his name or, where applicable, his name, his surname, their change and date of birth;
12. Family status, date and place of marriage, date on which the court's decision to declare a marriage null and void, date on which the court's decision on the absence of a marriage was taken, date on which the marriage was terminated by the death of one of the spouses, or date on which the court's decision on the death of one of the spouses was brought to law and the date on which the court's decision on divorce was referred to as the date of death, or, where appropriate, the date on which the court's decision on divorce was taken,
13. Date and place of establishment of a registered partnership (hereinafter referred to as "partnership"), date on which the court's decision on invalidity or absence of partnership is acquired, date on which the partnership is terminated by the death of one of the partners, or date on which the court's decision to declare one of the partners dead is acquired, and the date on which the court's final decision on the death declaration was referred to as the date of death, or, where appropriate, the date on which it did not survive, or the date on which the court's decision on the annulment of the partnership was acquired,
14. The spouse's or partner's birth number; if the spouse or partner is a stranger who is not assigned a birth number, his name and, where applicable, his name, his surname and their change of spouse and, where appropriate, his partner and the date of birth;
15. The birth number of the child; where the child is a stranger who is not assigned a birth number, the name and, where applicable, the names, surnames and their change and date of birth shall be provided;
16. on an adopted child
(a) the degree of adoption, even if this information is kept in the population registration information system as blocked data 43e),
(b) the original and new names, names, surnames of the child, where appropriate;
(c) the original and new birth number of the child,
(d) date and place of birth;
(e) the birth numbers of the adopters; in the event that the transferee has not been assigned a birth number, the name and, where applicable, the names, surnames, their change and the date of birth of the transferee;
(f) birth numbers of the father and mother; where they have not been allocated, their name and, where appropriate, their names, surnames and amendments; this data is not provided when it is a child born to a woman with a permanent residence in the Czech Republic who has given birth to a child and has applied in writing for the secrecy of her person in connection with the birth,
(g) the date on which the decision to adopt or revoke the adoption of the child becomes final;
17. Date, place and district of death; if the death of a citizen is outside the territory of the Czech Republic, the date and State on whose territory the death occurred,
On the 18th day in the court's decision to declare himself dead as the day of death, or the day that he did not survive,
(b) foreigners resident;
1. name (s), names (s), surname (s), change thereof, surname (s),
2. date of birth,
3rd sex,
4. place and state where the alien was born; where the alien was born in the territory of the Czech Republic, an indication of the place and district of birth shall be provided,
5th birth number,
6. citizenship,
7. Nature and address of residence,
8. Number and validity of residence permit,
9. the beginning of the stay or, where applicable, the date of termination of the stay;
10. Waiver or limitation of legal capacity;
11. administrative expulsion and the period during which entry into the Czech Republic is not allowed,
12. expulsion 43f) and the period during which entry into the Czech Republic is not allowed,
13. Family status, date and place of marriage, date on which the court's decision to declare a marriage null and void, date on which the court's decision on the absence of a marriage was acquired, date on which the marriage was terminated by the death of one of the spouses, or date on which the court's decision on the death of one of the spouses was acquired, and date on which the court's decision on divorce was referred to as the date of death, or, where appropriate, the date on which the marriage was acquired,
14. Name, surname, surname, change of spouse, birth number or date of birth,
15. the date and place of the establishment of the partnership, the date of the acquisition of legal power of the decision of the court of invalidity or of the absence of a partnership, the date of the termination of the partnership by the death of one of the partners, or the date of the acquisition of legal authority of the decision of the court of death, and the date of the final decision of the court of death as the date of death, or the date of the acquisition of legal power of the decision of the court of annulment of the partnership,
16. name, name, surname, change of partner, birth number or date of birth;
17. name and / or name, surname, change of child, birth number if the child is a resident; where the birth number has not been assigned, the date of birth;
18. The name, names, surnames, their change of father, mother or other legal representative, and their birth number, if any, if any; where one of the parents or other legal representative does not have a birth number, his name or, where applicable, his name, his surname, their change and date of birth;
19. Date, place and district of death; if there is a death outside the territory of the Czech Republic, the State in whose territory the death occurred or the date of death,
On the 20th day, which in the court's decision on the death declaration was referred to as the day of death, or the day which he did not survive.
(4) The data provided under paragraph 2 shall be:
(a) the name and, where appropriate, the names, the surnames, their change, the surname of the family;
(b) birth number,
(c) in the case of a change in the birth number of the original birth number,
(d) the day, month and year of birth;
(e) the place and district of birth, for a natural person born abroad, the State on whose territory he was born.
