determining the sectors in which investment incentives cannot be granted
The Ministry of Industry and Trade provides pursuant to § 11 (4) of Act No. 72 / 2000 Coll., on investment incentives and on the amendment of certain laws, as amended by Act No. 19 / 2004 Coll., ("the Act ') for the implementation of § 6 (4) of the Act:
Investment incentives, with the exception of the investment incentive provided for in Section 1 (2) (d) of the Act, cannot be granted in the case of an investment falling within the sectors of the steel industry, the synthetic fibres industry or firms in difficulty.
(1) The steel and synthetic fibre industries are defined in the Annex to this Decree.
(2) For the purposes of this decree, a firm in difficulty shall mean an entrepreneur:
(a) which is unable to meet its due obligations and would most likely lead to the bankruptcy of the undertaking without external intervention by public bodies;
(b) where the equity capital has decreased to less than half of the value of the capital and at the same time its value has decreased by more than a quarter in the previous 12 months; or
(c) which is in decline (1)
This decree shall take effect on the date of the entry into force of the Treaty of Accession of the Czech Republic to the European Union.

For the purposes of the Investment Incentives Act, the steel industry is the activities involved in the production of the following steel goods:

Definition of synthetic fibres manufacturing industry
For the purposes of this Decree, the manufacturing industry of synthetic fibres shall mean:
(a) extruding or forming of all types of staple and yarn fibres based on polyester, polyamide, acrylic and polypropylene, irrespective of their destination; or
(b) polymerisation, including polycondensation, if it is part of the extrusion; or
(c) any complementary process which follows the introduction of the extruding or shaping technology by the applicant or another entrepreneur belonging to the same group and which is usually part of the extruding or forming process for the business in question.
