DECLARATION

of 12 January 2009

on the declaration of the National Natural Monuments of Swamp and the establishment of its closer protection conditions

The Ministry of the Environment provides pursuant to § 79 (3) (c) of Act No. 114 / 1992 Coll., on the Conservation of Nature and Landscape, as amended by Act No. 218 / 2004 Coll. and Act No. 312 / 2008 Coll., ("the Act '):

§ 1

Subject matter

(1) The National Natural Monument of Swamp ("the National Natural Monument") is announced.

(2) The object of the protection is a saltwater and transition peat with numerous water areas forming the biotope of rare and endangered species of plants and animals, including the populations of brown rootseeds (Rhynchospora fusca) and white lily (Nymphaea candida). The protection also covers the natural habitat types and species for which another legislation1) the European site of Jestřebsko - Dokesko, which are located in the territory of the national natural heritage, has been declared as being of importance.

§ 2

Definition of national natural heritage

The national natural monument is situated in the territory of the Liberec Region in the cadastral territory of Doksy near Máchov Lake. The boundaries of the national natural monument shall be determined by closed geometric patterns with direct sides whose vertices are determined by the coordinates of the single trigonometric network of the cadastral2). The list of coordinates of the vertices of geometric patterns, as they follow, is given in Annex 1 to this decree. An indicative graphical representation of the territory of the national natural monument is given in Annex 3 to this Decree.

§ 3

Closer protection conditions

Only with the consent of the competent nature conservation authority can the national natural monument

(a) to make changes to the type of land or the way in which it is used (3);

(b) to adjust the surface of the road using non-local material of the same geological origin;

(d) establish hunting facilities.

§ 4

Protection zone

The protection zone of the national natural heritage is situated in the territory of the Liberec Region in the cadastral territory of Doksy near Máchov Lake. The boundaries of the national natural monument protection zone shall be determined by a separate enclosed geometric pattern with direct sides whose vertices are determined by the coordinates of the single trigonometric network system of the cadastral1). The list of coordinates of the vertices of the geometric pattern as they follow in the pattern is given in Annex 2 to this decree. The indicative graphical representation of the national natural heritage protection zone is given in Annex 3 to this Decree.

§ 5

Efficacy

This Decree shall take effect on 1 February 2009.
