Decree of the Government of the Slovak Socialist Republic on racing committees of popular control

on popular control racing committees
The Government of the Slovak Socialist Republic orders pursuant to § 15 paragraph 3 of the Slovak National Council Act No. 121 / 1971 Coll., on People's Control in the Slovak Socialist Republic:

ČÁST PRVNÍ

Establishment of folk control racing committees
§ 1
(1) The Works Commission of People's Control (hereinafter referred to as the "Racing Commission") is established in enterprises, other organisations and establishments (hereinafter referred to as "organisations") managed by the authorities of the Slovak Socialist Republic, where optimal conditions are created for this, and after the approval of the Government of the Slovak Socialist Republic.
(2) When selecting the organisations in which the race committee is to be set up, it shall be assessed in particular whether its establishment requires an economic or other social interest and whether the necessary political, cadre and other assumptions are made for its activities.
§ 2
(1) The proposal to set up a race committee is prepared in conjunction with the competent authorities of the Communist Party of Czechoslovakia, the Revolutionary Trade Union Movement, the Socialist Youth Union and the Head of Organisation (hereinafter referred to as the "authorities referred to in Section 2 (1)"):
(a) the Committee of People's Control of the District National Committee (the District National Committee in the Slovak Socialist Republic of Bratislava, the Municipal National Committee in Košice), where the organisations managed or managed by this National Committee, the National Committee of the Lower Level, or the organisation of the Central Management,
(b) the Committee of People's Control of the Regional National Committee (National Committee of the Slovak Socialist Republic of Bratislava), if it is an organisation managed or managed by that National Committee, or an organisation centrally controlled by the Committee of People's Control of the Slovak Socialist Republic,
(c) The Committee of People's Control of the Slovak Socialist Republic, if it is a joint management organisation for which it has reserved it.
(2) In order to prepare a proposal for the establishment of a race committee in a centrally managed organisation referred to in paragraph 1 (a) and (b), the committee of popular control of the national committee in whose district it is located shall be responsible.
(3) Proposals for consent to the establishment of racing committees are submitted to the Government of the Slovak Socialist Republic by the Committee of People's Control of the Slovak Socialist Republic.
§ 3
(1) Upon the agreement of the Government of the Slovak Socialist Republic, a committee of popular control shall be set up by the Racing Commission, competent pursuant to Article 2 (1) (hereinafter referred to as the "competent committee of popular control"), which shall also appoint a chairman, Vice-President and at least five other members of the Racing Commission; the number of members shall be determined taking into account the size of the organisation and the complexity of the control tasks.
(2) The members of the race committee are selected from the staff of the organisation or from pensioners who previously worked in the organisation. 1) Membership of the race committee shall be incompatible with the function of the head of the organisation and its representative, as well as with the function of the staff of the expert control unit of the organisation; A member of the race committee may also not be a member of an organisation that has concluded a material liability agreement for the values entrusted to it. 2)
(3) The competent committee of popular control shall, after consulting the authorities referred to in Article 2 (1), withdraw a member of the race committee if he fails to fulfil his duties properly or for other serious reasons.
(4) The appointment and withdrawal of members of the race committee shall be made public in the organisation.
§ 4
(1) If the conditions for the operation of the race committee cease to exist, it shall be cancelled by the competent committee of popular control after consulting the authorities referred to in Article 2 (1).
(2) For the measures referred to in paragraph 1, the Committee of People's Control of the District National Committee and the Committee of People's Control of the Regional National Committee shall seek the approval of the Committee of People's Control of the Slovak Socialist Republic, which shall inform the Government of the Slovak Socialist Republic of the cancellation of the race committee.

Activities of racing commissions
§ 5
(1) The Racing Commission shall carry out an inspection of the economic activity and the performance of the tasks of the organisation in which it was set up; check in particular:
(a) the performance of the economic plan of the organisation, in particular the tasks set out in the National Economic Development Plan of the Slovak Socialist Republic;
(b) the efficiency of production, the promotion of rationalisation and cost-effectiveness of work, energy, materials and funds;
(c) compliance with the specified quality of the products or services provided by the organisation, where appropriate;
(d) the protection and exploitation of property owned by the socialist organisation;
(e) compliance with work and technological discipline in the organisation;
(f) the performance of the organisation's tasks in the labour care sector.
(2) The Racing Commission shall check how the relevant services of the organisation deal with complaints, notifications and initiatives of citizens and organisations and whether they take corrective action. 3) The Racing Commission itself also accepts complaints and notifications which either advance to the organisation or directly examine them, if their seriousness so requires, or if there are other reasons. It shall keep its own records of the complaints and notifications received.
§ 6
(1) The Racing Commission shall work according to its own control plan; it is based on the needs of the organisation, on the thematic control tasks set out by the Committee of People's Control of the Slovak Socialist Republic, on the topics of the control tasks applied by the basic organisation of the Communist Party of Czechoslovakia and the relevant Committee of People's Control, taking advantage of the comments and suggestions of the workers and their organisations.
(2) The draft control plan will be discussed by the racing committee before it is approved with the authorities referred to in Article 2 (1) and with the relevant committee of popular control.
(3) The race committee shall inform its activities at least once a year of the competent committee of popular control and, after consulting the basic organisation of the Communist Party of Czechoslovakia, also the collective of workers of the organization.
§ 7
(1) The race committee shall proceed in the performance of the inspection and in the evaluation of the facts established, independently of the management of the organisation; ensure that its control findings are objective and that corrective measures are effective.
(2) The Racing Commission shall meet as necessary and at least once a month; it is able to act if an absolute majority of its members are present. The approval of an absolute majority of the members present shall be required for the validity of its resolutions.
§ 8
(1) The competent Human Control Committee shall direct and provide methodological assistance to the race committee.
(2) The Racing Commission is responsible for its activities to the competent Committee of People's Control.
§ 9
(1) The Racing Commission transfers its control knowledge to the basic organisation of the Communist Party of Czechoslovakia for use in the application of the right of control.
(2) The racing committee cooperates with the relevant competition authorities of the Revolutionary Trade Union Movement and the Socialist Youth Union, uses their knowledge for their control activities and informs them of their findings as necessary.
§ 10
The Racing Commission shall provide mutual assistance; cooperate, as necessary, with the popular control committees, the other control authorities, as well as with the control services of the superior authorities.

Approval of racing commissions
§ 11
(1) The Racing Commission and its mandated members are entitled to all the tasks required to carry out the inspection in the organisation; in particular may require:
(a) to allow them access to all the facilities and facilities of the organisation;
(b) that the documents, materials and documents required are submitted to them within the time limits laid down and complete and true oral or written information on the facts or explanations as to the causes of the defects found.
(2) If the members of the race committee prove themselves by a special mandate of the competent committee of popular control, they shall be provided with the required documents containing the facts constituting the subject of professional, economic or state secrecy.
(3) The Racing Commission shall be entitled to add to the participation in the inspection after consultation with the authorities referred to in Article 2 (1) to the staff of the organisation and pensioners who previously worked in the organisation; in the exercise of control activities, the co-workers shall have the same privileges as the members of the race committee, within the limits of the mandate of the race committee concerned.
§ 12
(1) The Racing Commission is entitled to:
(a) to draw attention to the organisation's leaders to the shortcomings identified and to encourage them to be removed;
(b) require the management organisation, without delay, to ensure that the deficiencies and their causes have been remedied if they have not been brought to the attention of the previous provision and if it is suspected that an offence, offence or offence has been committed in order to notify the competent authorities,
(c) in the event of a breach of professional or technological discipline or of damage to property held in socialist property, initiate the management organisation or the superior body to take action under the relevant rules against guilty persons. 5)
(2) Authorisations referred to in paragraph 1 shall also be given by the chairman of the race committee and the authorisations referred to in paragraph 1 (a) by the authorised members of the racing committee.
§ 13
Furthermore, the Racing Commission shall be entitled to:
(a) participate in control actions carried out in an organisation as decided by its manager and conduct periodic reviews of the management and evaluation of the organisation's economic performance;
(b) require the head of the organisation to ensure that serious defects are investigated beyond the possibilities of the race committee and to inform the racing committee of its results and the measures taken;
(c) propose to the competent committee of popular controls the suspension of the execution of an unlawful decision or of an illegal activity, and where there is a risk of damage, including an economic decision or an economic activity;
(d) request, where necessary, support from or after consultation with the competent committee of popular control, a superior authority or other competent national authority, and propose to it that a deeper control be carried out within the organisation.

Common and final provisions
§ 14
The organisation shall carry out administrative work on a timely and free-of-charge basis for the racing committee, create the necessary conditions for its action and pay the necessary costs in kind for its activities. 6)
§ 15
If the staff of the organisation fail to comply with the obligations imposed on them pursuant to Article 11 of this Regulation and the obligations imposed on them pursuant to Article 14 (1) and (2), or the obligation to report pursuant to Article 14 (3) of Act No. 103 / 1971 Coll., on People's Control, within the prescribed time limit, the race committee may initiate the competent committee of People's Control to impose an order fine under Article 15 of Act No. 103 / 1971 Coll., on People's Control.
§ 16
This Regulation shall enter into force on the day of its publication.

1) The selection of the members of the race committee and their legal situation are governed in particular by the provisions of Sections 17, 19, 20 (1), 22 and 23 of Act No. 103 / 1971 Coll., on People's Control, and by the provisions of Section 17 (4) of the SNR Act No. 121 / 1971 Coll., on People's Control in the Slovak Socialist Republic.
2) Section 176 of the Labour Code.
3) Government Decree No. 150 / 1958 Ú. v., on the handling of complaints, notices and incentives of workers.
4) The legal circumstances of the co-workers of the race committee are governed in particular by the provisions of Sections 18, 19 (1) and (3), 22 and 23 of Act No. 103 / 1971 Coll., on People's Control, and by the provisions of Section 17 (4) of the SNR Act No. 121 / 1971 Coll., on People's Control in the Slovak Socialist Republic, and by the provisions of Section 124 of the Labour Code.
5) § 76 et seq. of the Labour Code and, where applicable, the relevant disciplinary orders, and § 185 et seq. of the Labour Code.
6) The obligations of the organisation, its officials and staff related to the control activities of the race committee are laid down in the provisions of Section 14 of Act No. 103 / 1971 Coll., on People's Control.
