Regulation of the Minister for Health
of 7 May 1954
on hygiene and anti-epidemic soil protection.
The Minister of Health hereby orders, pursuant to Article 15 of Act No. 4 / 1952 Coll., on Sanitary and Anti-Epidemic Care:
The job of soil protection.
The objective of sanitary and anti-epidemic soil protection ("soil protection ') is to take care of soil protection in terms of soil protection against harmful pollution and other degradation, as well as to monitor the implementation of the necessary measures and monitor their effectiveness.
Essential soil protection requirements.
(1) Soil which may affect living conditions must comply with the essential hygiene requirements laid down by the main hygienist.
(2) Anyone who could adversely affect the state of the soil in the areas of its protection must implement all the measures necessary for soil protection to meet these requirements, in particular those provided for in other provisions of this Regulation. These measures shall be implemented in particular for the protection of:
(a) land in areas in which the construction or modification of housing sites is to be carried out, or the construction of facilities and facilities for production and trade, for other buildings and installations, in particular recovery, education and health (hereinafter referred to as "establishments and facilities");
(b) land around the settlements, establishments and facilities already established;
(c) agricultural, forestry and land around water sources;
(d) soil around the disposal, disposal and recovery facilities for liquid and solid waste.
Soil protection measures.
Soil protection shall be carried out by measures to ensure a satisfactory hygiene and epidemiological status of the soil, in particular:
(a) setting out appropriate sites for collecting liquid and solid waste and adjusting its disposal, disposal and recovery to avoid excessive biological and chemical burden on the soil and to avoid its self-cleaning capacity;
(b) adaptation of groundwater and surface water ratios in order to guarantee the development of favourable water conditions in soil;
(c) by preventing artificial interference and avoiding natural changes which may interfere with normal soil layer functions;
(d) preventing soil air from being degraded by excess gases, either by natural processes or by artificial interference, after malfunctions in gas storage and distribution facilities;
(e) setting out appropriate places for the burial of humans and for the disposal of animals and parts thereof;
(f) by establishing appropriate building and technical adaptations to prevent pollution of soil layers;
(g) the treatment of biological soil conditions, in particular the removal and reduction of germs of transmissible microbial and parasitic diseases of humans, animals and plants surviving in the soil;
(h) establishing maximum permitted concentrations of harmful substances in soil.
Provisions common, transitional and final.
(1) Sanitary and anti-epidemic services ensure compliance with all soil protection measures and monitor their effectiveness by regular checks, in particular by physical, chemical and biological analyses; where such measures affect agricultural production, forest land or water management, they shall do so in conjunction with the supervisory authorities of the competent central authorities.
(2) Sanitary and anti-epidemic services determine which soil protection measures are to be taken. Before that, they shall carry out the necessary soil survey and sources of pollution.
(3) The guidelines and binding opinions of the sanitary and anti-epidemic services bodies must be required to:
(a) anyone planning and implementing the construction or modification of housing sites or the construction of facilities and facilities which could adversely affect the hygienic and epidemiological state of the land, in the selection of the site and before the approval of the investment task, as well as the initial and technical project;
(b) the competent authorities before they authorise the construction or modification of the housing sites or the construction or operation of establishments and installations.
(4) Sanitary and anti-epidemic services may only give their consent to operate when the measures and modifications they have ordered have been implemented and their effectiveness checked.
The site, plant and plant polluting sites which are established or are already in operation at the time of the start of the application of this Regulation shall be progressively within the limits of the national economic development plan, as instructed by the authorities of the sanitary and anti-epidemic services, equipped with appropriate facilities for the disposal, disposal or use of soil pollutants, after their operation and use, so as to bring them as close as possible to the requirements of this Regulation.
This Regulation shall enter into force on the day of its publication.
