Government Regulation
of 13 February 1951
about dentists.
The Government of the Czechoslovak Republic orders according to § 4 paragraph 1 of Act No. 170 / 1950 Coll., on health professions:
The Dentist's task is to contribute to the extension and deepening of dental care and thus to the increase of the health level of the people through effective and valuable dental treatment to the extent set out in Section 4; This task is carried out primarily by professional work in executive public health care establishments.
The profession of a dentist may be performed and used by a Czechoslovak citizen who is fit for the exercise of that profession and on 31 December 1950
(a) be authorised to perform dental techniques as a dentist or as a tested dental technician; or
(b) be authorised to perform dental techniques to a limited extent as a dental technician and carry out a practical examination by 31 December 1952; or
(c) he has submitted an application for the examination in accordance with the provisions at the time concerning the exercise of dental equipment and will pass the written, oral and practical examination by 31 December 1952.
The Ministry of Health may authorise the pursuit of the profession of dentist by foreigners or by those who have received an education or training in dental technology abroad, provided that, according to their education and training and after practical activities, they are fit to pursue that profession. The Ministry of Health may attach this authorisation to the successful performance of the exam.
(1) In carrying out the tasks referred to in § 1, a dentist shall be entitled to:
(a) remove dental stone and coating;
(b) grinding teeth;
(c) to make firm and sensing fastening splints;
(d) remove the sensitivity of teeth by impregnating;
e) open and fill (seal) teeth and roots, counting in this root treatment,
(f) pull out teeth and roots, except in cases requiring medical treatment;
(g) to manufacture and plant, adapt and repair solid and sensing artificial teeth, teeth and parts thereof.
(2) In order to carry out the performance referred to in paragraph 1, a dentist shall be entitled to:
a) take fingerprints of teeth and jaws,
(b) use local numbness,
(c) to take and use medicines;
d) produce and evaluate roentgen images of teeth (skiography) if it is fit for this.
(3) Dentist is not entitled to other performances; in particular:
(a) use district numbness and narcotics;
(b) open tubers;
(c) treat diseases in the gums, oral mucosa and jaw,
(d) perform a resection of the root tip;
(e) treat the jaw anomaly (orthodontie),
(f) to examine under the effect of roentgen radiation (skiascopy),
(g) prescribe medicines;
(h) carry out diathermia and jontophoresis.
(4) If the dentist finds that medical treatment is necessary when performing the performance, he shall not continue to perform the initial assistance and shall be obliged to pass the treatment on to the treated person for further professional treatment, if not for first aid.
In order to enable dentists to perform their tasks well, in particular to ensure a constant increase in the level of their professional work, they participate in training. The successful outcome of this training may be linked to the further pursuit of the profession of dentist. Training is managed by the Ministry of Health in agreement with participating ministries.
(1) The position of dentists is determined and amended by the Regional National Committee under the Ministry of Health's guidelines to comply with the single economic plan. If there is an important general health interest in transferring a dentist to a place of work in another region or if this is required by another important general health interest, the Ministry of Health shall determine it after hearing the Regional National Committee.
(2) When exercising the powers referred to in paragraph 1, the Regional National Committee, after the case of the Ministry of Health, shall, in particular, ensure that health care is provided under national insurance, in particular health care for factory workers.
The Regional National Committee, after the case of the Ministry of Health, will impose a certain work obligation on the dentist when determining the place of work or at any time thereafter in the field of public health and, if an important general health interest so requires, special tasks for exceptional needs.
The Regional National Committee shall prohibit a dentist from pursuing his profession unless he fulfils the conditions set out in Section 2. The same measure may also be taken by the Regional National Committee in respect of a dentist who does not fulfil the obligations imposed on him by the Law on Health Professionals or Regulations issued under it.
The provisions on reimbursement of travel, moving and other expenses, after the provisions on reimbursement of expenditure to training participants, shall apply to the reimbursement of expenses incurred by the dentist by taking over the obligations imposed under the Law on health professions and the Regulations issued under it.
The provisions of § 6 to 9 do not apply to dentists of the power taken. These provisions shall apply to the Dentists of the National Security Corps or the Prison Guard Corps only in respect of the pursuit of their profession outside their employment relationship; in determining the place of employment and imposing work obligations and exceptional tasks, those dentists shall be allowed to perform uninterrupted duties arising from their employment relationship.
(1) The Ministry of Health shall, in agreement with the central authorities involved and in cooperation with the Unified Trade Union Regulations, carry out further arrangements for the exercise of the profession of a dentist, with the exception of those of a military authority, the National Security Corps and the Prison Guard Corps. In this way, it shall in particular issue more detailed provisions:
(a) the tasks of dentists,
(b) dental testing;
(c) the conditions for authorising the profession of dentist to a stranger or to a person who has received an education or training in dental technology abroad;
(d) the licence referred to in Article 4 (2) (d);
(e) reimbursement of expenditure pursuant to Article 9.
(2) A closer regulation of the profession of Dentists of the National Security Corps and the Prison Guard Corps will be carried out by general legislation of the Ministry of National Security and Justice in agreement with the Ministry of Health.
This Regulation shall enter into force on 1 January 1951; They shall be carried out by health, national defence, national security and justice ministers in agreement with the participating members of the Government.
