DECLARATION
of 20 August 2024
amending certain regulations in the field of education
The Ministry of Education, Youth and Sports provides, pursuant to § 20 (8), § 28 (6), § 56 and 71 of Act No. 561 / 2004 Coll., on Pre-school, Primary, Secondary, Higher Vocational and Other Education (Education Act), as amended by Act No. 383 / 2005 Coll., Act No. 49 / 2009 Coll., Act No. 472 / 2011 Coll. and Act No. 82 / 2015 Coll.:
Amendment of the order on secondary education and education in the Conservatory
Decree No. 13 / 2005 Coll., on Secondary Education and Education in the Conservatory, as amended by Decree No. 374 / 2006 Coll., Decree No. 400 / 2009 Coll., Decree No. 197 / 2016 Coll., Decree No. 145 / 2018 Coll., Decree No. 200 / 2021 Coll., Decree No. 126 / 2022 Coll., Decree No. 250 / 2022 Coll. and Decree No. 266 / 2023 Coll., are amended as follows:
1. In Paragraph 6b (2), "24 'is replaced by" 36'.
2. In the first sentence of Paragraph 6d (1), "20 'is replaced by" 30'.
Amendment of the Decree on basic education and certain formalities for compulsory education
Decree No. 48 / 2005 Coll., on basic education and certain formalities for compulsory education, as amended by Decree No. 454 / 2006 Coll., Decree No. 256 / 2012 Coll., Decree No. 197 / 2016 Coll., Decree No. 243 / 2017 Coll., Decree No. 140 / 2018 Coll., Decree No. 196 / 2019 Coll., Decree No. 271 / 2021 Coll., Decree No. 250 / 2022 Coll., Decree No. 435 / 2022 Coll. and Decree No. 237 / 2023 Coll., are amended as follows:
1. Paragraph 5 (2) reads as follows:
"(2) Pupils from more than one grade may be classified in one class. Class 1 does not include pupils in the first and second stages. ';
2. In the third sentence of Section 8, the words "first degree 'are deleted.
3. The following Section 9a is inserted after Section 9, including the title:
Classification of foreigners
A stranger shall be classified in the relevant year by age. If his interest so requires, he may be included one year below, taking into account the level of his education and evaluation of his educational needs. "
4. In Article 10 (1), the last sentence is replaced by the following: "Only a school comprising classes of first and second degrees may be included in the list of designated schools, unless otherwise specified."
5. Paragraph 10 (5) reads as follows:
"(5) The Regional Authority shall include the school on the list of designated schools at its request from 1 September or from a later date during the school year, provided that the pupil is at least 5 pupils under Section 11 (1). This school has no obligation to provide language training for pupils from other schools. In accordance with the procedure laid down in this paragraph, a school comprising only classes of first degree may also be designated. ';
6. In Article 10 (7), the words "whether it is a designated school referred to in paragraph 1 or 5," shall be inserted after the words "in the manner."
7. In Paragraph 11 (1), "12 'is replaced by" 24'.
8. in Article 11a (3) to (5):
"(3) The Director of the DPO shall set up a separate group for pupils participating in language training in person (hereinafter referred to as the" presentation group ') and a group for pupils participating in language training in a distance manner (hereinafter referred to as the "distance group'), unless otherwise specified. The Director of the DPE shall set up a presentation and distance group for language preparation separately for pupils in the first and second levels, provided that each group has at least two pupils.
(4) The presentation group for first-degree pupils shall be set up at least 1 pupil and shall have a maximum of 8 pupils in accordance with § 11 (1), except for the first group for language preparation, which shall be produced at least 2 pupils and a maximum of 8 pupils in accordance with § 11 (1). A further presentation group for first-degree pupils may be set up if 8 pupils are included in each of the existing groups for first-degree pupils under Section 11 (1).
(5) The second-degree presentation group shall be set up at least 1 pupil and shall have a maximum of 10 pupils in accordance with § 11 (1), except for the first group for language preparation, which shall be produced at least 2 pupils and shall have a maximum of 10 pupils in accordance with § 11 (1). A further second-degree presentation group may be established if 10 pupils are included in each of the existing second-degree groups in accordance with Section 11 (1). "
9. In Paragraph 11a, paragraphs 6 to 9 are added:
"(6) The language preparation group shall be established at least 1 pupil and shall have a maximum of 5 pupils as referred to in Paragraph 11 (1), except for the first language preparation group, which shall be produced at least 2 pupils and a maximum of 5 pupils as referred to in Paragraph 11 (1). Another language preparation distance group may be established if 5 pupils are included in each of the existing groups under Section 11 (1).
(7) The Director of the DPO may set up a mixed group for language preparation for pupils in the first and second stages, provided that the establishment of separate groups is not possible for personnel reasons or for lack of applicants for language preparation. Paragraph 4 shall apply mutatis mutandis to the mixed group.
(8) The group will cease to exist if the conditions for its creation are not met, except in a situation where there is only one group in which one pupil remains.
(9) The school director may, on the basis of an assessment of the need for language support, include pupils other than pupils in the language preparation group referred to in § 11 (1), even in greater numbers than those provided for in paragraphs 4 to 6, provided that this does not prejudice the quality of the language training provided for in § 11 (1). '
10. in Article 11b (1), "200" is replaced by "400" and "10" is replaced by "20."
11. the following Article 11c is inserted after Article 11b, which includes the title:
Language training in preparatory classes
(1) The entitlement to language support in the language preparation groups referred to in Article 11a is also for children in the preparation classes.
(2) Article 10 to 11b applies to language preparation in preparatory classes, unless otherwise specified.
(3) Children in the preparatory classes are not included in the number or proportion applicable to the determination of the designated school in accordance with Section 10 (1). Children in the preparatory classes shall be counted against the number applicable to the determination of the designated school in accordance with Section 10 (5).
(4) The child in the preparatory class can only be included in the presentation group. "
12. In Article 15, the following paragraph 3 is inserted after paragraph 2:
"(3) The evaluation of the critical assessment is also considered to be a verbal assessment, where the pupil is evaluated from behaviours and from individual subjects on the basis of an assessment of the level of compliance with predetermined criteria. The specific criteria and the expression of the extent to which they are implemented shall be determined by the school director in the evaluation rules. ';
Paragraphs 3 to 6 shall be renumbered paragraphs 4 to 7.
13. in Paragraph 15 (5), "3" is replaced by "4."
14. in Paragraph 15 (7), "4" is replaced by "5."
15. In Articles 18 (8) and 18 (a) (6), the words "after having established the level of his education, the assessment of his educational needs and taking into account his age" shall be replaced by the words "by age" and, at the end of the paragraph, the sentence "If his interest so requires, he may be classified by one year below, taking into account the level of his education and evaluation of his educational needs."
16. in Paragraph 18e (4), the words "after determining the level of his education, the assessment of his educational needs and taking into account his age" shall be replaced by the words "by age" and after the first sentence, the sentence "If his interest so requires, he may be classified by one year below, taking into account the level of his education and evaluation of his educational needs."
17. in Article 24 (1), the words "9a to 11c" shall be inserted after the words "8."
18. in Article 24 (3), the words "11c" shall be inserted after the words "§ 6,";
Transitional provision
In the school year 2024 / 25, a foreigner who has completed compulsory schooling on the territory of the Czech Republic is entitled to language training for a maximum of 36 months.
Amendment to Decree No. 250 / 2022 Coll.
Decree No. 250 / 2022 Coll., amending Decree No. 13 / 2005 Coll., on Secondary Education and Education in the Conservatory, as amended, and Decree No. 48 / 2005 Coll., on Basic Education and certain requirements for compulsory education, as amended, as amended, Decree No. 266 / 2023 Coll., is amended as follows:
1. in Article I, point 2 is deleted;
2. in Article II, points 2, 8 and 10 are deleted;
3. in Article III, "Article I (2) and Article II (2), (4), (6), (8) and (10) 'is replaced by" Article II (4) and (6)';
EFFECTIVE
This Decree shall take effect on 1 September 2024.
