amending Act No. 18 / 1997 Coll., on the Peaceful Use of Nuclear Energy and Ionising Radiation (Atomic Act) and amending and supplementing certain laws, as amended, and Act No. 634 / 2004 Coll., on Administrative Charges, as amended
Parliament has decided on this law of the Czech Republic:
Amendment of the Atomic Law
Act No. 18 / 1997 Coll., on the Peaceful Use of Nuclear Energy and Ionizing Radiation (Atomic Act) and on the Amendment and Addition of Certain Acts, as amended by Act No. 83 / 1998 Coll., Act No. 71 / 2000 Coll., Act No. 132 / 2000 Coll., Act No. 13 / 2002 Coll., Act No. 253 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 158 / 2003 Coll., Act No. 223 / 2004 Coll., Act No. 296 / 2007 Coll., Act No. 124 / 2008 Coll., Act No. 189 / 2008 Coll., Act No. 186 / 2006 Coll., Act No. 342 / 2006 Coll.
1. in Article 3 (2), the words "and ensure compliance with other obligations arising from European Union41 regulations" shall be added at the end of the text in point (t), in particular concerning the national and international assessment of the state supervision of nuclear safety of nuclear installations. "
footnote 41 reads as follows:
"41) Council Directive 2009 / 71 / Euratom of 25 June 2009 establishing a Community framework for the nuclear safety of nuclear installations.";
2. The following Sections 3a to 3g are inserted after Section 3, including the headings:
Fees for professional activities of the Office
Fees for the Office's professional activities shall be:
(a) a fee for an application for an authorisation ("application fee");
(b) maintenance fee.
Fees for the Office's professional activities
(1) The application fee is payable by the applicant for the authorisation.
(2) The fee shall be payable by the holder of the authorisation.
Subject matter of fees for professional activities of the Office
(1) The subject of the application fee shall be the Office's work related to the issue of:
(a) a permit to place a nuclear installation;
(b) permit for construction
1. nuclear equipment; or
2. Category IV workplace with open radionuclide radionuclide radiators,
(c) first permit to operate
1. nuclear equipment;
2. a Category III site for the extraction and processing of uranium ore; or
3. Category IV workplace with open radionuclide radionuclide radiators; or
(d) permit for individual decommissioning stages
1. nuclear equipment;
2. a Category III site for the extraction and processing of uranium ore; or
3rd Category IV workplace with open radionuclide radionuclides.
(2) The maintenance fee shall cover the activities of the Office relating to the exercise of State supervision over the activities of holders of authorisations to:
(a) operations
1. nuclear equipment;
2. a Category III site for the extraction and processing of uranium ore; or
3. Category IV workplace with open radionuclide radionuclide radiators; or
(b) individual decommissioning stages
1. nuclear equipment;
2. a Category III site for the extraction and processing of uranium ore; or
3rd Category IV workplace with open radionuclide radionuclides.
Exemption from fees for professional activities of the Office
(1) The fees of the Office's professional activities shall be exempt:
(a) public HEIs and medical establishments carrying out activities under this law for public health insurance;
(b) persons who carry out activities under this law only for public scientific and research funding, including European Union funds.
(2) The facts relevant for exemption from professional fees of the Office are evidenced by the taxpayer when applying for an authorisation or at the request of the Office.
(3) Where there is a change in the facts relevant to the exemption from fees for the professional activities of the Office, the taxpayer shall notify the Office of that fact within 15 days of the date on which the change took place.
Fees for the Office's professional activities
(1) The rate of the application fee in the case of an application for authorisation shall be as follows:
(a) Paragraph 3c (1) (a) shall not exceed CZK 30 000 000;
(b) Paragraph 3c (1) (b) shall not exceed CZK 150,000;
(c) § 3c (1) (c) maximum 60 000 000 CZK,
(d) § 3c (1) (d) maximum 60 000 000 CZK.
(2) The rate of the maintenance fee is up to CZK 4 000 000 for each calendar month in which the fee obligation lasted.
(3) The Government lays down, by regulation, the rates of fees for the professional activities of the Office for each activity of the Office in accordance with Section 3c.
Charging obligation for maintenance fee
(1) The fee payable shall be incurred on the first day of the calendar month in which the decision granting the authorisation became final.
(2) The fee requirement for the maintenance fee expires on the last day of the calendar month in which the authorisation expired.
Administration and budgetary identification of fees for the Office's professional activities
(1) The fee for the application is payable within 30 days of the date of the application for authorisation.
(2) The maintenance fee shall be payable within 30 days of the end of the fee period of the calendar year.
(3) The management of fees for the professional activities of the Office shall be carried out by the Office.
(4) Fees for the Office's professional activities are the revenue of the State budget. "
3. in Article 12 (1), the following point (b) is inserted after point (a):
"(b) for irradiation-related medical radiodiagnostic activities in the provision of dental care by dental practitioners, professional competence in the profession of dental practitioner under the Law on the pursuit of the medical profession of physician, dental practitioner and pharmacist,"
Point (b) shall be renumbered (c).
4. In Paragraph 12 (1) (c), the word "others' shall be inserted after the word" for '.
5. In Article 12 (2), "(a) and (b) 'is replaced by" (a) and (c)';
6. in Article 17 (1) (a), the words "the responsibility for ensuring nuclear safety cannot be transferred to another person" shall be inserted after the word "safety."
7. In Paragraph 18 (1) (p), the words "the European Communities' are replaced by the words" the European Union '.
8. In Paragraph 18, at the end of paragraph 1, the dot is replaced by a comma and the following point (s) is added:
"(s) to ensure and maintain the appropriate financial and human resources needed to fulfil nuclear safety obligations of nuclear installations.";
Amendment of the Administrative Charges Act
Item 106 of the Annex to Act No 634 / 2004 Coll., on Administrative Charges, including footnote 65, reads as follows:

Exemption
The management of radioactive waste storage sites and p. DIAMO shall be exempt from the charges specified in this item.
65) Paragraph 9 (1) of Act No. 18 / 1997 Coll., on the Peaceful Use of Nuclear Energy and Ionizing Radiation (Atomic Act) and on the amendment and addition of certain laws, as amended. "
EFFECTIVE
This Law shall take effect on the day of its publication, with the exception of the provisions of Articles I (2) and II, which shall take effect on 1 January 2012.
