laying down certain details and detailed conditions for implementing the measures of the common organisation of the market in beef and veal, pigmeat, poultry, sheepmeat and goatmeat and eggs and granting special export subsidies for beef and veal and for certain cuts of boned beef
The Government orders pursuant to § 2b (2) and to implement § 2a of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., and to implement Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 128 / 2003 Coll. and Act No. 85 / 2004 Coll.:
Subject matter
This Regulation lays down certain details and conditions for implementing the measures of the common organisation of the market in beef and veal, pigmeat, poultry, sheepmeat and goatmeat, and eggs and for granting specific export subsidies for beef and veal and for certain types of boned beef, the provisions of which are directly binding in European Community1) (hereinafter referred to as "the European Communities') to the Member States of the European Union or allow them to be implemented.
Definition of terms
For the purposes of this Regulation:
(a) slaughterhouses of establishments of a natural or legal person for slaughter in which more than one week's average is slaughtered in a calendar year than:
1.20 head of bovine animals for slaughter,
2.50 pigs,
3.10,000 pieces of chickens for slaughter,
4.2 000 turkeys,
5.5 pieces of sheep, or
6.5 pieces of goats,
(b) by an intermediary, a natural or legal person who, in the last calendar year of the week, has facilitated the purchase of more than:
1.20 head of calves for slaughter or bovine animals for slaughter,
2.50 pigs,
3.5 piglets,
4.5 pieces of sheep, or
5.5 pieces of goats,
(c) by a producer, a natural or legal person who produces or buys poultry for slaughter or piglets for further use;
(d) poultry cuts of establishments of a natural or legal person for slaughter in which more than one carcass is processed in a weekly average in a calendar year than
1.10,000 pieces of chickens for slaughter, or
2.2 000 turkeys,
(e) special export subsidy under European Community rules, 2)
(f) the packing establishment of a natural or legal person for the production or sale of an average of 100 000 eggs packed per week for the previous calendar year.
Certain provisions concerning the granting of private storage aid
The proposal for the conclusion of a contract for private storage aid and a tender under the European Communities Regulation (3) shall be submitted to the State Agricultural Intervention Fund (hereinafter referred to as the Fund) on the forms issued by it.
(1) The person with whom the Fund has concluded a private storage aid contract under European Community rules (3) shall provide the Fund with the following documents:
(a) notification of slaughter, destruction and storage operations;
(b) a summary of the slaughter and storage of the whole quantity of meat;
(c) notification of removal from storage or partial removal of meat for export;
(d) a statement of the quantities of meat removed,
(e) an application for payment of an advance on private storage aid;
(f) an application for payment of the aid or a supplement to the private storage aid and the release of the guarantee.
(2) The forms of documents referred to in paragraph 1 shall be issued by the Fund.
Submission of an invitation to tender for intervention buying-in
Tenders for intervention buying-in under European Communities and special legislation4) shall be submitted to the Fund on forms issued by the Fund.
Intervention storage
(1) The person with whom the Fund has concluded an intervention storage contract under European Community rules (4) and specific legislation (4) shall provide the Fund with the following documents:
(a) demolition protocol;
(b) the notification of the intervention warehouse;
(c) monthly notification of the intervention warehouse;
(d) the annual report of the intervention warehouse.
(2) The forms of documents referred to in paragraph 1 shall be issued by the Fund.
Intervention sale
An offer for buying-in of intervention meat and an application for buying-in of intervention meat in the context of the sale of intervention meat by the Fund under European Community and special legislature5 shall be submitted to the Fund on the basis of forms issued by the Fund.
Market and price reports
Market and price reporting for beef
(1) The slaughterhouses and intermediaries shall provide information on:
(a) the sources, stocks and uses of meat; the information shall be submitted to the Fund for each calendar month by the 10th day of the following calendar month,
(b) the sources, stocks and distribution of meat products; the information shall be submitted to the Fund for each calendar month by the 10th day of the following calendar month,
(c) the development of the average prices and quantities of animals for slaughter and the prices of the types of meat and products selected; the information shall be submitted to the Fund for each calendar month by the 10th day of the following calendar month,
(d) the prices paid to farmers for animals for slaughter, meat and products delivered and their quantities; the information shall be submitted to the Fund for the 13th and 27th calendar days in a calendar month until the following day,
(e) weekly prices paid to farmers for slaughter animals delivered, including weekly prices for animals delivered from organic farming holdings, according to the SEUROP Code classification (7) and fat cover classes and their quantities; the information shall be submitted to the Fund for each calendar week by the following Monday,
(f) weekly selling prices for beef forequarters, beef hindquarters and beef minced meat; the information shall be submitted to the Fund for each calendar week by the following Monday.
(2) The information referred to in paragraph 1 (c) to (f) on prices shall be submitted to the Fund as a weighted average in prices excluding VAT.
(3) The information referred to in paragraph 1 shall be submitted to the Fund in such a way as to enable the remote transmission of data (hereinafter referred to as "electronic or telefax"), where appropriate in paper form.
(4) The information referred to in paragraph 1 shall be submitted on forms issued by the Fund.
Market and price reports for pigmeat
(1) slaughterhouses and intermediaries shall provide information on:
(a) the sources, stocks and uses of meat; the information shall be submitted to the Fund for each calendar month by the 10th day of the following calendar month,
(b) the sources, stocks and distribution of meat products; the information shall be submitted to the Fund for each calendar month by the 10th day of the following calendar month,
(c) the development of the average prices and quantities of animals for slaughter and the prices of the types of meat and products selected; the information shall be submitted to the Fund for each calendar month by the 10th day of the following calendar month,
(d) the prices paid to farmers for animals for slaughter, meat and products delivered and their quantities; the information shall be submitted to the Fund for the 13th and 27th calendar days in a calendar month until the following day,
(e) weekly prices paid to farmers for animals for slaughter delivered, including weekly prices for animals delivered from organic farming holdings according to the SEUROP 9 classification and conformation classes; the information shall be submitted to the Fund for each calendar week by the following Monday,
(f) weekly selling prices for pork roast, pork flank, pork shoulder, ham and minced pig meat; the information shall be submitted to the Fund for each calendar week by the following Monday.
(2) The producer and intermediary shall provide the Fund with information on the prices and quantities of piglets for each calendar week by Monday of the following calendar week, on the basis of European Community and special legislature6.
(3) The information referred to in paragraph 1 (c) to (f) and in paragraph 2 on prices shall be submitted to the Fund as a weighted average in prices excluding VAT.
(4) The information referred to in paragraphs 1 and 2 shall be submitted to the Fund electronically or by fax, where appropriate in paper form.
(5) The information referred to in paragraphs 1 and 2 shall be submitted on forms issued by the Fund.
Market and price reports for poultry, poultrymeat and eggs
(1) Slaughterhouses and poultry cuts under European Community and Special Legislation (10) provide the Fund with information on:
(a) the quantity sold and the selling price of whole grade A chickens, including the quantity sold and the selling price of whole organic farming chickens; and
(b) the quantity sold and the selling price of chicken breast cuttings and chicken thighs.
(2) The information referred to in paragraph 1 shall be submitted to the Fund for each calendar week by Monday of the following calendar week by 12.00.
(3) Producers shall provide the Fund with information on:
(a) the selling prices of Class A slaughter poultry for 1 kg live weight in CZK at prices excluding VAT;
(b) the quantity of Class A slaughter poultry sold in pieces;
(c) the quantity of Class A slaughter poultry sold in kilograms.
(4) The information referred to in paragraph 3 shall be submitted to the Fund for each calendar month by the 20th day of the following calendar month.
(5) Packages under European Community and special legislation11) provide the Fund with information on:
(a) the quantities of packed eggs sold broken down by M and L weight groups and by farming technology;
b) sales prices of packed eggs in CZK for 100 units in prices excluding VAT broken down by weight groups M and L.
(6) The information referred to in paragraph 5 shall be submitted to the Fund for each calendar week by Monday of the following calendar week at 12.00 hours.
(7) The information referred to in paragraphs 1, 3 and 5 shall be submitted to the Fund electronically or by fax, where appropriate in paper form.
(8) The information referred to in paragraphs 1, 3 and 5 shall be submitted on forms issued by the Fund.
Market and price reports for sheepmeat and goatmeat
(1) slaughterhouses and intermediaries shall provide information on the development of the average prices of slaughter animals and the prices of selected types of meat and products and their quantities, on the basis of specific legislation11); the information shall be submitted to the Fund for each calendar month by the 10th day of the following calendar month.
(2) The information referred to in paragraph 1 on prices shall be submitted to the Fund as a weighted average of sales prices excluding VAT.
(3) The information referred to in paragraph 1 shall be submitted electronically or by fax to the Fund, where appropriate in paper form.
(4) The information referred to in paragraph 1 shall be submitted on forms issued by the Fund.
Providing specific export subsidies
(1) The application for a special subsidy certificate for export under European Community rules (12) shall be submitted to the Fund using the form issued by the Fund.
(2) Declaration under the rules of the European Community13) shall be submitted to the Fund using the form issued by the Fund.
Efficacy
This Regulation shall enter into force on the date of the entry into force of the Treaty of Accession of the Czech Republic to the European Union.
