DECLARATION
of 5 August 2024
on technical and security requirements for electronic auction systems
According to § 29 (2) of Act No. 250 / 2023 Coll., the Ministry of Local Development provides for public auctions:
§ 1
(1) The electronic auction system must:
(a) all communication between the participants in the electronic auction (hereinafter referred to as "auction") and the electronic auction system is provided in a secure encrypted way by means of network protocol, cryptographic algorithms and server certificates that are currently resistant;
(b) time synchronised with coordinated world time;
(c) adapted to display the content of the website where the auction takes place when displayed in the mobile device by means of a responsive website design or mobile version of the website;
(d) authentication of persons applying for it is carried out;
(e) at the website where the auction takes place, the auction participant shall be identified by an insignificant identifier assigned to it at random for each individual auction;
(f) the electronic acts of the auctioneer and the auctioneer and the electronic acts carried out automatically by the electronic auction system shall be processed and recorded with an accuracy of at least one hundredth of a second; and
(g) automatically update the data at the website where the auction takes place within 5 seconds of their change.
(2) The server certificate referred to in paragraph 1 (a) must be issued by a recognised certification authority, be valid and correspond to all domain names used by the electronic auction system.
(3) Synchronisation of system time with coordinated world time according to paragraph 1 (b). (b) must be carried out at least once every 24 hours.
(4) Authentication of persons referred to in paragraph 1 (d) must be carried out at least by entering the username and password. The username is unique for each person and consists of at least 6 characters. The password consists of at least 12 characters and contains at least 1 capital letter, 1 small letter, 1 digit and 1 special character. Passwords must be stored in an electronic auction system only in coded form using a currently resistant cryptographic algorithm.
(5) The electronic auction system must not allow intervention in the course of an auction which is contrary to the Public Auction Act.
§ 2
(1) The completeness and integrity of the registration of the requirements of arrivals to the website where the auction takes place must be ensured by a hosting service supplier or an internet connection supplier who is different from the auctioneer and from an electronic auction system operator.
(2) The availability of the auction website must be checked by means of a service set up which carries it out from a geographical location other than that of a controlled website. The provider of this service shall be different from the auctioneer and from the operator of the electronic auction system.
§ 3
(1) It must be possible to use the electronic auction system in a commonly available electronic device and a free and currently supported version of the Internet browser without the need to install other applications except for the normal extension of the browser. Information on the minimum configuration of the electronic equipment with which an auction may take place shall be included in the publicly available part of the electronic auction system.
(2) Documents must be published in the electronic auction system in PDF / A format.
(3) In the publicly available part of the electronic auction system, a user manual shall be available detailing the important functionalities of the system.
(4) The electronic auction system must allow access to the website where the auction took place, for at least 1 year after the auction is concluded.
§ 4
(1) On the auction website, the electronic auction system must display to the public:
(a) information on the time remaining until the start of the auction and the current time;
(b) the history of the tenders submitted, including the designation of the auction participants by their insignificant identifier;
(c) the amount of the last tender separately from the history of the tenders submitted; and
(d) information on the remaining time during which tenders may be submitted.
(2) The website where the auction takes place must be accessible to the public without the need for registration in the electronic auction system.
§ 5
Efficacy
This Decree shall take effect on 1 January 2025.
