DECLARATION
of 7 June 2005
amending Decree No 330 / 2004 Coll., on measures to prevent the introduction and spread of harmful organisms of plants and plant products, as amended by Decree No 662 / 2004 Coll.
The Ministry of Agriculture pursuant to § 88 (1) (b) of Act No. 326 / 2004 Coll., on Phytosanitary Care and on the Amendment of Certain Related Acts (hereinafter "the Act ') provides:
Decree No. 330 / 2004 Coll., on measures to prevent the introduction and spread of harmful organisms of plants and plant products, as amended by Decree No. 662 / 2004 Coll., is amended as follows:
1. In the introductory sentence, the words "and in accordance with the law of the European Communities (hereinafter referred to as the Community) 1 ', including footnote 1, are deleted.
2. In Section 1, the heading "Basic terms' is replaced by the heading" Subject matter of adaptation and basic terms'.
3. In Section 1, the following paragraph 1 is added:
"(1) This decree (1) incorporates the relevant provisions of the European Communities (hereinafter referred to as the Community) 1a and provides for measures to prevent the introduction and spread of harmful organisms of plants and plant products.
1) It is issued on the basis and within the limits of the law in which the relevant Directives of the European Communities have already been reflected.
(1a) Commission Directive 92 / 70 / EEC of 30 July 1992 laying down detailed rules for surveys carried out for the recognition of protected zones in the Community. Commission Directive 92 / 90 / EEC of 3 November 1992 laying down the obligations to which producers and importers of plants, plant products or other objects are subject and laying down the details for their registration. Commission Directive 92 / 105 / EEC of 3 December 1992 establishing the degree of unification of plant passports used for the movement of certain plants, plant products or other objects within the Community and the detailed procedures for the issue of such plant passports and the conditions and detailed procedures for their replacement. Commission Directive 93 / 50 / EEC of 24 June 1993 determining certain plants not listed in Part A of Annex V to Council Directive 77 / 93 / EEC whose producers or warehouses or dispatch centres in the production areas of those plants must be entered in an official register. Commission Directive 93 / 51 / EEC of 24 June 1993 laying down rules for the movement of certain plants, plant products or other objects through a protected zone and for the movement of such plants, plant products or other objects within the protected zone of origin. Commission Directive 94 / 3 / EC of 21 January 1994 establishing a procedure for the notification of the detention of a consignment or harmful organism originating in third countries and presenting an imminent plant health risk. Commission Directive 95 / 44 / EC of 26 July 1995 laying down the conditions under which certain harmful organisms, plants, plant products and other objects listed in Annexes I to V to Council Directive 77 / 93 / EEC may be imported into or moved in the Community or certain protected zones of the Community for experimental or scientific purposes and work in the breeding of varieties. Commission Directive 97 / 46 / EC of 25 July 1997 amending Directive 95 / 44 / EC laying down the conditions under which certain harmful organisms, plants, plant products and other objects listed in Annexes I to V to Council Directive 77 / 93 / EEC may be imported into or moved within the Community for experimental or scientific purposes and for the breeding of varieties. Commission Directive 98 / 22 / EC of 15 April 1998 laying down minimum conditions for carrying out plant health checks on plants, plant products or other objects originating in third countries at inspection points other than those of destination in the Community. Council Directive 2000 / 29 / EC of 8 May 2000 on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community. Commission Directive 2001 / 33 / EC of 8 May 2001 amending certain Annexes to Council Directive 2000 / 29 / EC on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community. Commission Directive 2002 / 28 / EC of 19 March 2002 amending Council Directive 2000 / 29 / EC on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community. Commission Directive 2004 / 105 / EC of 15 October 2004 laying down models of official phytosanitary certificates or phytosanitary certificates for re-export accompanying plants, plant products or other objects from third countries referred to in Council Directive 2000 / 29 / EC. Council Directive 2005 / 15 / EC of 28 February 2005 amending Annex IV to Directive 2000 / 29 / EC on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community. Commission Directive 2005 / 16 / EC of 2 March 2005 amending Annexes I to V to Council Directive 2000 / 29 / EC on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community. Commission Directive 2005 / 17 / EC of 2 March 2005 amending certain provisions of Directive 92 / 105 / EEC relating to plant passports. ';
Paragraphs 1 and 2 shall become paragraphs 2 and 3.
Footnotes 1a to 1c are renumbered as footnotes 1b to 1d.
4. in Article 2 (1) (a), the words "and vines" shall be inserted after the words "fruit species."
5. in Article 15 (2) (a), "EU-Plant Health Passport" is replaced by "EC Plant Health Passport";
6. Paragraph 15 (5), including footnote 6, reads:
"(5) For potato tubers (Solanum tuberosum L.) intended for cultivation (seed potatoes) and referred to in point 18.1. of Annex No 4, Part A, Section II,, the plant passport may be replaced by an official label in accordance with a specific legislation6) provided that the label confirms compliance with the specific requirements laid down in Annex 4, Part A. As from 1 January 2006, the designation" EC Plant Health Passport 'on the label shall be regarded as such confirmation. Details of compliance with the conditions laid down for seed potatoes intended to be moved to and moved within the protected zone concerned, established with regard to harmful organisms relevant to seed potatoes, shall be given either on this label or on any document used in trade.
6) Article 14 of Decree No 175 / 2004 Coll., laying down details of the marketing of seeds and seed plants, as amended by Decree No 40 / 2005 Coll. '.
7. In Article 15, paragraphs 6 to 8 are added:
"(6) For sunflower seed (Helianthus annus L.) referred to in point 26 of Annex 4 to Part A Section II of the plant passport may be replaced by an official label in accordance with a specific legislation (6), provided that the label confirms compliance with the specific requirements laid down in Annex 4, Part A. As from 1 September 2005, the designation" EC Plant Health Passport 'shall be regarded as such on the label.
(7) For tomato seed (Lycopersicon lycopersicum L. Karsten ex. Farw.) and bean seed (Phaseolus L.) referred to in points 27.1, 27.2 and 29.4 of Annex No 4 Part A Section II of the plant passport may be replaced by an official label in accordance with a specific legislation (6), provided that the label confirms compliance with the specific requirements laid down in Annex 4, Part A. As from 1 September 2005, the designation "EC Plant Health Passport 'shall be regarded as such on the label.
(8) For Lucerne seed (Medicago sativa L.) referred to in points 28.1 and 28.2 of Annex 4 to Part A Section II of the plant passport may be replaced by an official label in accordance with a specific legislation (6), provided that the label confirms compliance with the specific requirements laid down in Annex 4, Part A. As from 1 September 2005, the designation "EC Plant Health Passport" shall be deemed to be such confirmation. ';
8. in Annex No 1 (A) (I) (a) (7), (8) and (25) and (d) (2), (5) and (6), the word "in particular" shall be inserted after the words "which are";
9. in Annex No 2 (B) (a) (3), the right column reads:
"Greece, Ireland, the United Kingdom of Great Britain and Northern Ireland (Northern Ireland, Isle of Man and Jersey) '.
10. In Annex No 2 (B) (b) (2) to the right column, the word "Estonia 'is inserted after the word" Spain'.
11. in Annex 2 (B) (d) to the right-hand column, the word "Italy," shall be deleted;
12. In Annex 3 (B) (1) and (2) to the right column, the word "Estonia 'is inserted after the word" Spain'.
13. In Annex 4, Part A, Section I, point 2 reads as follows:
| „2. Dřevěný obalový materiál, ve formě obalových beden, bedniček, přepravek, bubnů a podobných dřevěných obalů, palet, ohradových palet a jiných přepravních podložek, nástavných rámů palet, použitý k přepravě předmětů všeho druhu, s výjimkou dřeva surového o tloušťce 6 mm nebo menší a dřeva zpracovaného pomocí lepidla, tepla a tlaku, nebo jejich kombinací, původem ze třetích zemí, s výjimkou Švýcarska. | Dřevěný obalový materiál musí: | ||
| - být podroben jednomu ze schválených ošetření stanovených v příloze I Mezinárodního standardu FAO pro fytosanitární opatření č. 15 Směrnice zavádějící pravidla pro dřevěný obalový materiál v mezinárodním obchodu a | |||
| - být opatřen značkou, | |||
| a) podle přílohy II Mezinárodního standardu FAO pro fytosanitární opatření č. 15 Směrnice zavádějící pravidla pro dřevěný obalový materiál v mezinárodním obchodu, která obsahuje dvoupísmenný ISO kód země, kód identifikující producenta a kód označující provedení schváleného ošetření dřevěného obalového materiálu, | |||
| b) v případě, že byl obalový materiál vyroben, opraven nebo znovu použit v době od 1. března 2005, obsahující také logo uvedené v příloze II tohoto standardu FAO. Tento požadavek se ale přechodně až do 31. prosince 2007 nevztahuje na dřevěný obalový materiál, vyrobený, opravený nebo znovu použitý před datem 28. února 2005.“ | |||
14. In Annex 4 (A) (I), point 7.3. of the right column (a), "wood temperature 'is replaced by" bark temperature'.
15. In Annex 4, Part A, Section I, point 8 reads as follows:
| „8. Dřevo použité k zaklínění nebo podepření nákladů neobsahujících dřevo, včetně dřeva hraněného, s výjimkou dřeva surového o tloušťce 6 mm nebo menší a dřeva zpracovaného pomocí lepidla, tepla a tlaku, nebo jejich kombinací, původem ze třetích zemí, s výjimkou Švýcarska. | Dřevo musí: | |

| nebo přechodně až do 31. prosince 2007 | ||
| - být vyrobeno ze dřeva, které je prosté kůry, škodlivých organismů a příznaků napadení škodlivými organismy.“ | ||
16. In Annex No 4, Part A, Section II, point 18.5. of the left column:
"18.5. Taps of Solanum tuberosum L. other than:
- those referred to in points 18.1, 18.2, 18.3 or 18.4, Part A, Section II of this Annex, and other than:
- tubers marketed in packs of 5 kg or less and intended for use by owners or recipients for non-commercial purposes or for consumption during transport, unless there is a risk of spreading harmful organisms. "
17. in Annex 4, Part B, points 1, 7 and 14.1, the right column shall read:
"Greece, Ireland, the United Kingdom of Great Britain and Northern Ireland (Northern Ireland, Isle of Man and Jersey) '.
18. In Annex 4, Part B, point 14.7, in the middle column, in point (b), the words "subjected 'are replaced by the words" submitted' and the words "wood temperature 'are replaced by the words" bark temperature'.
19. In Annex No 4, Part B, points 20.1. and 20.2. of the right column, the word "Denmark," is deleted.
20. In Annex 4, Part B, point 21, in the middle column, in point (c), the word "Ticino," is deleted and in the right-hand column, the word "Estonia," is inserted after the word "Spain,"
21. In Annex No 4, Part B, point 21.1. of the middle column, the words "In addition to the prohibitions resulting from these plants from point 15 of Annex 3, Part A, official confirmation that plants: 'are replaced by the words" In addition to the prohibition resulting from point 15 of Annex 3, Part A, and applicable to the introduction into the Community of plants of Vitis L., other than fruits, from third countries (except Switzerland), official confirmation that plants:'.
22. In Annex 4, Part B, point 21.3., in the middle column, in point (b), the word "Ticino," is deleted and in the right-hand column, the word "Estonia," is inserted after the word "Spain,"
23. in Annex 4, Part B, points 22, 23, 25, 26, 27.1, 27.2 and 30, the word "Denmark," shall be deleted;
24. Point 31 of Part B of Annex 4 reads as follows:
| „31. Transitional provision
The designation of the plant passport "EU-Plant Health Passport 'under current legislation may be used until 31 December 2005; in the case of its use for plants and plant products placed on the market in the territory of the Czech Republic, the designation of the plant passport" EU-Plant Health Passport' may be used until 30 June 2006 in accordance with existing legislation.
Efficacy
This decree shall take effect on the day of its publication.
