Law amending and supplementing the regulations on public staff purification committees

amending and supplementing the provisions on cleaning committees for the review of the activities of public servants.
The Constitutional National Assembly of the Czechoslovak Republic decided on this law:
Čl. I.
The Decree of the President of the Republic of 4 October 1945, No. 105 Coll., on the Purgatory Committees for the Review of the Activities of Public Employees, as amended by the Law of 16 May 1946, No. 130 Coll., hereinafter referred to as "Decree ', is amended and supplemented as follows:
1. In the first sentence of Article 5 (1), the words "and the Chief Purgatory Commission 'are inserted after the words" Purgatory Commission'. Paragraph 2 of the same paragraph is deleted, paragraph 3 is renumbered to paragraph 2 and paragraph 4 to paragraph 3.
2. Paragraph 18 (3), second sentence:
"The President of the Chamber, after a member of the Chamber (rapporteur) authorised by him, shall report the case '.
3. Paragraph 32 reads as follows:
"The scope of the Purgatory Committees shall expire on 4 May 1947. The High Purgatory Commission shall continue its activities after this date. '
Čl. II.
Final time limit for the submission of reprimand notices.
(1) Credits may be dealt with in accordance with a decree, provided that they have been lodged with the relevant Purgatory Commission not later than 30 days after the date of the entry into force of this Act in those cases where the facts of the offence are known to the Office (authority) responsible for submitting the disciplinary notice on the basis of its own proceedings at the latest by the date of the entry into force of that law.
(2) On expiry of the period laid down in paragraph 1, the Chairman of the Purgatory Board shall reject notifications as inadmissible. The disciplinary representative may lodge a complaint against this decision within 15 days of the date of receipt of the decision by the Purgatory Board to the competent Chief Purgatory Commission.
(3) The fact that it was not possible to give disciplinary notice to an activity which could be prosecuted in accordance with § 2 of the Decree or within the time limit laid down in paragraph 1 does not preclude the conduct of normal disciplinary (disciplinary) proceedings, where such activity constitutes the substance of a professional offence pursuant to § 87, following the case of § 153 of the service pragmatics or similar provisions. In such cases, the provisions of Paragraph 12 (3) of the Decree do not apply.
Čl. III.
Discussing cases unended by purgatory commissions.
(1) On 5 May 1947, the powers of the Purgatory Committees to discuss cases pending shall be transferred to the Disciplinary Board (other competent disciplinary bodies). If there is a staff member for whom the Disciplinary Board is responsible as a single seat, the latter shall decide definitively in a single seat.
(2) If the Commission (authority) is not competent (competent) in accordance with the previous paragraph, the powers of the Purgatory Commission shall be transferred to the Disciplinary Board for pragmatic officials and officers of the Regional National Committees (in Slovakia for the District National Committees) and the Chief Purgatory Board to the Chief Disciplinary Board for the Ministry of Interior (in Slovakia for the Internal Affairs).
(3) The Commission (authorities) continues the procedure under the rules applicable to them with the amendment that the provisions of Sections 1 to 3 and 29 of the Decree apply to the definition of personal scope and enforceable activity, to the penalties and to the payment of the salary withheld during the suspension period and to the counting of that period.
Čl. IV.
This Act shall take effect on the day of its publication; it shall be carried out by all members of the Government.
