Article 2
3. in Articles 2 (a), 4 (1) (c), 17 (b), 41 (1) (c), 44 (1) (d), 45 (1) (b), 48 (1) (b) and (c), 49 (1) (b), 57 (2), 67 (5) and 67a (3), the word "control" shall be replaced by "control."
4. In Article 3 (1) (c), the words "fur animals," shall be deleted and the word "bumblebees" shall be inserted after the word "hives."
5. in Article 3 (1), point (f) is deleted;
Points (g) to (mm) shall be renumbered as points (f) to (ll).
6. Paragraph 3 (1) (j) reads as follows:
"(j) an outbreak as referred to in Article 4 (40) of Regulation (EU) 2016 / 429 of the European Parliament and of the Council,"
7. in § 3 (1) (t):
"(t) the withdrawal period referred to in Article 4 (34) of Regulation (EU) 2019 / 6 of the European Parliament and of the Council of 11 December 2018 on veterinary medicinal products and repealing Directive 2001 / 82 / EC, as amended,"
footnote 5a is deleted.
8. in Article 3 (1) (hh), the words "for the epidemiological surveillance network and" shall be replaced by the words "State Veterinary Administration or the Municipal Veterinary Administration in Prague State Veterinary Administration (hereinafter the Regional Veterinary Administration)."
9. In Article 3 (1), the words "or abused animals' shall be added at the end of the text of point (j).
10. in Article 3 (1) (kk), the words "which are made up of mothers, workers and drones and" shall be inserted after the words "bees."
11. in Article 3, the following paragraph 7 is added:
"(7) Where reference is made in this Act to movements of animals or animal products concerning a Member State, this shall also mean another Contracting State of the Agreement on the European Economic Area. '
12. in Paragraph 4, the following paragraphs 3 and 4 are inserted after paragraph 2:
"(3) The keeper of the dog must ensure that the dog is marked with an electronic chip which complies with the technical requirements laid down in Annex II to the European Union Code on animal health conditions for the non-commercial movement of pet animals 48 (hereinafter referred to as the" electronic chip "), with the exception of a dog which was marked with a legible tattoo carried out before 3 July 2011. The breeder of the newly born dog is obliged to ensure the marking of the dog by electronic chip before offering the dog for sale or handing the dog to the new breeder, but no later than 3 months of age of the dog. The keeper of the dog shall also ensure that the identification number of the dog is recorded in the document of vaccination of the dog. The dog's identification number means an alphanumeric code displayed by an electronic chip that allows identification of a specific dog.
(4) The obligations of the keeper of the dog referred to in paragraph 3 shall not apply to breeders of experimental animals, suppliers of experimental animals or users of experimental animals under the Animal Protection Act 6), armed forces, security corps, military police or municipal police 68) as regards dogs used to perform the tasks of the municipal police. ';
Paragraphs 3 to 7 shall be renumbered paragraphs 5 to 9.
13. in Article 4 (5), the words "State Veterinary Administration or Municipal Veterinary Administration in Prague State Veterinary Administration (" Regional Veterinary Administration ")" shall be deleted;
14. in Paragraph 4 (6), "paragraph 3" is replaced by "paragraph 5."
15. in Article 4 (7) and Article 4 (8) of the introductory part of the provision, the words "3 and 4" are replaced by the words "5 and 6."
16. Paragraph 4 (9) is deleted.
17. In Article 4a, at the end of paragraph 3, the sentence "Passport is a public instrument. 'is added.
18. in Paragraph 4a, the following paragraph 6 is inserted after paragraph 5:
"(6) The passports referred to in paragraph 3 shall also be issued by a university carrying out an accredited master's study programme in the field of veterinary medicine and hygiene approved by the Regional Veterinary Administration for this activity. The rights and obligations of a veterinarian authorised to issue passports shall apply mutatis mutandis to a university approved to issue passports. The approval of a university for the issue of passports may be suspended or withdrawn by the Regional Veterinary Administration if the university has issued a passport with demonstrably false data, completed incompletely or incorrectly, or in breach of the conditions laid down in this Act or European Union Regulation on animal health conditions for the non-commercial movement of pet animals 48). '
Paragraphs 6 and 7 shall be renumbered paragraphs 7 and 8.
19. in Article 4b (3) (a), the words "or university" shall be inserted after the words "to veterinary surgeons."
20. The following Section 4c is inserted after § 4b:
The marking of the dog referred to in Article 4 (3) or the marking of pet animals by electronic chip in accordance with the European Union Regulation on the animal health conditions for the non-commercial movement of pet animals (65) shall be carried out by a private veterinarian or a university carrying out an accredited master's programme of veterinary and hygiene studies. ';
21. in Article 5, paragraph 2 is deleted;
Paragraphs 3 to 7 shall be renumbered paragraphs 2 to 6.
22. in Article 5 (3), point (a) is deleted;
Points (b) to (d) shall be renumbered as points (a) to (c).
23. Footnote 11 reads:
"11) Act No. 258 / 2000 Coll. Government Decree No. 27 / 2002 Coll., laying down the method of organisation of work and working procedures which the employer is obliged to ensure in the course of work related to animal husbandry. § 12, 12d and 12f of Act No. 246 / 1992 Coll. '
24. in Article 5 (3) (b), "(b)" is replaced by "(a)";
25. in Article 5 (3) (c), the words "control programme" are replaced by the words "eradication programme" and the words "Ministry of Agriculture Bulletin" are replaced by the words "Ministry website."
26. in Article 5 (5), the words "and paragraph 4 (a)" shall be deleted;
27. in Article 5, the following paragraph 6 is inserted after paragraph 5:
"(6) Breeders operating a bumble bee plant which is separated from the environment shall be subject to the obligations of the livestock breeders referred to in points (a) to (c) of paragraph 1. ';
Paragraph 6 shall become paragraph 7.
28. in Article 5 (7), the comma shall be replaced by a dot at the end of point (e) and point (f) shall be deleted;
29.
(1) An operator of an establishment or carrier subject to registration or approval under Regulation (EU) 2016 / 429 of the European Parliament and of the Council or under Commission Delegated Regulation (EU) 2019 / 2035, in particular Commission Delegated Regulation (EU) 2019 / 2035 and Commission Delegated Regulation (EU) 2020 / 686, is required to apply to the Regional Veterinary Administration for approval or registration under Regulation (EU) 2016 / 429 of the European Parliament and of the Council.
(2) The obligation referred to in paragraph 1 shall not apply to:
(a) breeders of registered animals under the Breeding Act (8) who are required to register their holdings under the Breeding Act (8);
(b) persons under Article 13a (1) of the Animal Protection Act (6) who have a notification obligation under the Animal Protection Act (6).
The persons referred to in points (a) and (b) shall be deemed to be registered under Article 84 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council.
(3) The Regional Veterinary Administration shall register, with the exception referred to in paragraph 2, in accordance with Article 93 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council,
(a) operators' establishments as referred to in Article 84 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council;
(b) the carrier referred to in Article 87 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council and Article 3 of Commission Delegated Regulation (EU) 2019 / 2035; and
(c) the animal segregation operator referred to in Article 90 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council.
(4) The Regional Veterinary Administration, in accordance with Articles 97, 99 and 100 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council, shall approve the establishments referred to in Article 94 (1) or Article 95 (a) of Regulation (EU) 2016 / 429 of the European Parliament and of the Council and suspend or withdraw approval under the conditions laid down in the Regulation.
(5) The obligation to keep records pursuant to Article 102 to 105 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council and Commission Delegated Regulation (EU) 2019 / 2035 shall not apply to operators referred to in Article 102 (4) of Regulation (EU) 2016 / 429 of the European Parliament and of the Council.
(6) Operators of establishments, carriers or dispatch of animals registered by the Regional Veterinary Administration in accordance with paragraph 3, or operators of establishments approved by the Regional Veterinary Administration in accordance with paragraph 4, unless they are subject to an obligation to keep data in the Stážových zárodních zárodních nákladně (8), shall be required to keep records kept pursuant to Article 102 to 105 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council and Commission Delegated Regulation (EU) 2019 / 2035 for a period of 3 years.
(7) Operators of establishments, carriers or animal segregation operators registered by the Regional Veterinary Administration in accordance with paragraph 3, or operators of establishments approved by the Regional Veterinary Administration in accordance with paragraph 4, shall notify the Regional Veterinary Administration within 7 days of the date on which these events occurred,
(a) the amendments provided for in Regulation (EU) 2016 / 429 of the European Parliament and of the Council or by European Union provisions adopted on the basis thereof;
(b) the cessation of its activities.
(8) Registration under Article 84 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council is not subject to registration and alerts under Article 102 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council are not required to maintain:
(a) breeders of registered animals under the Breeding Act (8) who are not required to register their holdings under the Breeding Act (8);
(b) breeders operating a bumble bee plant which is not separated from the surrounding environment. "
30. The following Sections 5b to 5d are inserted after Section 5a:
(1) An operator of aquaculture establishments or groups of aquaculture establishments subject to registration or approval under Regulation (EU) 2016 / 429 of the European Parliament and of the Council or under Commission Delegated Regulation (EU) 2016 / 429 of the European Parliament and of the Council, in particular Commission Delegated Regulation (EU) 2020 / 691, is required to apply to the Regional Veterinary Administration for approval or registration under Regulation (EU) 2016 / 429 of the European Parliament and of the Council. The registration referred to in Article 172 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council shall not apply to aquaculture establishments referred to in Article 3 of Commission Implementing Regulation (EU) 2021 / 2037.
(2) The obligation to apply for approval under paragraph 1 shall not apply to aquaculture establishments referred to in Article 176 (2) of Regulation (EU) 2016 / 429 of the European Parliament and of the Council; such establishments shall be subject to registration only.
(3) The Regional Veterinary Administration shall register aquaculture establishments or groups of aquaculture establishments in accordance with Article 173 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council.
(4) The Regional Veterinary Administration shall, in accordance with Article 181, 183 and 184 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council, approve aquaculture establishments or groups of aquaculture establishments referred to in Article 176 (1), Article 177, Article 178 (a) or Article 179 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council and suspend or withdraw approval under the conditions laid down in the Regulation.
(5) Operators referred to in paragraph 1 and operators of aquatic animals intended for aquaculture establishments or for release into the wild pursuant to Article 188 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council shall be required to keep records kept pursuant to Article 186 to 188 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council and Commission Delegated Regulation (EU) 2020 / 691 for 3 years.
(6) The records referred to in Article 186 (1) (c), (d) and (e) of Regulation (EU) 2016 / 429 of the European Parliament and of the Council are not required to be kept by aquaculture operators referred to in Article 4 (1) of Commission Implementing Regulation (EU) 2021 / 2037. The records referred to in Article 188 (1) of Regulation (EU) 2016 / 429 of the European Parliament and of the Council shall not be required to keep the carriers referred to in Article 4 (2) of Commission Implementing Regulation (EU) 2021 / 2037.
(7) Operators of aquaculture establishments or groups of aquaculture establishments registered by the Regional Veterinary Administration in accordance with paragraph 3 or approved by the Regional Veterinary Administration in accordance with paragraph 4 shall notify the Regional Veterinary Administration within 7 days of the date on which these events occurred,
(a) the amendments provided for in Regulation (EU) 2016 / 429 of the European Parliament and of the Council or by European Union provisions adopted on the basis thereof;
(b) the cessation of its activities.
The Regional Veterinary Administration shall approve a private veterinarian for establishments referred to in Article 5a or 5b where such approval is required by Regulation (EU) 2016 / 429 of the European Parliament and of the Council or by Commission Delegated Regulation (EU) 2019 / 2035, Commission Delegated Regulation (EU) 2020 / 686 and Commission Delegated Regulation (EU) 2020 / 691. The approval of a private veterinarian for this activity may be suspended or withdrawn by the Regional Veterinary Administration if it has been implemented in breach of the requirements laid down in this Law, Regulation (EU) 2016 / 429 of the European Parliament and of the Council or Commission Delegated Regulations adopted on the basis thereof, in particular Commission Delegated Regulation (EU) 2019 / 2035, Commission Delegated Regulation (EU) 2020 / 686 and Commission Delegated Regulation (EU) 2020 / 691.
(1) An operator keeping insects intended for human consumption or for the production of processed animal protein is required to apply to the Regional Veterinary Administration for registration of its establishment and to fulfil the obligations under Articles 84 and 102 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council. The Regional Veterinary Administration shall register those establishments in accordance with Article 93 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council.
(2) The operator of an establishment registered by the Regional Veterinary Administration in accordance with paragraph 1 shall keep records maintained in accordance with Article 102 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council for 3 years.
(3) The operator of an establishment registered by the Regional Veterinary Administration in accordance with paragraph 1 shall notify the Regional Veterinary Administration within 7 days of the date on which such events occurred,
(a) the amendments provided for in Regulation (EU) 2016 / 429 of the European Parliament and of the Council;
(b) the cessation of its activities. ";
31. In Part One, Title II, the following Section 2 is inserted after Section 1, including the title and footnote 39:
Central dog registration
(1) The Chamber is the administrator and operator of the information system for the central registration of dogs (hereinafter referred to as the "central registration information system").
(2) The central registration information system is not publicly available and has access to it
(a) a private veterinarian for the purpose of recording or consulting data for the purpose of fulfilling the obligations laid down by this law;
(b) a public authority for the purpose of consultation in connection with the exercise of its powers to the extent provided for in the procedure laid down in the Law on Basic Registers (39); and
(c) the breeder of the dog for the purpose of entering or viewing the number of his phone within the scope of the information provided on that breeder and his bred dog.
(3) The following data shall be kept in the central repository information system:
(a) dog identification number or dog tattoo number,
(b) the sex of the dog;
(c) the passport number of the dog from the passport records kept by the Chamber in accordance with § 4a, if the passport has been issued;
(d) the name and, where applicable, the name and address of the place of permanent residence, the residence or residence of the breeder of the dog, or his legal representative, or the business or name of the breeder of the dog, and the number of the telephone number of the breeder of the dog and, where applicable, his legal representative;
(e) the address of the place where the dog is kept;
(f) an indication of the vaccination or re-vaccination of the dog against rabies and the date of such vaccination or re-vaccination.
(4) The Ministry shall reimburse the Chamber for the final costs associated with the acquisition, management, operation and administration of the central registration information system, the one-off reimbursement of the final expenses for the establishment of remote and continuous access to data from the central registration information system and the flat-rate annual reimbursement of the final expenses for the provision of data from the central registration information system.
(5) The implementing act shall set the amount of compensation for the final expenditure relating to the acquisition, management, operation and administration of the central registration information system, the one-off reimbursement of the final expenditure for establishing remote and continuous access to data from the central registration information system and the flat-rate annual reimbursement of the final expenditure for the provision of data from the central registration information system belonging to the Chamber.
Dog breeders
(1) The keeper of the dog is obliged to ensure registration
(a) the dog shall enter the central registration information system at the same time as the identification of the newly born dog by an electronic chip in accordance with § 4 (3); the entry of the dog in the central registration information system shall be carried out by a private veterinarian in accordance with § 5g (a);
(b) data on vaccination or re-vaccination of the dog against rabies in the central register information system; the entry of this data into the central registration information system shall be carried out by a private veterinarian in accordance with § 5g (b);
(c) changes of the breeder or permanent changes of the address of the dog's breeding site to the central register information system at the latest when the dog is vaccinated or re-vaccinated against rabies; the entry of this data in the central registration information system shall be carried out by a private veterinarian in accordance with § 5g (c).
(2) The obligations of the keeper of the dog referred to in paragraph 1 shall not apply to breeders of experimental animals, suppliers of experimental animals or users of experimental animals under the Animal Protection Act 6), armed forces, security corps, military police or municipal police68) as regards dogs used to perform the tasks of municipal police.
Private veterinarian
A private veterinarian shall:
(a) enter the dog in the central register information system within 7 working days of the date on which the dog was marked with an electronic chip in accordance with Article 4 (3); this entry shall include the information referred to in Article 5e (3) (a), (b), (d) to (f) and, if the dog has a passport, the information referred to in Article 5e (3) (c);
(b) enter in the central register information system an indication of the vaccination or re-vaccination of the dog against rabies and the date of such vaccination or re-vaccination within 7 working days of the date on which the dog was vaccinated or re-vaccinated;
(c) enter in the central register information system a change in the breeder or a permanent change in the address of the dog's breeding site within 7 working days of the date of notification of this information to the veterinarian.
College implementing an accredited master's study programme in the field of veterinary medicine and hygiene
For the purposes of this Section, a university carrying out an accredited master's programme in the field of veterinary medicine and hygiene shall also be considered as a private veterinarian. The rights and obligations of a private veterinarian under § 5e to 5g apply mutatis mutandis to this university.

"(2) Animals may only be transported under the conditions laid down in this Act, the Animal Protection Act against Torture (6), the European Union provisions governing animal protection during transport (14) and Regulation (EU) 2016 / 429 of the European Parliament and of the Council or Commission Delegated Regulations adopted on the basis thereof, in particular Commission Delegated Regulation (EU) 2020 / 688 and Commission Delegated Regulation (EU) 2020 / 990; the official veterinarian shall supervise compliance with these conditions. ';
40. Paragraph 7 (3) is deleted.
41. Paragraph 8, including the title and footnotes No 80 to 82, reads:
Movement of animals between Member States
(1) The Regional Veterinary Administration may, in the cases provided for in the Regulation, authorise an exemption from the animal health requirements for movements:
(a) animals which are laid down in Part IV, Title I, Chapters 3, 4 and 5 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council and in Commission Delegated Regulations adopted on the basis of that Regulation, governing animal movement requirements (80);
(b) aquatic animals or animal products derived from aquatic animals other than live aquatic animals, as provided for in Chapters 2 and 3 of Title II of Part IV of Regulation (EU) 2016 / 429 of the European Parliament and of the Council and in Commission Delegated Regulations adopted on the basis of it governing the movement requirements of animals (81).
(2) The central veterinary administration may authorise an exemption from the animal health requirements laid down in Regulation (EU) 2016 / 429 of the European Parliament and of the Council as regards movements
(a) animals between Member States for scientific purposes6), or near borders for recreational purposes, sports and cultural events, or for grazing or work, or the movement of germ products to gene banks in another Member State, under the conditions laid down in Article 138, 139 and 165 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council and in Commission Delegated Regulations adopted on its basis 82);
(b) aquatic animals in the territory of the Czech Republic from another Member State for scientific purposes (6) under the conditions laid down in Article 204 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council.
(3) Aquaculture movements from another Member State may be released into the wild in the Czech Republic only if they fulfil the conditions laid down in Article 199 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council.

Movement of circus animals
(1) The Regional Veterinary Administration registers circuses, issues registers of circus animals (hereinafter referred to as "circus animals") and registers of circus shows and carries out other tasks for official veterinary practitioners under European Union rules on animal health requirements for movements of circus animals between Member States 14a). The animal health conditions laid down in European Union provisions governing animal health requirements for movements of circus animals between Member States 14a) for movements of circus animals between Member States shall also apply to the national movements of such animals.
(2) Passports for circus animals are issued by an approved veterinarian for this activity (§ 3 (1) (hh)) and confirmed by the official veterinarian of the competent regional veterinary administrations; the records of these passports are kept by the Chamber. The approval of a veterinarian for this activity may be suspended or withdrawn from the veterinarian who has issued a passport with demonstrably false data, filled in incompletely or incorrectly, or in contravention of the conditions laid down in European Union rules governing the animal health requirements for the movement of circus animals between Member States 14a). '
Article 45 (9b) is deleted;
46. In Part One, Title II of Section 4 and Section 17b of Section 17b, the word "fighting 'is replaced by" control'.
47. In Article 10 (1), the words "in accordance with Article 26 to 28 of Regulation (EU) 2016 / 429 of the European Parliament and of the Council and Commission Delegated Regulation (EU) 2020 / 689, national veterinary surveillance with a view to the early detection of the diseases listed in Annex 2 thereto," shall be inserted at the beginning of point (a).
