Government Regulation No. 361 / 2007 Coll., laying down conditions for the protection of health at work, as amended by Government Regulation No. 68 / 2010 Coll., Government Regulation No. 93 / 2012 Coll., Government Regulation No. 9 / 2013 Coll. and Government Regulation No. 32 / 2016 Coll., are amended as follows:
1. At the end of footnote 1, the sentence "Commission Directive (EU) 2017 / 164 of 31 January 2017 establishing the fourth list of indicative occupational exposure limit values in accordance with Council Directive 98 / 24 / EC and amending Commission Directives 91 / 322 / EEC, 2000 / 39 / EC and 2009 / 161 / EU is added to the separate line. '.
2. Paragraph 9 (1) reads as follows:
"(1) The hygiene limit of the chemical in the working air is the permissible exposure limit and the maximum permissible concentration. The exposure limit is permitted by the hygiene limit of dust in the working air. '
3. In Article 9 (4), at the end of the second sentence, the words "unless otherwise specified in Annex 2 to this Regulation 'shall be added.
4. In Article 9, the following paragraph 9 is added:
"(9) The limit values for gases and vapours shall be given either as a volumetric concentration in ppm independent of the instantaneous temperature and pressure, or as a mass concentration in mg.m-3 at 20 ° C and a pressure of 101,3 kPa dependent on these quantities. The limit values for aerosols are given in mg.m-3 for actual environmental conditions in terms of temperature and pressure. The limit values for fibres shall be given in the number of fibres / cm3 or in the number of fibres / cm3 for actual environmental conditions in terms of temperature and pressure at the workplace. ';
5. In Paragraph 25, the following sentence is added at the end of paragraph 9: "For the purposes of classifying work into the second category, the procedure set out in Annex 5 to this Regulation shall not apply if, according to an expert assessment carried out under the Public Health Protection Act by the holder of an accreditation certificate or authorization26) the rate of occurrence of the local muscle load factor and its risk to health does not meet the criteria for classification of work as risk27) and the employer has not detected occupational diseases or occupational diseases in the performance of the assigned work. The professional evaluation shall include data on the nature of the work, place of work, time of work, exchange rate, information on the handled material, the mode of work and rest during the work, the tools used, the sex of the employees and their rotation at individual posts and photo-documentation relating to the work environment, if any. ';

Explanatory notes to the table:
PEL - permissible exposure limit.
NPK-P - maximum permissible concentration.
CAS No - Registration number of the substance used in Chemical Abstracts Service.
(1) When selecting an appropriate exposure control method, account should be taken of possible restrictions and interferences that may occur in the presence of other sulphur compounds.
(2) Fog is defined as a thoracal fraction.
(3) Consideration is given to physicochemical properties (e.g. explosive).
(4) For the evaluation of exposure to lead, the result of the examination of plumbemia is decisive.
(5) The control of mercury exposure and inorganic compounds of bivalent mercury shall take into account relevant biological exposure tests which complement the indicative occupational exposure limit values.
(6) Short-term exposure limit in relation to the reference period.
Explanatory notes to the column of the table "Notes':
B - for a substance, a biological exposure limit (BET urine + blood) is established.
D - The skin penetration is significantly applied to exposure.
I - irritates mucous membranes (eyes, airways) or skin.
P - serious late effects cannot be excluded for a substance.
S - the substance has a sensitising effect.
V - inhalable fraction of aerosol.
R - respiratory fraction of aerosol.
For aerosols of substances with significant respiratory and eye irritation, generally, the health limits set for couples cannot be used; the protection of workers needs to be addressed taking into account specific conditions.
Explanatory notes to table column "conversion factor to ppm ':
The conversion factor from the mass concentration data in mg.m-3 to the volume concentration figure in ppm shall be subject to a temperature of 25 ° C and a pressure of 100 kPa. ';
Transitional provision
For deep-sea mining and tunnelling, the limit values for nitric oxide, nitrogen dioxide and carbon monoxide laid down in Government Regulation No 361 / 2007 Coll., as effective before the date of entry into force of this Regulation, may be used until 21 August 2023.
Efficacy
This Regulation shall enter into force on the day of its publication.
