on how to conduct a personal search by customs
The Ministry of Finance provides pursuant to § 35a paragraph 6 of Act No. 17 / 2012 Coll., on the Customs Administration of the Czech Republic, as amended by Act No. 243 / 2016 Coll.:
How to conduct a personal search by customs
(1) A personal inspection shall be carried out in rooms or reserved spaces which are lit at sufficient temperature, provided that the necessary privacy is provided for the safe disposal of clothes and items of the person checked and accessible accessories enabling washing and drying after the personal inspection carried out and which are secured against the entry of unauthorised persons.
(2) Where a personal inspection is to be carried out at the request of the person checked in the presence of another person, the customs officer shall designate that person; that person must be of the same sex as the person checked and the customs officer.
(3) The personal examination shall be carried out first by examining the headgear, footwear, parts of the upper clothing and the oral cavity. The customs officer then continues to examine other parts of the clothing including laundry and other parts of the body.
(4) If the customs officer has reason to suspect that the hidden goods are in a particular part of the clothing, footwear or body, he shall first examine that part of the clothing, footwear or body.
Efficacy
This decree shall take effect on the day of its publication.
