GOVERNMENT REGULATION
of 21 April 2004
on the implementation of certain measures of the common organisation of the market in seeds
The Government orders pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll.:
Subject matter
This Regulation provides for the implementation of certain measures of the common organisation of the market in seeds, the adaptation of which by the provisions of the European Community1) (hereinafter referred to as "the rules of the European Communities') orders or allows Member States of the European Union to implement them.
Approval of breeders and suppliers
(1) Breeders, (2) Breeders, (3) Breeding establishments, (3) Suppliers (4), shall be subject to approval or registration (5) under the rules of the European Communities (6) (hereinafter referred to as "Breeders and Suppliers") implemented by the State Agricultural Intervention Fund (hereinafter referred to as "the Fund").
(2) Breeders and suppliers approved may:
(a) produce seed,
(b) have complied with the registration or notification requirement laid down in the specific legislation, 7)
(c) submit an application to the Fund using a form issued by the Fund.
(3) The application referred to in paragraph 2 shall include proof that the applicant is an entrepreneur under specific legislation. 8)
Registration of seed multiplication contracts in third countries
(1) Registration of seed multiplication contracts in third countries9) is carried out in accordance with the provisions of the European Communities 10) Fund.
(2) The notification of the conclusion of a contract containing the information provided for in the Regulation of the European Communities (11) shall be submitted by the breeder or supplier of the Fund using a form issued by the Fund.
(3) The notification referred to in paragraph 2 shall include an officially certified copy of the contract.
Method of proving the estimated quantity of seed
The proof showing the estimated quantity of seed to be imported shall be the certificate of the contracting party established in a third country of the quantity of seed produced under a contract registered under Section 3.
Efficacy
This Regulation shall enter into force on the date of the entry into force of the Treaty of Accession of the Czech Republic to the European Union.
