GOVERNMENT REGULATION
of 12 July 2023
amending Government Regulation No 426 / 2016 Coll., on conformity assessment of radio equipment when making them available on the market, as amended by Government Regulation No 499 / 2021 Coll.
The Government hereby orders, pursuant to Articles 4, 6 (3) and 50 (5) of Act No. 90 / 2016 Coll., to assess the conformity of specified products when making them available on the market:
Čl. I
Government Regulation No 426 / 2016 Coll., on conformity assessment of radio equipment when making them available on the market, as amended by Government Regulation No 499 / 2021 Coll., is amended as follows:
1. At the end of footnote 1, the sentence is added to the separate line:
"Directive (EU) 2022 / 2380 of the European Parliament and of the Council of 23 November 2022 amending Directive 2014 / 53 / EU on the harmonisation of the laws of the Member States relating to the making available on the market of radio equipment. ';
2. in Article 3 (3) (a), the words "in particular single chargers" shall be replaced by the words "other than charging devices of category and class of radio equipment listed in Part I of Annex 8 to this Regulation."
3. In Article 3, the following paragraph 4 is added:
"(4) Radio equipment falling within the category or classes listed in Part I of Annex 8 to this Regulation shall be so designed as to meet the technical requirements concerning charging capacities set out in Part II of Annex 8 to this Regulation. ';
4. In Article 6, the following paragraph 3 is inserted after paragraph 2:
"(3) In the case of radio equipment falling within the category and class listed in Part I of Annex 8 to this Regulation, the instructions shall include information on the technical requirements concerning the charging capacities and compatible charging devices of those radio equipment in accordance with Part II of Annex 8 to this Regulation. Information on technical requirements relating to charging capacity and compatible charging devices shall also be displayed by the manufacturer on the label, the model of which is set out in Part IV of Annex 8 to this Regulation. The label shall be placed in the instructions and on the packaging or glued to the packaging in the form of a sticker. If the radio equipment does not have a packaging, the label shall be affixed to the radio equipment in the form of a sticker. When supplying radio equipment to consumers and other end-users, the label shall be displayed visibly and legibly and, in the case of distance sales, close to the price information. If the size or nature of the radio equipment does not allow this, the label may be printed as a separate document accompanying the radio equipment. ';
Paragraphs 3 to 6 shall be renumbered paragraphs 4 to 7.
5. in Article 8 (1) and 9 (c), the words "to 4" shall be replaced by the words "2, 4 and 5."
6. In Article 8, the following paragraph 7 is added:
"(7) The importer shall, when placing the radio equipment listed in Part I of Annex 8 to this Regulation on the market, ensure that the requirements laid down in Article 6 (3) are met."
7. In Article 9, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) When making available the radio equipment listed in Part I of Annex 8 to this Regulation on the market, the distributor shall ensure that the requirements laid down in Article 6 (3) are met."
8. The following Section 10a is inserted after Section 10:
„§ 10a
(1) Where an economic operator offers consumers and other end-users the opportunity to acquire radio equipment together with charging equipment, it shall also offer consumers and other end-users the opportunity to acquire such radio equipment without charging equipment.
(2) The operator shall ensure that, when radio equipment is supplied to consumers and other end-users, it is displayed on the packaging or affixed to the packaging in the form of a pictogram sticker showing that the radio equipment contains or does not contain charging devices. The pictogram shall be visible and legible and, in the case of distance sales, shall be placed close to the price indication. The model of the pictogram is set out in Part III of Annex 8 to this Regulation. ';
9. In the second sentence of Article 11 (1), the words "and Article 3 (4) 'are inserted after the words" Article 3 (1) (a)'.
10. in Article 16 (g), the words "of its intended purpose of use" shall be replaced by the words "referred to in Article 6 (1) to (4)."
11. in Article 16 (i), the words "incomplete or" are replaced by the words "incomplete,"
12. In Article 16, at the end of point (j), the dot is replaced by a comma and the following points (k) to (m) are added:
"(k) the label does not meet the requirements of Article 6 (3) or is not placed, glued, displayed or printed in accordance with Article 6 (3);
(l) the operator does not offer consumers and other end-users, in accordance with Paragraph 10a (1), the possibility of acquiring radio equipment with or without charging equipment; or
(m) the pictogram does not meet the requirements of Section 10a (2) or is not placed, glued or displayed in accordance with Section 10a (2). ';
13. In Annex 7, "§ 6 (3) 'is replaced by" § 6 (4)'.
14. the following Annex 8 is inserted after Annex 7:

"Annex No 8 to Government Regulation No 426 / 2016 Coll.
TECHNICAL REQUIREMENTS AND INFORMATION RELATING TO THE RENCE OF CERTAIN RADIO DEVICES

Část I

Technical requirements concerning charging capacities
1. The technical requirements set out in points 2 and 3 of this Part shall apply to the following categories or classes of radio equipment:
1.1 mobile phones,
1.2 tablets,
1.3 digital cameras,
1.4 headphones,
1.5 headsets,
1.6 hand video game consoles,
1.7 portable speakers,
1.8 electronic readers,
1.9 keyboard,
1.10 mice,
1.11 portable navigation equipment,
1.12 wireless earphones.
2. If the radio equipment referred to in point 1 of this Part is found to be charging by cable charging, it shall meet the following requirements:
(a) it shall be equipped with a USB type C socket according to EN IEC 62680-1-3: 2021 "Universal serial bus interface for data and performance - Part 1-3: Common parts - Cable specification and USB type C ® connector" which must always be accessible and functional,
(b) it shall be possible to charge them by means of cables meeting the requirements of EN IEC 62680-1-3: 2021 "Universal serial bus interface for data and performance - Part 1-3: Common parts - Specifications of the C ® cable and USB connector.
3. If the radio equipment referred to in paragraph 1 of this Part is capable of being charged by cable charging at a voltage greater than 5 volts or a current greater than 3 amps or power consumption greater than 15 watts, it shall:
a) integrate the USB Power Delivery protocol according to EN IEC 62680-1-2: 2021 "Universal serial bus interface for data and performance - Part 1-2: Common parts - Performance USB specifications";
(b) ensure that any additional charging protocol enables the full functionality of the USB Power Delivery technology referred to in (a) regardless of the charging device used.

Information on technical requirements concerning charging capacities and compatible charging devices
In the case of radio equipment referred to in part The following information shall also be provided in this Annex which may also be made available via QR codes or similar electronic solutions:
(a) in the case of all categories or classes of radio equipment subject to the requirements set out in Part I of this Annex, a description of the performance requirements for cable charging devices that can be used with such radio equipment, including the minimum power input needed to charge the radio equipment and the maximum power input needed to charge the radio equipment at the maximum charging speed expressed in watts, by indicating: "the power input supplied by the charging device shall be between the minimum [xx] watts required by the radio equipment and the maximum [y] watts necessary to achieve the maximum charging speed." The number of watts shall express the minimum power required by the radio equipment and the maximum power required by the radio equipment to achieve the maximum charging speed;
(b) in the case of radio equipment covered by the technical requirements referred to in point 3 of Part I of this Annex, a description of the technical requirements relating to the charging capacity of the radio equipment which can be charged by cable charging at a voltage of more than 5 volts or a current greater than 3 amperes or a power of more than 15 watts, including an indication that the radio equipment supports the charging protocol of the USB Power Delivery, by indicating the text "fast charging of USB PD" and an indication of any other supported charging protocol by its name in a text format.

Pictogram showing whether the charging device is attached to the radio device
1. the pictogram must have the following formats:
1.1. In the case of a charging device attached to a radio device

1.2. If no charging device is attached to the radio equipment

2. In pictogram format, different visual variations (e.g. colour, filler version or outline only, line thickness) may be provided that the pictogram remains visible and legible. If the pictogram is reduced or enlarged, the proportions shown in the figures in paragraph 1 of this Part shall be maintained. The dimension "a 'referred to in paragraph 1 of this Part shall be equal to or greater than 7 mm, irrespective of the deviation.

Label content and form
1. The label shall be in the following format:

2. the letters "XX" shall be replaced by a figure corresponding to the minimum power required to charge the radio equipment which determines the minimum power to be supplied by the charging device for charging the radio equipment. The letters "Y 'shall be replaced by a figure corresponding to the maximum power input required to achieve the maximum charging speed of the radio equipment which determines the power to at least supply the charging device to achieve that maximum charging speed. If the radio device supports this communication protocol for charging, the abbreviation" USB PD "(USB Power Delivery) will be displayed." USB PD' is the protocol that ensures the fastest supply of power from the charging device to the radio equipment without shortening the battery life.
3. In the label format, different visual variations (e.g. colour, filler version or outline only, line thickness) may be provided that the label remains visible and legible. If the label is reduced or enlarged, the proportions given in the figure in paragraph 1 of this Part shall be maintained. The dimension "a 'referred to in paragraph 1 of this Part shall be equal to or greater than 7 mm, regardless of the deviation.'
Čl. II
Efficacy
This Regulation shall enter into force on 28 December 2024, with the exception of Article I (15), which shall take effect on 28 April 2026.
