GOVERNMENT REGULATION
of 24 October 2018
amending Government Regulation No. 30 / 2014 Coll., laying down binding rules on the provision of financial contributions to forest management and selected hunting activities, as amended
The Government mandates pursuant to § 46 (9) of Act No. 289 / 1995 Coll., on Forests and on the amendment and amendment of certain laws (Forest Act), as amended by Act No. 501 / 2012 Coll., and pursuant to § 62 (2) of Act No. 449 / 2001 Coll., on hunting, as amended by Act No. 501 / 2012 Coll. and Act No. 357 / 2014 Coll.:
Government Regulation No. 30 / 2014 Coll., on the establishment of binding rules on the provision of financial contributions to forest management and selected hunting activities, as amended by Government Regulation No. 308 / 2014 Coll., Government Regulation No. 51 / 2015 Coll. and Government Regulation No. 209 / 2016 Coll., is amended as follows:
1. In Article 2 (7), the first sentence is replaced by the following: "The applicant for the financial contribution to forest management referred to in Part Two, Titles I, II, III, IV, VII or IX, before the start of work on the subject of the financial contribution, shall deliver to the Ministry of Defence, the Ministry of the Environment or the competent regional authority a declaration of the financial contribution to forest management (hereinafter referred to as the" declaration ').'.
2. in § 2 (7), § 3 (4), § 4 (3), § 12 (3), § 22 (4) and § 35 (4), "31 August" is replaced by "30 June."
3. in Article 2 (8), "IV and VII 'is replaced by" IV, VII or IX' and "Annexes 11 and 12 'is replaced by" Annex 11';
4. in Article 3 (3) (c):
"(c) the concentration of wood in the forest by balancing it, provided that the maximum technically permissible weight per axle of the exporting machine is not more than 6 000 kg, ';
5. In Article 3 (5), the sentences second to last are replaced by the sentences "The information contained in the application form shall also be provided by the applicant to the competent regional authority electronically published by the Ministry of Agriculture on its website. At the request of the provider or the competent regional authority, copies of the invoices, forest economic records or other production technical documents containing the type of technology used, the number of technical units used and the identification of the crop groups in which the technology was used shall be submitted as proof of compliance with the subject of the financial contribution. In the case of a financial contribution referred to in paragraph 3 (c), copies of the technical document, technical certificate, certificate of conformity or other authentic instrument or technical documentation showing the value of the maximum technically permissible mass fixed on each of the axles of the vehicles used to balance timber shall also be submitted at the request of the provider or the competent regional authority. ';
6. in Article 3 (9), "EUR 300 / ha7 'is replaced by" EUR 300 / ha per year or EUR 1 500 / ha in total for 5 years';
7. In Articles 4 (4) and 22 (5), the last sentence is replaced by the following: "The information contained in the application form shall also be provided by the applicant to the competent regional authority electronically published by the Ministry of Agriculture on its website. '.
8. In Article 5 (1) and in Article 23 (1), the words "on request of the provider or the competent regional authority 'shall be inserted after the words" on request of the provider or the competent regional authority' and the words "outline 'shall be replaced by the words" forestry'.
9. In § 6 (1), § 7 (1), § 8 (1), § 14 (1), § 15 (1), § 24 (1), § 25 (1) and § 26 (1), the words "sheet of origin of reproductive material12) and the contour" are replaced by the words "affidavit of forest owner on origin of reproductive material12) in the case of the use of reproductive material from its own forest crops and, at the request of the provider or the competent regional authority, also forestry."
10. Footnote 12 reads:
"12) § 29 (5) of Act No. 289 / 1995 Coll., as amended."
11. in Article 7, paragraph 3 is deleted;
Paragraphs 4 and 5 shall be renumbered paragraphs 3 and 4.
12. in Paragraph 8 (4):
"(4) The financial contribution for repeated artificial planting shall be granted at a maximum of 30% of the area of artificial restocking by planting the first and actual number of individuals, but not more than 1,3 times the minimum number of individuals per hectare laid down for basic timber by other legislation10. ';
13. in Paragraph 8, paragraph 6 is deleted;
14. In Section 9, the following paragraph 1 is added:
"(1) The application for a financial contribution for the provision of forest areas within the legal period shall be accompanied by a forest map with a graphic drawing of the forest areas secured at the request of the provider or the competent regional authority. ';
Paragraphs 1 and 2 shall become paragraphs 2 and 3.
15. Paragraph 10, including the title, reads:
Transformation of crops with unsuitable or replacement woody composition or reconstruction of crops after damage
(1) A financial contribution for the conversion of crops with an inappropriate or replacement woody composition or the reconstruction of crops after damage may be granted if:
(a) the quality of the work carried out and its compliance with forest management legislation is confirmed by the forest farm;
(b) the State Administration of Crop Forests has authorised an exemption from the prohibition on the implementation of tolling intentional logging in forest areas under 80 years of age; and
(c) the age of the crop, plus the number of years from the beginning of the validity of the forestry or forestry economic curriculum, until the work for which the financial contribution is requested has been carried out, shall not exceed 40 years of age as indicated in the forestry or forestry economic curriculum.
(2) The financial contribution for the conversion of crops with an unsuitable or replacement woody composition or the reconstruction of the crops after damage shall be granted to the area of forest area removed as part of its conversion or reconstruction.
(3) A financial contribution for the conversion of crops with an inappropriate or replacement woody composition or the reconstruction of crops after damage shall not be granted for the work carried out in the framework of forest protection under Section 35b. '
16. In Paragraph 13 (1), the words "on request of the provider 'shall be inserted after the words" forestry' and the words "outline 'shall be replaced by the words" forestry'.
17. in Article 15, paragraph 4 is deleted;
Paragraphs 5 and 6 shall be renumbered paragraphs 4 and 5.
18. in Article 16 (1), the words "sheet of origin of reproductive material12), contour" shall be replaced by the words "affidavit of the forest owner on origin of reproductive material12) in the case of the use of reproductive material from its own forest areas and, at the request of the provider or the competent regional authority, also forestry."
19. Paragraph 16 (5) is deleted.
Paragraphs 6 to 8 shall become paragraphs 5 to 7.
20. In Article 16 (7), the words "referred to in Article 8 (7) 'shall be deleted and at the end of the paragraph the words" Semi-grazed plant' shall be added to a plant produced by at least double education, or a combination of curing and undercutting or incorporation into packaging, with an above-ground part of a height of 51 to 120 cm and a root neck of a thickness specified by another legislation30). The seed shall mean a plant grown at least twice by education, or a combination of curing and undercutting roots or incorporation into packaging, with an above ground part of a height of 121 to 250 cm and a root neck of a thickness determined by other legislation30). ';
21. in Article 17, the following paragraph 1 is inserted:
"(1) A forest map shall be attached to the application for a financial contribution to ensure forest areas of the meliorative and strengthening trees within the legal period, upon request of the provider, with a graphical outline of the forest areas secured. ';
Paragraphs 1 and 2 shall become paragraphs 2 and 3.
22. Paragraph 18, including the title, reads:
Transformation of crops with unsuitable or replacement woody composition or reconstruction of crops after damage
(1) A financial contribution for the conversion of crops with an inappropriate or replacement woody composition or the reconstruction of crops after damage may be granted if:
(a) the quality of the work carried out and its compliance with forest management legislation is confirmed by the forest farm;
(b) the State Administration of Crop Forests has authorised an exemption from the ban on the implementation of tolling intentional logging in forest areas under 80 years of age;
(c) the age of the crop, plus the number of years following the beginning of the validity of the forestry or forestry economic curriculum, until the work for which the financial contribution is requested has been carried out, shall not exceed 40 years of age referred to in the forestry or forestry economic curriculum; and
(d) there has been a change in the woody composition from the stands of the plant or geographical origin to the crops with at least a minimum representation of the melliorative and strengthening trees provided for by other legislation18).
(2) The financial contribution for the conversion of crops with an inappropriate or replacement woody composition or the reconstruction of the crops after damage shall be granted to the area of forest area removed as part of its conversion or reconstruction. "
23. In Paragraph 21, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The financial contribution for the individual protection of seedlings of meliorative and strengthening timber against game shall be granted for a maximum of 100 pieces of individual protection per hectare of the area of planting of seedlings of meliorative and strengthening trees. ';
24th Paragraph 22 (9) reads:
"(9) The financial contributions provided for in paragraphs 23 to 29 shall be granted in the renewed parts of the crop groups:
(a) with actual total representation not exceeding 40%
1. any species of spruce, except gilled spruce;
2. all kinds of birch or larch, and
3. any species of pine with the exception of forest pine; or
(b) whose age in the year of completion of the financial contribution is more than 55 years. "
25. in Paragraph 25, paragraph 4 is deleted;
Paragraph 5 shall become paragraph 4.
26. Paragraph 26 (4) is deleted.
Paragraphs 5 to 7 shall be renumbered paragraphs 4 to 6.
27. in Article 26 (5), the words "not more than 30% of the area of artificial renewal by seed shall be inserted after the words" providing. "
28. Paragraph 26 (6) is deleted.
29. In Paragraph 35, at the end of paragraph 5, the words "or copies of the accounting documents relating to the direct costs actually incurred for the development of the forest economic plan shall be added."
30. in Part Two, the following Title IX is inserted after Title VIII:
FINANCIAL CONTRIBUTION TO THE PROTECTION OF LESS
(1) A financial contribution for forest protection may be granted to the forest owner or person referred to in Article 2 (5) for the protection of the forest against calamite insect pests pursuant to another legislation (32) and to pine fish.
(2) The financial contribution for forest protection shall be granted if it is for military forests or other non-State-owned forests and not for forests within the national parks and their protection zones.
(3) The financial contribution for forest protection shall be:
(a) the timely and effective rendering of excavated coniferous wood by covering its nets with the product against fibula-eaters;
(b) the timely and effective rendering of extracted coniferous wood by spraying it with a preparation against fibula-eaters with added dye;
(c) the timely and effective rendering of extracted coniferous wood by debarring it; or
(d) removal of coniferous wood from the forest area within 40 years of the age of damaged fibula-eaters or spruce-fish under the conditions of chipping of the harvested wood and leaving part of the grafting area evenly distributed on the area of the removed forest area.
(4) The application for a financial contribution for forest protection shall be submitted by the applicant to the competent regional authority within 3 months of the completion of the subject-matter of the financial contribution but no later than 30 June for the period of validity of the declaration.
(5) The application for a financial contribution for forest protection shall be made on a form, a model of which is set out in Annex 12 to the Regulation. The information contained in the application form shall also be provided by the applicant to the competent regional authority electronically published by the Ministry of Agriculture on its website. If the presence of a calamite insect pest has reached an elevated or a calamic state in the area covered by the application, the application shall be accompanied by a registration of calamite pests (33). At the request of the provider or the competent regional authority, copies of the accounting or production technical documents proving the purchase of the relevant plant protection products and the execution of the work to the extent specified in the application for a financial contribution to forest protection shall also be submitted.
(6) A financial contribution for forest protection may be granted if:
(a) the implementation of timely and effective rendering of excavated coniferous wood or the removal of damaged coniferous wood from the forest, in accordance with forest management legislation, is confirmed by an expert forest economy;
(b) the applicant has notified, within 7 calendar days of completion of the subject of the financial contribution, of the timely and effective rendering of excavated coniferous wood electronically published by the Ministry of Agriculture on its website; and
(c) in the case of the financial contribution referred to in paragraph 3 (d), the forest area of the fibula-eater or of the lark has been damaged to at least 20% of the area of the grassland group.
(7) The financial contribution referred to in paragraph 3 (d) shall be granted for forest crops for which, after the addition of the number of years from the beginning of the validity of the forest plan or forest economic curriculum until the removal of the forest area for which the financial contribution is requested, the age referred to in the forestry plan or in the forest economic curriculum shall not exceed 40 years.
(8) The rates of the financial contribution for forest protection are set out in Part IX of Annex 1 to this Regulation.
(9) The amount of the financial contribution for forest protection shall be determined as the sum of the product of the rate and quantity of technical units actually carried out.
32) Paragraph 3 (1) of Decree No. 101 / 1996 Coll., laying down the details of the forest protection measures and the model of the service badge and the model of the forest guard pass, as amended.

31. in Article 36 (1), "Sections 37 to 39 and 41" shall be replaced by "this Title."
32. in Paragraph 36 (2), the words "Sections 37 to 39 and 41" shall be replaced by the words "This Title, with the exception of the application for a financial contribution referred to in Section 41b," and at the end of the paragraph the sentence "The application for a financial contribution referred to in Section 41b shall be served by the applicant on the subject of the financial contribution by 31 August for the immediately preceding marketing year (34)."
Footnote 34 reads:
"34) Paragraph 1 (1) of Decree No 553 / 2004 Coll., on the conditions, model and closer guidelines for drawing up the hunting plan."
33. in Paragraph 36 (3), the words "paragraphs 37 to 39 and 41" shall be replaced by the words "under this Title" and the words "once per period" shall be added at the end of the text of the paragraph.
34. in Paragraph 36 (4), "paragraphs 37 to 39 and 41" shall be replaced by "this Title."

"(g) the acquisition and installation or the production and installation of new small game feeders; small game feeder means a manger for feeding the hare to the field-surrounding fodder and to the cider feed or powder for feathered game,
(h) the acquisition of acoustically-lit game-breakers to protect them in agricultural activities; or
(i) the provision of suitable feed for European deer, spotted, Japanese sik or muflon (hereinafter "selected species of cloven-hoofed game") in the winter season for a period of 4 months. "
39. in Paragraph 37 (2), the words "in the case of the subject of the contribution referred to in paragraph 1 (a) to (g)" and the text "(f)" shall be replaced by the words "(g)."
40. in Paragraph 37 (2), the word "a" shall be deleted at the end of (c);
41. in Paragraph 37 (2) (d), "f)" is replaced by "h."
42. In Paragraph 37, at the end of paragraph 2, the dot is replaced by "a 'and the following point (e) is added:
"(e) in the case of the subject matter of the contribution referred to in paragraph 1 (i), the number of pieces of selected species of cloven-hoofed game after its closure in the winter compartment."
43. In Paragraph 37 (3) (a), "0,5" is replaced by "2."
44. in Paragraph 37 (3) (f):
"(f) the frequency of catch devices for cloven-hoofed game does not exceed 1 head per 150 ha of chase and catch gear, when designed as a metal cage, is equipped with a contact sliding wall and a signal transmission device for the closure of the cage;"

50. The following Sections 41a to 41c are inserted after Section 41, including the headings and footnotes 35 to 37:
Financial contribution to the reduction of the numbers of a large cormorant
(1) The subject of the financial contribution to reducing the numbers of a large cormorant is the capture of a large cormorant in accordance with the Hunting Act and the Nature and Lands35 Act.
(2) The request for a financial contribution to the reduction of the numbers of a large cormorant is accompanied by a decision of the State Administration of Hunting to permit or impose a reduction of the numbers of the game (36).
(3) A financial contribution to the reduction of the numbers of large cormorant may be granted for each upper part of the beak of a large cormorant separated at the level of the ozone, the transmission of which is confirmed for destruction in Annex 2 to the application for funding to be provided to the users of the hunt.
Financial contribution to the reduction of wild pig numbers
(1) The financial contribution to reducing the numbers of wild boar is to catch wild boar in accordance with the hunting law.
(2) A financial contribution to the reduction of the number of wild boar stocks may be granted in respect of each item which has exceeded the annual average of the catches of wild boar in the same hunting season for the three marketing years immediately preceding the marketing year for which the financial contribution is requested. Where the catch figure for wild boar for any of the previous 3 marketing years is missing for newly recognised hunts, the value of 3 head per 100 ha of hunting area, rounded to the bottom, shall be used as the annual average of wild boar catches in the previous 3 marketing years.
(3) For the calculation, for the marketing year for which the financial contribution is requested, only cuts registered by the State Veterinary Administration shall be referred to as being examined for the presence of a muscle and presented for such examination with tail.
Financial contribution for landscape greening including fencing
(1) The financial contribution for landscape greening, including fencing, is:
(a) the setting up of new draws outside the land designated for the performance of forest functions; a draw is the wood crop resulting from the planting of suitable species of bushes and trees and providing small animals with a natural shelter in the open land; or
(b) planting of fruit-bearing crops outside the land intended for the performance of forest functions; Fodder trees means forest apple, bird cherry, pear bun, bird crane, sand crane, torah crane, ash crane, white silverskin, monkfish, monkfish, grayfish, grayfish, marlin, chestnut, cleavage, thorn, ivory, plum ivory, rose, halibut and hazelnut.
(2) The application for a financial contribution to the greening of the landscape, including the fencing of timber, is accompanied by:
(a) a declaration by the user of the hunt that the owner of the hunting ground concerned has been given prior consent to the planting of timber on its parcel, together with an indication of the parcel number of the parcel and the name of the cadastral area in which the land is situated;
(b) a diagram of the subject of the contribution to the map of 1: 25 000 or 1: 10 000;
(c) a copy of the proof of purchase of planting material, including in particular the type of wood, the height of the above-ground part and the number of individuals;
(d) photographic documentation of the subject matter of the contribution; and
(e) a project containing, in particular, a list of the parcels on which the harvest or planting crop has been set up, the timber composition of the planting and, in the case of a tie, the area.
(3) A financial contribution for landscape greening, including fencing, may be granted if:
(a) timber from the list of invading non-native species has not been used for planting 37);
(b) the area of the established draw shall not exceed 2 ha per 100 ha of chase, the minimum area of the established draw being 0,05 ha and the maximum area of the established draw being 1 ha; and
(c) for the planting of trees in a set-aside and for the planting of fruit trees, semi-fruit or rootstock with a mechanical barrier to contact with animals of a minimum height of 1 m have been used; half-grain means a wood with an above ground part with a height of 51 to 120 cm, a wood with an above-ground part with a height of 121 to 250 cm.

Explanatory notes:
1) Only suitable timber listed in Annex 4 to Decree No. 83 / 1996 Coll., on the processing of forest development plans and the definition of economic files, as amended, shall be supported.
2) Only white birch, lush birch, bird crane, sticky alder and grey alder are supported from suitable basic trees for the preparation only in the case of seedlings and forest crops.
3) The warm spruce is only supported at the 5-forest-growing-level and at the higher forest-growing stages (this does not apply to the target economic files 39 and 01).

(2) Only white birch, hairy birch, bird crane, sticky alder and grey alder shall be supported from the suitable basic trees of the preparation, only in the case of sieve.
3) The warm spruce is only supported at the 5-forest-growing-level and at the higher forest-growing stages (this does not apply to the target economic files 39 and 01).
