on the details of the granting of state authorisation for the construction of selected gas installations, its modification, extension or cancellation
The Ministry of Industry and Trade (hereinafter referred to as "the Ministry ') provides, pursuant to § 98 (7) of Act No. 458 / 2000 Coll., on the terms and conditions of business and on the exercise of state administration in the energy sector and on the amendment of certain laws (hereinafter referred to as" the Act') for the implementation of § 67 (13) of the Act:
Subject matter
This decree sets out the details of the granting of State authorisation for the construction of selected gas installations (hereinafter referred to as "construction authorisation '), which are the elements of the application for the grant, amendment, extension and revocation of the authorisation, including the models of applications and the details of the conditions for examining such applications.
Application for authorisation for construction
(1) An application for authorisation for the construction of selected gas installations shall be submitted to the Ministry separately for each selected gas plant.
(2) An application for authorisation for the construction of selected gas installations shall be submitted to all new installations, including pipelines, connected to the distribution system of the control station and, in cases of reconstruction of existing selected gas plants, where the replacement of the installation increases the capacity of the selected gas plants. Transfers of selected gas installations are not covered by this obligation.
(3) The model of the application for authorisation for the construction of a direct pipeline is set out in Annex 1, the model of the application for authorisation for the construction of an underground gas storage tank is set out in Annex 2, the model of the application for authorisation for the construction of a gas pipeline connecting the gas system to foreign gas systems is set out in Annex 3, the model of the application for authorisation for the construction of a pressure level pipeline higher than 0,4 The MPa is set out in Annex No 4 and the model application for authorisation for the construction of a liquefied natural gas storage tank of more than 10 m3 is set out in Annex No 7.
Notification of amendments
(1) Changes to the information contained in the decision to authorise the construction or change of an investor, whether before or during the construction, relating to the authorisation granted for construction, shall be notified by the authorisation holder to the Ministry in writing without delay. The Ministry records these changes to the data.
(2) The change in the date of completion, extension or shortening of the pipeline route, the change in capacity parameters and the change in operating pressure of selected gas installations shall be regarded as changes to the data specified in the decision granting authorisation for construction.
Application for extension of authorisation to construction
(1) An application for renewal of the authorisation for construction shall be submitted to the Ministry for each selected gas installation separately, stating the reasons for the extension.
(2) The model of the application for renewal of the authorisation for construction is set out in Annex 5.
Request for revocation of authorisation for construction
(1) The request for revocation of the construction authorisation shall be submitted with justification to the Ministry.
(2) The model of the application for revocation of construction authorisation is set out in Annex 6.
Assessment of applications
When examining applications under § 2 to 5, account shall always be taken of:
(a) compliance with the State Energy Concept;
(b) compliance with the territorial energy concept;
(c) the effectiveness and effectiveness of the proposed construction, including how the construction is financed;
(d) for the protection of the environment, where specific environmental legislation so provides (1);
(e) the accuracy, the veracity and the completeness of the documents submitted.
Efficacy
This decree shall take effect on the day of its publication.
