National Security Office

on the personality and model of forms used in the field of personnel security
The National Security Office provides pursuant to § 22 (4), § 33 (8) and § 47 (2) of Act No. 148 / 1998 Coll., on the protection of classified information and on the amendment of certain laws:
Personal fitness detection
(1) The proposed person requesting an opinion on personality before a psychological examination declares in writing that he is not under the influence of alcohol, narcotic drugs and psychotropic substances.
(2) The psychologist carrying out the psychological examination is familiar in advance with the organisation and methods of psychological examination.
(3) In a psychological examination, an investigating psychologist follows
(a) intellect,
(b) structure and dynamics of personality,
(c) motivation;
(d) behaviour;
(e) attitudes and values.
(4) A psychological examination is used
(a) for level II security clearance, an indicative method consisting of a personality questionnaire, an intellectual test and an interview;
(b) for level III security clearance of standard methods and final interview;
(c) for level IV security clearance as part of a comprehensive screening of the projective method and in-depth interview.
Judgement
(1) The opinion on the personality of the proposed person shall include:
(a) the identity of the proposed person;
(b) means of verification of identity,
(c) the designation for which level of security clearance is issued;
(d) a description of the person proposed,
(e) the results of the examination;
(f) date of examination,
(g) the stamp of the authority of the State or the organisation issuing the opinion;
(h) the name and signature of the investigating psychologist.
(2) The opinion on personality does not contain a conclusion relating to the ability of the proposed person to disclose facts.
Conditions for accreditation of professional centres
(1) The condition for issuing accreditation shall be a written declaration that:
(a) the investigating psychologist will be a graduate of a single-branch psychology study in a university with a experience of more than 5 years, of which at least half must be made up of a psychopathology which has been trained by the National Security Office (the Office) on methods, techniques and evaluation of psychological examination;
(b) the professional workplace shall inform the Office of the estimated amount of the cost of the assessment of the individual competence for each level of security clearance;
(c) in the event of a change of the investigating psychologist, the professional workplace shall notify the Office of this fact and shall demonstrate in the notification the competence of another investigating psychologist;
(d) the professional workplace shall keep written materials which have been produced in the framework of a psychological examination and which have served to issue an opinion on the personality of the proposed person for at least 6 years and shall ensure that they are prevented from unauthorised loading, destroy the materials by shredding or request the Office to carry out the shredding after that period;
(e) the professional workplace shall follow the methodological supervision of the Office for the uniform conduct of psychological examination, use of diagnostic methods and techniques;
(f) the professional workshop agrees to consult the Office on the materials on the basis of which the opinion has been drawn up;
(g) in the event of the cessation of a professional workplace or after the expiry of the accreditation period, the professional office shall forward to the Office written materials which have been produced in the framework of the psychological examinations carried out and used to issue an opinion on the personality of the proposed person.
(2) A written declaration as referred to in paragraph 1 and evidence of the training of the investigating psychologist shall be annexed to the application for accreditation by the expert centre.
(3) The application shall be submitted in writing to the Director of the Office and the accreditation shall be issued for a period of 1 year. Before the expiry of this period, the renewal of accreditation may be reapplied for.
Security questionnaire
The safety questionnaire is set out in Annex 1; it is provided in written or electronic form.
The model of the declaration of personality is set out in Annex 2.
Models of other forms
The forms set out in Annexes 3 to 5 to this Decree shall be used in the field of personnel security.
Efficacy
This Decree shall take effect on 1 November 1998.
