amending Decree No 353 / 2016 Coll., on the admission procedure for secondary education, as amended by Decree No 243 / 2017 Coll., and Decree No 27 / 2016 Coll., on the education of pupils with special educational needs and of pupils gifted, as amended
The Ministry of Education, Youth and Sports provides, pursuant to § 19, § 20 (4), § 60g (4) and § 64 of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended by Act No. 383 / 2005 Coll., Act No. 49 / 2009 Coll., Act No. 472 / 2011 Coll., Act No. 82 / 2015 Coll. and Act No. 178 / 2016 Coll.:
Amendment of the Education Order for pupils with special educational needs and gifted pupils
Annex No. 1 to Decree No. 27 / 2016 Coll., on the education of pupils with special educational needs and gifted pupils, as amended by Decree No. 270 / 2017 Coll. and Decree No. 416 / 2017 Coll., is amended as follows:
1. In Section 3 of Part A of the table Second-degree support measures in point 7 "Adjustments to admission and termination conditions' for point II.7 A." Admission to education 'means the third column, including footnote 11, read: "Rules for adjusting the conditions for admission to secondary education and the corresponding model of the recommendations of the educational counselling establishment are laid down in other legislation11). The head of another school shall adapt the recruitment procedure for the applicant with the need for second-degree support measures, respecting the functional consequences of the applicant's special educational needs, his illness or disability, which may affect the course of the admission procedure. The school shall proceed on the basis of the recommendations of the school advisory establishment.

2. In Section 3 of Part A of the table of third-degree support measures in point 8 "Adjustments to admission and termination conditions' for subsection III (8) (A." Adaptation to admission conditions'), the third column reads as follows: "Rules for adjusting the conditions for admission to secondary education and the relevant model of the recommendations of the educational advisory establishment are laid down in other legislation11). The Director of another School shall adjust the recruitment procedure for applicants with the need for third-degree support measures, respecting the functional consequences of the specific training needs of the candidate, his illness or disability which may affect the course of the admission procedure. Where necessary, the school director shall allow for the presence of a supporting person, the use of additional communication systems for deaf and deaf blind persons, or the use of alternative or augmented means of communication. The school shall proceed on the basis of the recommendations of the school advisory establishment. ';
3. In Section 3 of Part A of the table of the fourth-degree Support Measures in point 8 "Adjustments to the conditions of admission to and termination of education 'of point IV (8) A." Adaptation to the conditions of admission to education' of the third column reads: "Rules for adjusting the conditions for admission to secondary education and the relevant model of the recommendations of the educational advisory establishment are laid down by other legislation11). The principal of another school shall adjust the course of the admission procedure for applicants with the need for fourth-degree support measures, respecting the functional consequences of the specific training needs of the candidate, his illness or disability which may affect the course of the admission procedure. Where necessary, the school director shall allow for the presence of a supporting person, the use of additional communication systems for deaf and deaf blind persons, or the use of alternative or augmented means of communication. The school shall proceed on the basis of the recommendations of the school advisory establishment. ';
4. In Section 3 of Part A in the table of fifth-degree support measures in point 8 "Adjustments to the conditions of admission and termination of education 'for point V.8 A." Adjustments to admission conditions for education' means the third column: "Rules for adjusting the conditions for admission procedures for secondary education and the relevant model of the recommendations of the educational counselling establishment are laid down in other legislation11). The admission of applicants to education at another school shall be governed by the provisions of the Education Act and shall respect the functional consequences of the illness or disability of the applicant, which have already been respected during his previous education and which may affect the course of the admission procedure. The principal of the school shall adjust the recruitment procedure for applicants with the need for fifth-degree support measures in a similar manner to that of the fourth-stage. ';
Efficacy
This Decision shall enter into force on 1 November 2018.
