DECLARATION
of 16 September 2019
amending Decree No 470 / 2012 Coll., on the use of toll-charged infrastructure, as amended
The Ministry of Transport provides for the Act No. 13 / 1997 Coll., on the Road, as amended by Act No. 102 / 2000 Coll., Act No. 80 / 2006 Coll., Act No. 97 / 2009 Coll., Act No. 347 / 2009 Coll., Act No. 152 / 2011 Coll., Act No. 196 / 2012 Coll., Act No. 64 / 2014 Coll., Act No. 268 / 2015 Coll., Act No. 225 / 2017 Coll. and Act No. 193 / 2018 Coll., for the implementation of § 20 (1), § 22a (3) and § 22c (2) (f) and § 22c (7) Act:
Decree No. 470 / 2012 Coll., on the use of toll-charged infrastructure, as amended by Decree No. 307 / 2015 Coll., Decree No. 434 / 2016 Coll., Decree No. 458 / 2017 Coll. and Decree No. 247 / 2018 Coll., is amended as follows:
1. In Paragraph 3, "1 550 'is replaced by" 2 468'.
2. in Article 4 (a), the word "toll" shall be inserted after the word "number."
3. In Article 5 (1), the words "and by taking over electronic equipment 'are replaced by the words" or through customer service'.
4. Paragraph 6 (1) is deleted and paragraph 2 is deleted.
5. Paragraph 8 (1) reads as follows:
"(1) The vehicle operator shall cancel the vehicle with the electronic toll system operator and return the electronic device to it at the contact or distribution point or via the postal service operator. When the vehicle is unchecked, the vehicle operator shall submit a vehicle registration certificate or a technical certificate or other document proving the removal of the vehicle from the vehicle register. Those documents may be replaced by evidence of the identity of the vehicle operator or of the representative of the vehicle operator if the representative of the vehicle operator is registered in the toll system. ';
6. In Article 8 (2), the words "or distribution 'shall be inserted after the words" contact'.
7. Paragraph 10 (3) reads as follows:
"(3) The electronic toll system operator shall be entitled to block the electronic equipment due to a serious breach of the terms and conditions of the electronic toll system operator; the locking of the electronic device shall be given prior warning by the vehicle operator. If the electronic device is blocked during use of the toll infrastructure, the operator or the driver of the vehicle shall ensure that it is exchanged for a fully functioning electronic device at the nearest contact or distribution point. ';
8. At the end of the text of § 12, the words "or placed under the arrangements for such carriage 'shall be added.

Transitional provision
This Decision shall enter into force on the date of its adoption.
Efficacy
This Regulation shall enter into force on 22 September 2019, with the exception of Article I (9), which shall take effect on 1 January 2020.
