DECLARATION
of 29 June 2012
amending Decree of the Ministry of Transport and Communications No. 31 / 2001 Coll., on driving licences and on the register of drivers, as amended
The Ministry of Transport provides pursuant to Article 137 (2) of Act No. 361 / 2000 Coll., on road traffic and on amendments to certain laws (Road Traffic Act), as amended by Act No. 478 / 2001 Coll., Act No. 53 / 2004 Coll., Act No. 411 / 2005 Coll., Act No. 226 / 2006 Coll., Act No. 274 / 2008 Coll., Act No. 133 / 2011 Coll. and Act No. 297 / 2011 Coll., (hereinafter "the Act ') for the implementation of § 92 (8), § 104 (5), § 105 (5), § 109 (10), § 115 (8) and § 122b of the Act:
Decree No. 31 / 2001 Coll., on driving licences and on the register of drivers, as amended by Decree No. 154 / 2003 Coll., Decree No. 177 / 2004 Coll., Decree No. 194 / 2006 Coll. and Decree No. 27 / 2012 Coll., is amended as follows:
1. In Paragraph 1 (1), the following footnote 5 is inserted after the word "Republic ':
"(5) Directive 2006 / 126 / EC of the European Parliament and of the Council of 20 December 2006 on driving licences. Commission Directive 2011 / 94 / EU of 28 November 2011 amending Directive 2006 / 126 / EC of the European Parliament and of the Council on driving licences. ';
2. Paragraph 1 (2) reads as follows:
"(2) The individual information in the driving licence referred to in paragraph 4 shall be given in the Czech language, legibly, in large letters in Latin alphabet and Arabic numerals. Information on the identification, title and scientific rank of the holder of the driving licence and the name of the issuing authority may also include small printing letters. The signature of the holder of the driving licence shall correspond to the signature drawn up by the applicant's own hand. ';
3. in Article 1 (3) (a), the words "the Czech Republic" shall be replaced by the words "the CZECH REPUBLIC."
4. in Paragraph 1 (3) (c):
"(c) the inscription" DEVICE TRADE, "'
5. in Article 1 (3) (d), the words "model of the European Communities" shall be replaced by the words "MODEL OF THE EUROPEAN UNION," the words "others" shall be deleted; the words "European Communities" shall be replaced by "European Union" and the words "Member State" shall be replaced by "Annex 6."
6. In Article 1 (4), the words "code numbers' are replaced by the words" following digits', the words "(hereinafter referred to as" issuing authority ')', the words "permanent residence of the holder of a driving licence 'are replaced by the words" normal residence of the holder of a driving licence on the territory of the Czech Republic' and the words "and subgroups of driving licences certified by the holder 'are replaced by the words" vehicles which are entitled to drive the licence'.
7. Paragraph 1 (5) reads as follows:
"(5) The following particulars shall appear on the back of the driving licence referred to in paragraph 1 under the following numbers:
9. groups of vehicles which are entitled to drive the licence holder,
10. the date of creation of the driving licence for each group of vehicles, which shall be indicated in the order of the date, month and year (in DD.MM.RR format); that date shall be indicated on each driving licence newly issued to its holder for exchange of a driving licence or on a duplicate of a driving licence issued for loss, theft, damage or destruction of a driving licence;
11. the expiry date of the driving licence for each group of vehicles (in DD.MM. RR format),
12. a record of the suspension or limitation of the driver's driving licence and professional competence as specified by the harmonised code referred to in Article 11 and the national code referred to in Article 11a;
13. record of information relevant to the management of the driving licence by the host Member State;
14. other records. '.
8. Paragraph 1 (8) is deleted.
Paragraph 9 shall become paragraph 8.
9. Sections 9 and 10 are deleted, including the headings.
10. in Article 10a (1), the words "the European Communities" shall be deleted;
11. in Article 10a (3), "Article 81" shall be replaced by "Article 80a," "the relevant harmonisation code" shall be replaced by "the relevant harmonised code" and the word "harmonisation" shall be deleted;
12. Sections 11 and 11a, including the headings, read:
Harmonised codes
(1) The driving licence shall include harmonised codes under the 01 to 99 heading recording the conditions and limitations of the driving licence, the professional competence of the driver and other administrative matters.
(2) The list of harmonised codes referred to in paragraph 1 and their delimitation are set out in Part I of Annex 5.
National codes
(1) In addition, the driving licence shall indicate the national codes under the code number 100 and higher, recording certain other conditions and restrictions on the driving licence and other administrative matters.
(2) The list of national codes referred to in paragraph 1 and their delimitation are set out in Part II of Annex 5. ';
13. The heading of Section 12 reads: "Application for a driving licence, issue of a driving licence and international driving licence."
14. in Paragraph 12 (1):
"(1) The model of the application for a driving licence and the application for a driving licence is set out in Annex 7."
15. Paragraph 12 (3) reads:
"(3) The model of the application for an international driving licence is set out in Annex 7a."
16. Paragraph 15, including the title, reads:
Confirmation of loss, theft, damage or destruction of a driving licence
The model of the certificate of notification of loss, theft, damage or destruction of the driving licence is set out in Annex 9. ';
17. in Article 17 (2) (b), the words "and subgroups of licences granted" shall be replaced by the words "vehicles which the driver is entitled to drive."
18. in Paragraph 17 (2) (e), the words "the European Communities" shall be replaced by the words "issued by other Member States";
19. in Article 17 (2) (j), the words "or some group or subgroup of driving licences" shall be replaced by the words "for a group or groups of vehicles."
20. in Article 17 (2) (m), the words "the European Communities" shall be replaced by the words "issued by other Member States."
21. in Article 17 (2) (p) and (3) (e), the words "the European Communities" shall be replaced by the words "issued by another Member State."
22. in Article 17 (3) (a), the words "award or extension of driving" shall be replaced by the words "driving."
23. in Article 17 (3), the following point (d) is inserted after point (c):
"(d) a request for a decision on the professional competence of the driver;"
Points (d) to (r) shall be renumbered as points (e) to (s).
24. in Article 17 (3) (f), "the European Communities" shall be replaced by "issued by another Member State."
25. In Article 17, at the end of paragraph 3, the dot is replaced by a comma and the following point (t) is added:
"(t) other official records and documents relating to the driver."
26. Annex No 1 reads as follows:
