amending Act No 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended
Parliament has decided on this law of the Czech Republic:
Čl. I
Amendment of the Education Act
Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended by Act No. 383 / 2005 Coll., Act No. 112 / 2006 Coll., Act No. 158 / 2006 Coll., Act No. 161 / 2006 Coll., Act No. 165 / 2006 Coll., Act No. 179 / 2006 Coll., Act No. 342 / 2006 Coll., Act No. 624 / 2006 Coll., Act No. 217 / 2007 Coll., Act No. 296 / 2007 Coll., Act No. 343 / 2007 Coll., and Act No. 58 / 2008 Coll., is amended as follows:
1. Paragraph 60, including the title, reads:
„§ 60
Admission to the first year of secondary education
(1) The Director of the School shall declare the different stages of the admission procedure in accordance with the implementing legislation. The number of wheels of the admission procedure is not limited. For admission to the first year of secondary school, the school director shall declare at least one round of admission. The deadline for the first round of the admission procedure is laid down in the implementing legislation.
(2) In the course of the recruitment procedure, the school director may decide to take the entrance examination. The acceptance test is a method of verifying the assumptions of a candidate whose content and form shall be determined by the school director in accordance with the basic education framework programme. In this case, for the first round of the admission procedure, the school director shall set at least two dates for the examination. The focus and complexity of the entrance examinations carried out at the different dates of the first round of the admission procedure and the way in which the results obtained in the entrance examinations are assessed shall be such as to enable the overall order of success of the candidates for the first round of the admission procedure to be determined. If the school director decides not to take the examination, he shall inform the candidate or legal representative of the minor without undue delay.
(3) For admission procedures, the school director shall determine:
(a) uniform criteria for all tenderers accepted in each individual round of admission to the relevant field of education and form of education for a given school year; and
(b) the estimated number of applicants admitted to each field of education and form of education.
(4) Decisions on the holding of the entrance examination, if the Director of the School has decided on its conduct in the context of the admission procedure, on the dates of the entrance examination, on the uniform criteria laid down and on the expected number of applicants admitted to the School Director
(a) for the first round of admission procedures for the fields of education with a talent test by 30 October, for the other fields of education by 31 January;
(b) for the next round of the admission procedure, no later than the date of publication of the relevant round of the admission procedure.
Individual decisions of the School Director shall also be published in a way that allows remote access.
(5) Applications for secondary school education for the first round of the admission procedure shall be submitted by an elderly candidate or legal representative of a minor candidate to the Director of the secondary school concerned, on the form prescribed by the Ministry and within the time limit laid down in Section 60b.
(6) The application shall include the documents provided for in the implementing legislation and, in the case of a minor tenderer, its acceptance.
(7) For the first round of admission to the daily form of training, the applicant may submit three applications. For the first round of the admission procedure for one field of education held within one school, if the school director decides to take the entrance examination, the examination may not be carried out on several different dates in which the entrance examination is held.
(8) The admission test for the first round of the admission procedure, if announced by the school director, shall be held within the time limit set by the implementing legislation. The invitation to the entrance exam for the first round of the admission procedure to the daily form of education for a specific term shall be sent by the school director 14 days before the date of the entrance examination.
(9) The same deadline for taking the entrance examination or the talent examination in another field of education or other school to which the applicant has applied for shall not justify the setting of a replacement date for the admission examination or the talent examination referred to in paragraph 12.
(10) At the end of the first round of the admission procedure, the school director may declare further cycles of the admission procedure to fulfil the intended status of the pupils, acting in a similar manner to that of the first round, except for the obligation to set 2 terms of the entrance examination. The entrance examination shall take place for the next stages of the admission procedure at the dates specified by the school director, but not earlier than 14 days after the announcement of the relevant round of the admission procedure. The invitation for the entrance exam for the next stages of the entrance procedure shall be sent by the school director no later than 7 working days before the date of the entrance examination.
(11) Candidates who do not show up within the specified time limit for serious reasons for the admission or talent test and duly apologize in writing to the principal of the school no later than 3 days after the deadline for the admission or talent test, the Director of the school shall set a replacement deadline for its execution. The admission or talent test shall take place within 1 month of the date of the proper entrance or talent examination.
(12) In justified cases, the school director may decide to extend the duration of the entrance or talent examination to subsequent working days immediately following the deadline set for the admission or talent examination.
(13) In the various stages of the admission procedure, the school director shall evaluate the candidate according to:
(a) evaluation in previous education certificates;
(b) the results of the evaluation achieved in the talent test, if established;
(c) the results of the assessment obtained during the acceptance test, if established; and
(d) other facts which prove the appropriate ability, knowledge and interests of the tenderer.
(14) Where more than one tenderer than one tenderer is eligible for admission, the ranking shall be determined in accordance with the results of the evaluation of the admission procedure.
(15) The admission of a candidate to secondary school education shall also be subject to compliance with the conditions of medical fitness of the candidate for a given field of education, if any.
(16) The school director shall terminate the evaluation of candidates within 3 working days after the deadline for the entrance examinations. According to the results obtained by the individual tenderers in the recruitment procedure, the school director shall determine their ranking and send a decision to accept or not to accept the candidate or the legal representative of the minor tenderer.
(17) If the entrance examination is not carried out in the first round of the admission procedure, the school director shall send a decision to accept or not to accept a candidate or a legal representative of a minor candidate without undue delay, no later than the end of the deadline set for the admission examination.
(18) The decision on the outcome of the recruitment procedure, which cannot be served on the tenderer or on the legal representative of the minor tenderer, shall be imposed for a period of 5 working days, then deemed to have been received. A document which cannot be served shall be deposited at the premises of the postal service operator where it is served through it.
(19) The appeal of the candidate against the decision of the school director on the outcome of the recruitment procedure may be filed within 3 working days of receipt of the decision.
(20) The applicant to whom the decision to take up the training has been served must be required to confirm his intention at the secondary school concerned in accordance with § 60a.
(21) Admission to another form of education shall be treated in a similar manner to that of the daily form of education.
(22) If the school director declares further rounds of admission procedures, he shall immediately notify the Regional Office of the number of vacancies in each field of education and form of education. The Regional Authority shall publish without delay an overview of secondary schools with data on the number of vacancies in individual fields of education and forms of education, including in a way that allows remote access. '.
2. The following Section 60a and Section 60b are inserted after Section 60, including the headings:
„§ 60a
Registration form
(1) To confirm the applicant's intention to become a pupil of the relevant field of education and form of education at the secondary school concerned, the entry note is used.
(2) A candidate who is a primary school student will receive a registration card at that primary school no later than 15 March or 30 November if he applies for an education course with a talent test. In other cases, at the request of the tenderer, the Regional Office responsible for the place of permanent residence of the tenderer shall issue the entry note.
(3) Each applicant for secondary school education participating in the admission procedure for the following school year shall receive one entry note.
(4) The Ministry provides for an implementing act
(a) the form and content of the entry note;
(b) the manner in which they are recorded; and
(c) details of the issue of replacement registration cards.
(5) The entry note shall be endorsed by the stamp and signature of the official of the authority issuing the entry note.
(6) The applicant or legal representative of a minor candidate shall confirm his intention to educate himself at the secondary school concerned by submitting the entry note to the principal of the school who has decided on his admission to education no later than 5 working days after the date on which the candidate received the decision.
(7) If the applicant or the legal representative of a minor tenderer does not confirm the intention to educate himself in a secondary school pursuant to paragraph 6, he shall waive his right to be admitted as a pupil of the secondary school concerned and another candidate may be admitted to his post. The right to be a student of a secondary school shall also be waived by a candidate who shall request in writing the Director of the secondary school concerned to give back the registration.
§ 60b
Application dates for the first round of the admission procedure
(1) The applicant shall submit an application for a daily form of education to the principal of the secondary school by 15 March, in the case of an application for an education course with a talent test by 30 November.
(2) A candidate applying for a non-daily form of education shall submit an application to the Director of a secondary school by 20 March, in the case of an application for an education course with a talent test by 30 November. "
3. In Paragraph 62, at the end of paragraph 2, the sentence "In the event of a test taking place on a replacement date, the deadline for communicating the result of the talent test according to the third sentence shall not apply."

This Act shall take effect on the day of its publication.
