GOVERNMENT REGULATION
of 21 April 2004
laying down certain details and conditions for granting the single agricultural area payment for 2004
The Government orders pursuant to § 2c (6) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll., (hereinafter referred to as "the Act"):
Subject matter
This Regulation lays down certain details and detailed conditions for granting the single agricultural area payment for the year 2004 (hereinafter referred to as "payment '), the adjustment of which by the immediately binding provisions of the European Community1) (hereinafter referred to as" the rules of the European Communities') to Member States of the European Union or allowing it to be implemented.
Applicant
The applicant for payment ("the applicant ') is a natural or legal person who, in his own name and under his own responsibility, manages agricultural land which is kept on the applicant's record of the use of agricultural land according to user relations (Sections 3a and 3b of the Act) (hereinafter" the register').
Application for payment
(1) Payment applications (hereinafter referred to as "applications") shall be submitted to the State Agricultural Intervention Fund (hereinafter referred to as "the Fund") on the form issued by it by 15 May 2004.
(2) Where the applicant grows hemp on one of the soil blocks (Section 3a (3) of the Law) or on one of the parts of the soil blocks (Section 3a (4) of the Law) referred to in the application, he shall add to the application a recognition certificate (3) on the certification of hemp seed and a declaration that the Fund shall immediately notify the commencement of the flowering of hemp on one of the soil blocks or on one of the parts of the soil blocks referred to in the application referred to in paragraph 1.
Conditions for receipt of payment
(1) Payment shall be granted for agricultural land which, on 30 April 2004, is kept in the register of the applicant and is cultivated on agricultural land between 1 May 2004 and 31 August 2004.
(2) The minimum area for which payment may be granted under paragraph 1 must be at least 1 hectare of agricultural land, according to the data recorded on the basis of previous records (Sections 3a and 3b of the Act).
(3) The payment referred to in paragraph 1 shall be granted if the applicant fulfils the conditions to the extent laid down by European Community rules (1) and undertakes to comply with good agricultural and environmental conditions.
(4) For the purposes of this Regulation, good agricultural and environmental conditions shall mean the non-interference of landscape or other elements preventing, in particular, wind or water erosion of the soil (for example, limits, terraces, windbreakers, grubbed valleys and field paths using natural sloping, respecting plantations and possibly accompanied by ditches.
Efficacy
(1) This Regulation shall enter into force on the date of the entry into force of the Treaty of Accession of the Czech Republic to the European Union.
(2) This Regulation shall expire on 30 April 2005.
