DECLARATION
of 27 June 2012
on the determination of the scope and form of the information transmitted on the security breach and network integrity loss
Pursuant to Section 150 (5) of Act No. 127 / 2005 Coll., on Electronic Communications and amending certain related acts (Act on Electronic Communications), as amended by Act No. 468 / 2011 Coll., the Czech Telecommunications Office provides for the implementation of Section 98 (4) of the Electronic Communications Act:
Scope of the information transmitted
(1) An entrepreneur providing a public communications network or providing a publicly available electronic communications service (hereinafter referred to as "the entrepreneur") in compliance with the obligation under Section 98 (4) of the Electronic Communications Act in the information transmitted to the Czech Telecommunications Office (hereinafter referred to as "the Office") and shall indicate:
(a) the date and time of occurrence of the event;
(b) the reason for the restriction or interruption of the provision of a publicly available electronic communications service;
(c) the area and extent of the disruption of the public communications network or technological facilities, the territorial scope of the restriction or interruption of the provision of publicly available electronic communications services and the measures taken to restore the network and the provision of services;
(d) the type of publicly available electronic communications services affected;
(e) the type of public communications network affected;
(f) the number of participants or users, where applicable, publicly available electronic communications services affected by events, indicating whether they have been maintained with access to emergency numbers;
(g) the estimated time for removing the cause of the restriction or interruption of the provision of publicly available electronic communications services;
(h) the name and surname of the person authorised to act as an entrepreneur in respect of the performance of the information obligation, including his contact details, at least within the scope of the telephone number and e-mail address.
(2) In carrying out the obligation under Article 98 (4) of the Electronic Communications Act, the entrepreneur shall, in the information transmitted to users of publicly available electronic communications services, provide at least the information referred to in paragraph 1 (a), (d) and (g).
(3) The entrepreneur shall immediately inform the Office, the entities operating the emergency call centre and the users of the publicly available electronic communications service of the date and time of entry into service of all affected technological units and of the resumption of the provision of the electronic communications service.
Form of the information transmitted
(1) The operator shall transmit the information referred to in Article 1 (1) in the form of a notification of the breach of security and loss of integrity of the public communications network, of the interruption of the provision of a publicly available electronic communications service or of the refusal of access to that service. The model of the form of this notification is set out in the Annex to this Order.
(2) The undertaking shall transmit the notification referred to in paragraph 1:
(a) by e-mail, in the form of a data message signed by the guaranteed electronic signature (1), or by means of a data box or by telephone, if the electronic form of communication cannot be used;
(b) bodies operating an emergency call centre by e-mail in the form of a data message signed by a recognised electronic signature or by telephone, where electronic mail cannot be used.
(3) The information referred to in Article 1 (2) shall be transmitted by the trader to users of publicly available electronic communications services by means of a communication published in the mass media, in a manner that allows remote and continuous access, or where this is useful in view of the number of participants and the nature of the case, in a similar manner.
(4) The information referred to in Article 1 (3) shall be transmitted by the entrepreneur to the Office, to bodies operating an emergency reception centre and to users of publicly available electronic communications services in the manner referred to in paragraphs 2 and 3.
Transmission of information for emergency situations
An entrepreneur who is obliged to inform the Office without delay of a threat or breach of the security and integrity of the network, of the security of the service and of the restriction or interruption of the provision of a publicly available telephone service shall transmit such information to the Office in accordance with § 1 (1) and (3) and in the form of § 2 (1) and 2 (a).
Efficacy
This Decree shall take effect on 1 August 2012.
