GOVERNMENT REGULATION
of 16 July 2003
laying down the conditions for setting individual limits for the acquisition of suckler cow premiums
The Government orders the implementation of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 62 / 2000 Coll., Act No. 307 / 2000 Coll. and Act No. 128 / 2003 Coll.:
Subject matter
This Regulation lays down, in accordance with European Community law, a national limit and individual limits for farmers (2) for suckler cows for meat production.
Definition of terms
For the purposes of this Regulation:
(a) suckler cow holdings in the establishment where the animals are kept or kept on the farm of the breeder, (2) on land leased by the breeder, (2) on the territory of the Czech Republic on 31 March 2003;
(b) suckler cow milk cow of breed, (3) listed in Annex 1 to this Regulation, kept on the holding for meat production;
(c) the national limit on the aggregate number of premium rights for breeders, (2) provided for in this Regulation for breeders (2): suckler cows operating on holdings in the Czech Republic;
(d) an individual limit on the right to the premium for breeders, (2) keeping suckler cows on holdings (hereinafter referred to as "the breeder"), laid down by the Ministry of Agriculture (hereinafter referred to as "the Ministry"),
(e) the right to the premium, the right granted by the Ministry to the farmer for the subsidy under this Regulation;
(f) the national reserve for obtaining suckler cow premiums, the number of suckler cow premium rights allocated to breeders in accordance with this Regulation.
National limit
The national limit is 90 300 individual limits.
Application for an individual limit on suckler cows
(1) The application for an individual limit on suckler cows (hereinafter referred to as "the application") shall be submitted by the breeder to the Ministry in accordance with the model set out in Annex 2 to this Regulation.
(2) The breeder shall indicate in the application:
(a) the registration number of the holding;
(b) identification number of the animal,
(c) the breeding of the animal;
(d) the name of the cadastral territory in which the individual establishment or parcel of the holding on which the suckler cow is kept, for which the individual limit is requested;
(e) the inclusion of the cadastral territory in the area under Government Regulation No 505 / 2000 Coll., establishing support programmes to promote non-production functions of agriculture, to support the activities involved in the maintenance of the landscape, to help promote less favourable areas and to assess them, as amended by Government Regulation No 500 / 2001 Coll.
(3) The application shall be accompanied by an officially certified copy of the document authorising the holding in agriculture under the special legislature.4)
Criteria for setting individual limits on suckler cows
(1) The application may be lodged no later than 30 days after the date of entry into force of this Regulation.
(2) The Ministry will compare the data in the application with the data kept in the central register under the breeding law when examining the applications of breeders. 5)
(3) The minimum number of suckler cows for which an individual limit may be applied for shall be 5 head.
(4) The Ministry shall prioritise individual limits on suckler cows kept in the areas referred to in paragraph 5.
(5) The Ministry provides for each suckler cow kept in:
(a) mountain areas 1. Type6) 1 premium right;
(b) mountain areas of type 2 (6) (1) premium right;
(c) other less favourable areas of type 1 (6) 0,95 premium rights,
(d) other less favourable areas of Type 2 (6) 0,9 premium rights;
(e) other less favourable areas of type 3 (6) 0,85 premium rights,
(f) other less favourable areas of type 4 (6) 0,8 premium rights,
(g) areas with specific restrictions of type 1 (6) 0,7 premium rights,
(h) areas with specific restrictions 2. Type6) 0,65 premium rights;
(i) the 1, 2 or 3 zones of the national park, or the protected landscape area, (7) in which the area referred to in (a) to (f) is not concerned, 0,75 premium rights.
(6) The Ministry shall fix for each suckler cow kept outside the area referred to in paragraph 5 a multiple of the individual limits, calculated as a proportion of the difference between the national limit and the total sum of the individual limits established by the Ministry pursuant to paragraph 5, and the total number of suckler cows kept outside the area referred to in paragraph 5.
(7) The individual limit established by the Ministry for Breeders includes the limits set by the Ministry pursuant to paragraphs 5 and 6.
(8) The individual limit established by the Ministry's breeders in accordance with paragraph 7 shall be rounded to the bottom of the whole number when they form a decimal figure with a decimal figure. The minimum number of individual limits established by the Ministry to the individual breeder shall be at least 3 individual limits.
Application for and assessment of an individual limit on suckler cows
The application for an additional individual limit on suckler cows (hereinafter referred to as "the additional application ') shall be submitted by the breeder,
(a) which has been rejected in full by the Ministry in accordance with Article 4 on account of incorrect completion of the data in the application;
(b) which did not infringe the law when the information in the application was incorrect, 5)
the Ministry in accordance with the model set out in Annex 3 to this Regulation.
(1) An additional request may be made to the Ministry no later than 10 days after the date of entry into force of this Regulation.
(2) An additional application, which is incomplete, contains false information or is submitted after the period referred to in paragraph 1, shall not be taken into account by the Ministry.
(3) When examining an additional application, the Ministry will apply the criteria and procedures set out in paragraphs 2 to 8 of Section 5 mutatis mutandis. The Ministry shall set individual limits on suckler cows for each area in accordance with Sections 5 (5) and 5 (6), respectively, in accordance with the categories referred to in the various provisions of Sections 5 (5) (a) to (i) and, where appropriate, with Section 5 (6). In the absence of individual limits on suckler cows for all producers of suckler cows from each area, in accordance with § 5 (5) or § 5 (6) respectively, these individual limits on suckler cows shall become part of the national reserve for obtaining suckler cow premiums.
Efficacy
This Regulation shall enter into force on the day of its publication.

*) The proportion of blood in suckler cows of the breed referred to in point 13 shall be at least 75%; where the father of a suckler cow is a bull registered in the Breeding Book of Bovines of the Czech Bovines in Section M, the proportion of blood C must be at least 50%; in the case of crosses of suckler cows developed by crossing of suckler cows with one of the breeds referred to in points 1 to 12, the proportion of blood of those breeds shall be at least 50%.
