amending and supplementing the Act of the Czech National Council No. 20 / 1987 Coll., on State Monument Care, as amended by the Act of the Czech National Council No. 425 / 1990 Coll., on District Offices, the modification of their responsibilities and on certain other measures related thereto
The Czech National Council decided on this law:
The Act of the Czech National Council No. 20 / 1987 Coll., on State Heritage Care, as amended by the Act of the Czech National Council No. 425 / 1990 Coll., on District Offices, the modification of their responsibilities and on certain other measures related thereto, is amended as follows:
1. Paragraph 14 (8) reads as follows:
"(8) The renewal of cultural monuments or parts thereof, which are works of art or artisanal works, may only be carried out by natural persons on the basis of an authorisation granted by the Ministry of Culture. Legal persons may carry out restoration of cultural monuments or parts thereof, which are works of art or artistic craft through natural persons authorised for restoration. In the decision granting an authorisation, the Ministry of Culture may determine the scope of the activity and, where appropriate, other conditions for its execution. Such authorisation may be withdrawn if they do not comply with the conditions under which the authorisation was granted to them or if they carry out the renewal of cultural monuments or parts thereof in a way which distorts their value. ';
Article 16 (2) reads as follows:
"(2) In the event of an exceptional social interest in preserving the cultural heritage, the Ministry of Culture may contribute to the restoration of the cultural heritage. '.
3. In Paragraph 22 (2), the second sentence is: "If a construction worker is a legal person or a natural person in whose business the need for rescue archaeological research arises, the costs of rescue archaeological research shall be borne by that builder; otherwise cover the costs of an archaeological research organisation. ';
4. Paragraph 35 (1) (h) reads as follows:
"(h) restores cultural monuments pursuant to Paragraph 14 (8) through natural persons not authorised by the Ministry of Culture;"
5. Article 35 (2) (c) reads as follows:
"(c) restores national cultural monuments pursuant to Paragraph 14 (8) through natural persons not authorised by the Ministry of Culture;"
6. in Paragraph 39 (2), the amount "1000 Kčs' is replaced by" 10 000 Kčs' and the following point (h) is inserted after point (g):
"(h) carry out the restoration of cultural monuments pursuant to Paragraph 14 (8) without the permission of the Ministry of Culture,"
Point (h) shall be renumbered as point (i).
7. In Paragraph 39 (3), the amount "5000 Kčs' is replaced by" 50 000 Kčs' and the following point (f) is added:
"(f) restores the national cultural monuments referred to in Paragraph 14 (8) without the permission of the Ministry of Culture."
This Act shall take effect on 1 June 1992.
