GOVERNMENT REGULATION
of 16 July 2003
laying down the conditions for setting individual limits for the award of the ewes and goats premium
The Government orders the implementation of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 62 / 2000 Coll., Act No. 307 / 2000 Coll. and Act No. 128 / 2003 Coll.:
Subject matter
This Regulation lays down, in accordance with the law of the European Communities (1), the national limit and the individual limit for breeding (2) ewes and goats for the production of meat.
Definition of terms
For the purposes of this Regulation:
(a) female ewe sheep which has already been feared at least once or reached at least 1 year of age and is kept on a holding in the Czech Republic;
(b) a female goat which has already been streaked at least once or reached at least 1 year of age and is kept on a holding in the Czech Republic for the purpose of producing meat;
(c) the holding of the breeding of ewes and goats of the breeders (m2) in the establishment where the animals are kept, or the rearing of such animals on the breeder's own land, (2) possibly on the land leased by the breeders (2) in the Czech Republic on 31 March 2003;
(d) by national limit, the aggregate number of premium rights for breeders, (2) provided for by this Regulation for breeders (2) of ewes or goats, where applicable;
(e) an individual limit on the right to the premium for breeders, (2) keeping ewes or goats on farms (hereinafter referred to as "breeder"), as determined by the Ministry of Agriculture (hereinafter referred to as "Ministry"),
(f) the right to the premium the right granted by the Ministry to the farmer for the subsidy under this Regulation.
National limit
The national limit is 66 733 individual limits.
Application for an individual limit on ewes and goats
(1) An application for an individual limit on ewes and goats (hereinafter referred to as "the application") shall be submitted by the breeder to the Ministry in accordance with the model set out in the Annex to this Regulation.
(2) The breeder shall indicate in the application:
(a) the registration number of the holding;
(b) identification number of the animal,
(c) the name of the cadastral territory on which the individual establishment or parcel is situated of the holding on which the breeder keeps the ewes or goats for which the individual limit is requested;
(d) the inclusion of the cadastral territory in the area under Government Regulation No 505 / 2000 Coll., establishing support programmes to promote non-production functions of agriculture, to support the activities involved in the maintenance of the landscape, aid programmes to promote less favourable areas and criteria for their assessment, as amended by Government Regulation No 500 / 2001 Coll.
(3) The application shall be accompanied by an officially certified copy of the document authorising the holding in agriculture under the special legislature.3)
Criteria for setting individual thresholds for ewes and goats
(1) The application may be lodged no later than 30 days after the date of entry into force of this Regulation.
(2) The Ministry shall make a comparison of the data in the application with the data kept in the central register in accordance with the Breeding Act (4) when examining breeders' applications.
(3) The minimum number of ewes or goats for which individual limits may be applied for shall be 10 pieces of such ewes or goats.
(4) The Ministry sets individual limits on ewes or goats to farmers who keep ewes or goats in the Czech Republic.
(5) In the event that the number of applications for individual ewes or goats is higher than the national limit, the Ministry shall determine for each ewes or goat kept in:
(a) mountain areas and other less favourable areas (5) (1) premium right;
(b) areas with specific limitations (6) and in the national park zone (1), (2) or (3), or protected landscape7) 0.8 premium rights.
(6) The Ministry shall fix for each ewe or goat kept outside the area referred to in paragraph 5 a multiple of the individual limits, calculated as a proportion of the difference between the national limit and the total sum of the individual limits established by the Ministry pursuant to paragraph 5, and the total number of ewes and, where applicable, goats kept outside the area referred to in paragraph 5.
(7) The individual limit established by the Ministry's breeders in accordance with paragraphs 5 and 6 shall be rounded down, if they form a figure with a decimal figure remaining, to the whole number downwards. The minimum number of individual limits established by the Ministry to the individual breeder shall be at least 10 individual limits.
(8) The individual limit set by the Ministry for Breeders includes the limits set by the Ministry pursuant to paragraphs 5 to 7.
Efficacy
This Regulation shall enter into force on the day of its publication.
