DECLARATION

Ministry of Transport and Communications

of 10 June 2002

on the fixing of water tanks and watercourses on which navigation of vessels with combustion engines is prohibited and on the extent and conditions of use of surface water for navigation

The Ministry of Transport and Communications, in agreement with the Ministry of the Environment, provides, pursuant to § 7 (5) of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), hereinafter referred to as "the Act":

§ 1

Subject matter

This decree sets out water tanks and water streams on which the voyage of vessels with combustion engines is prohibited, 1) and the scope and conditions of the use of surface water for navigation.

§ 1a

Basic concepts

For the purposes of this decree:

(a) by water skiing, an activity carried out using water skis or other floating object without its own steering gear in a tow behind a combustion engine vessel;

(b) by a jet ski, a vessel of less than 4 m in length, using an internal combustion engine with a hydroreactive propulsion system as the main source of propulsion and designed to drive by a person or persons seated, standing or kneeling on the hull, not within it;

(c) by a vessel intended to sail in glide, a small craft with its own propulsion capable of carrying one or more persons, designed and constructed to glide at a high speed, with a power / displacement ratio r > 120, or, where applicable, Frode Fn > 3;

(d) the use of an internal combustion engine as an auxiliary propulsion of a sailboat for its use in order to ensure the safety of navigation when manoeuvring in ports, berths, bulkheads and locks, and in serious defects preventing the use of dyeing, or for arriving in non-wind or other adverse climatic conditions; it is not permanently used in normal operation.

§ 2

Prohibition of vessels carrying combustion engines

The voyage of vessels with combustion engines shall be prohibited on the water tanks and on the waterways or their sections listed in Annex 1 to this Regulation.

Range of surface water use for navigation

§ 3

(1) On surface waters on which the voyage of vessels with internal combustion engines is not prohibited pursuant to § 7 (5) of the Act or § 2 of this Decree, the voyage of such vessels shall be possible only at a dive corresponding to the displacement of the vessel at which the effect of hydrodynamic lift is negligible (displacement mode of navigation), but not more than 25 km / h. A cruise at a higher speed outside the discharge mode is only possible:

(a) in the surface water sections listed in Annex 2 to this Decree at a distance of more than 25 m from the shore, unless the navigational characteristics are otherwise specified;

(b) in the sections of surface water listed in Annex 3 to this Decree, at a distance of more than 25 m from the shore, unless specified otherwise, and where the ratio of engine power or engine power / displacement ratio of the vessel used is ≤ 60; the power / displacement ratio is calculated by dividing the maximum power or engine power P (kW) by the displacement of vessel D (m3 or tonne) corresponding to the maximum authorised load: r = P / D;

(c) on surface waters marked with the corresponding navigational characteristics referred to in paragraphs 2 and 3.

(2) Water skiing can only be operated on surface waters marked with corresponding navigational features located pursuant to § 28 of Act No. 114 / 1995 Coll., on inland navigation, under conditions of good visibility, between 8 and 12 and 14 and 19 hours and outside Sunday, public holidays and other holidays. (1a)

(3) Vessels intended for gliding under § 1a (c) and water scooters may only be operated:

(a) on surface waters which are not even partly located in the territory of the national park, protected landscape areas, national nature reserves, natural reserves, national natural monuments, natural monuments, natural parks, European sites or bird areas, 1b)

(b) on water tanks and watercourses on which no bathing surface water is present, (1c) or which are not immediately adjacent to such surface water;

(c) on surface waters not listed in Annex 4 to this Decree;

(d) on surface waters marked with the corresponding navigational characteristics according to special legislation, 1d)

(e) on surface waters on which access is ensured for vessels following reinforced access communication entering surface waters at a distance of not more than 1 km from the border referred to in (d);

(f) under good visibility;

(g) between 8 and 12 and 14 and 19 hours off Sunday, public holidays and other holidays.

(4) The direct navigation of vessels intended to sail in glide or water scooters from the reinforced access communication referred to in point (e) to surface water referred to in point (d) and back, in the discharge mode of the voyage and in direct connection with the operation of the voyage on surface water referred to in point (d) shall be authorised under this Decree. The power / displacement ratio shall be calculated according to the relation referred to in § 3 (1) (b) and the Frode number shall be calculated by dividing the maximum speed of the vessel V (m / s) by the square root of the product of the gravity constant (g = 9,81 m / s2) and the length of the main waterline L wl (m): Fn = V / (g.L wl) 1 / 2.

§ 4

(1) The water tanks listed in Annex 4 to this Decree are regulated by the scope of the use of surface water for the navigation of vessels with internal combustion engines, so that public water transport under Section 35 of Act No. 114 / 1995 Coll., on inland navigation is possible on those tanks and the navigation of vessels sailing by sailing and using the auxiliary marine combustion engine.

(2) Surface waters may not be used for navigation for the duration of the declared second and third stages of flood activity, unless otherwise provided for in specific legislation. 2) Vessels must be located in protected areas during this flood activity and must be secured in such a way that they are not released.

§ 5

Small vessels subject to registration (1) may stand outside the designated ballast and berth if the vessel is under permanent supervision but not more than 24 hours in total.

§ 6

The restriction under § 3 to 5 does not apply to:

(a) vessels of the State Navigational Administration, the Fire Department of the Czech Republic, the armed forces of the Czech Republic, the Police of the Czech Republic, the municipal police and watercourses managers, if used for service purposes,

(b) vessels of the components of the integrated rescue system when carrying out rescue and disposal operations;

(c) vessels used in connection with the construction, maintenance or operation of waterworks or other watercourses, vessels of persons carrying out obligations under the law or of vessels used to provide health services or to protect against flooding.

§ 7

Conditions for the use of surface water for navigation

Surface waters may be used to sail by a vessel with an internal combustion engine if:

(a) as fuel used unleaded petrol, diesel or gas, 3)

(b) to lubricate a two-stroke internal combustion engine, an oil marked by the manufacturer as non-environmentally damaging (biodegradable) oil.

§ 8

This decree shall take effect on the day of its publication.
