on the level of tolls, discounts on tolls and the level of remuneration for the provision of the European electronic tolls service
The Government orders pursuant to § 46 (1) of Act No. 13 / 1997 Coll., on Road, as amended by Act No. 102 / 2000 Coll., Act No. 80 / 2006 Coll., Act No. 152 / 2011 Coll. and Act No. 196 / 2012 Coll.:
Subject matter
This Regulation (1) incorporates the relevant European Union2 provisions and regulates the level of tolls, the amount of tolls rebate and the procedure for its application to road motor vehicles for the use of selected sections of the road and the method for determining the level of remuneration for the provision of the European electronic toll service.
Resolution and toll rates
(1) Toll rates are broken down by:
(a) infrastructure categories for user tariffs
1. motorway; or
2nd First Class Road,
(b) category of vehicle at rates for:
1. vehicles in an electronic toll system with the exception of vehicles of categories M2 and M3; or
2. vehicles of categories M2 and M3,
(c) EURO vehicle emission classes at vehicle rates
1. to EURO IV class;
Class 2 EURO V and EEV,
Class 3 EURO VI; or
4. using only electricity or hydrogen as fuel;
(d) the maximum authorised mass of the vehicle or combination for the rates for vehicles or vehicles of mass
1. more than 3,5 tonnes and less than 7,5 tonnes;
2. at least 7,5 tonnes and less than 12 tonnes, or
3. at least 12 tonnes,
(e) the number of axles of a vehicle or combination for the rates for vehicles or combinations of vehicles
1. with 2 axles,
2. with 3 axles,
3. with 4 axles, or
4. with 5 or more axles, and
(f) vehicle CO2 emission classes at vehicle rates
1. CO2 emission class 1,
2. CO2 emission class 2,
3. CO2 emission class 3,
4. CO2 emission class 4, or
5th CO2 emission class 5.
(2) Toll rates for use
(a) the motorways for vehicles in an electronic toll system with the exception of vehicles of categories M2 and M3 are listed in Annex 1 to this Regulation;
(b) the first-class roads for vehicles in an electronic toll system with the exception of vehicles of categories M2 and M3 are listed in Annex 2 to this Regulation;
(c) the motorways for vehicles of categories M2 and M3 are listed in Annex 3 to this Regulation; and
(d) Class I roads for vehicles of categories M2 and M3 are listed in Annex 4 to this Regulation.
Discount on toll
(1) The period of time applicable to the calculation of the reduction on parts of tolls imposed overall in order to achieve a return on the costs incurred for toll infrastructure (hereinafter "toll rebate") is fixed at the calendar year.
(2) If the total amount of the part of the toll imposed in order to achieve the recovery of the costs incurred for the toll infrastructure identified by the electronic toll system during the time period referred to in paragraph 1 for the vehicle in the electronic toll system has reached at least
a) 65 000 CZK, a discount of 6% is provided,
b) 95 000 CZK, a discount of 9% is provided,
c) 170 000 CZK, a discount of 11% is provided,
d) 270 000 CZK, a discount of 13% is provided.
(3) The amount of the part of the toll imposed pursuant to paragraph 2 shall not include tolls imposed prior to the date on which the data and documents relating to the vehicle are supplied in accordance with Paragraph 6 (2).
Procedure for applying the toll discount
(1) The vehicle operator shall provide the electronic toll system operator with the data and vehicle documents in the electronic toll system necessary for the calculation of the toll discount for the calendar year for which the discount is to be granted for the first time and shall notify the vehicle operator without undue delay of any changes to those data or documents.
(2) The data and documents relating to the vehicle in the electronic toll system are:
(a) details of the vehicle operator
1. the name and, where applicable, the name and surname, business name or name,
2. the date of birth or, if it is a legal person or an undertaking, its identification number;
3. the address of the residence or registered office; and
4. contact details for electronic service;
(b) the registration number of the vehicle, including the indication of the country where the vehicle is registered;
(c) a copy of the vehicle registration certificate or equivalent document issued by a Member State other than the European Union; and
(d) power of attorney when the vehicle operator is represented by a third party.
(3) Electronic toll system operator no later than 6 months after the end of each calendar year
(a) verify that, in the case of a vehicle in an electronic toll system for which the information referred to in paragraph 1 has been provided, a discount has been claimed in accordance with Article 5 (2);
(b) calculate the amount of the toll rebate for each vehicle; and
(c) invite the vehicle operator who has been entitled to a toll discount to provide details of the bank account for which an amount corresponding to the amount of the toll discount can be sent.
(4) The electronic toll system operator shall send an amount corresponding to the amount of the toll discount, rounded down to the whole crown, to the account referred to in paragraph 3 (b). (c) within 4 months of receipt of the bank account data.
Method of determining the remuneration for the provision of the European electronic toll service
(1) The remuneration for the provision of the European electronic toll service shall be fixed periodically over the calendar month period.
(2) The remuneration for the provision of the European electronic toll service is determined as a product of:
(a) the aggregate toll collected by the European Toll Provider pursuant to Article 22c (1) (g) of the Road Act during the calendar month for which the remuneration is fixed; and
(b) the remuneration coefficient of the European Toll Provider established for the calendar year covered by the calendar month for which the remuneration is fixed.
(3) The remuneration coefficient of the European Toll Provider is set as the product of:
(a) the cost-effectiveness of the electronic toll system; and
(b) the coefficient of similarity of services provided by the European Toll Provider.
(4) The cost return of the electronic toll system shall be determined as a proportion
(a) the average annual amount of actual and estimated payments by the operator of the electronic toll system paid by suppliers for its construction and operation during the period 1 December 2019 to 30 November 2029; and
(b) the estimated revenue from tolls stored during the calendar year in which the calendar month for which the remuneration is fixed falls.
(5) The coefficient of similarity of the services provided by the European Toll Provider is established as a proportion
(a) the amount of actual and estimated payments by the electronic toll system operator paid by suppliers of the electronic toll system for its construction and operation during the period from 1 December 2019 to 30 November 2029 relating only to types of comparable activities the performance of which is provided by both the European Toll Provider and the Electronic Toll System Provider, taking into account the scope of the services provided by them; and
(b) the amount of actual and estimated payments by the operator of the electronic toll system paid by suppliers for its construction and operation during the period 1 December 2019 to 30 November 2029.
Transitional provision
In the case of vehicles of categories EURO VI and EEV in an electronic toll system that has been equipped with registered electronic equipment before the date of entry into force of this Regulation, the toll rates under this Regulation shall apply only from the moment those vehicles are equipped with registered electronic equipment where the electronic toll system operator has entered the data necessary to distinguish the category of vehicles. Until this time, the toll rates of the vehicles according to the first sentence shall be those of Government Decree No. 484 / 2006 Coll., on the amount of time fees, toll rates, toll discounts and the procedure for applying the toll discount, as effective before the date of entry into force of this Regulation.
Repeal
The following shall be deleted:
1. Government Decree No. 484 / 2006 Coll., on the amount of time fees and the toll rates for use of designated roads.
2. Government Regulation No. 272 / 2007 Coll., amending Government Regulation No. 484 / 2006 Coll., on the amount of time charges and the toll rates for use of designated infrastructure.
3. Government Decree No. 404 / 2009 Coll., amending Government Decree No. 484 / 2006 Coll., on the amount of time charges and the toll rates for use of designated infrastructure, as amended by Government Decree No. 272 / 2007 Coll.
4. Government Decree No. 26 / 2010 Coll., amending Government Decree No. 484 / 2006 Coll., on the amount of time charges and the toll rates for use of designated infrastructure, as amended.
5. Government Decree No. 415 / 2010 Coll., amending Government Decree No. 484 / 2006 Coll., on the amount of time charges and the toll rates for use of designated infrastructure, as amended.
6. Government Decree No. 243 / 2011 Coll., amending Government Decree No. 484 / 2006 Coll., on the amount of time charges and the toll rates for use of designated infrastructure, as amended.

Efficacy
This Regulation shall take effect on 1 January 2015.
