Decree of the Ministry of Transport and Communications on registration and testing and operation of historical vehicles and sports vehicles

on the registration and testing and operation of historical vehicles and sports vehicles
The Ministry of Transport and Communications (hereinafter referred to as "the Ministry ') provides, pursuant to § 91 (1) of Act No. 56 / 2001 Coll., on the conditions of operation of vehicles on the road and amending Act No. 168 / 1999 Coll., on liability insurance for damage caused by the operation of a vehicle and on the amendment of certain related laws (Act on Insurance of Liability from the operation of a vehicle), as amended by Act No. 307 / 1999 Coll., as amended by Act No. 478 / 2001 Coll. (hereinafter referred to as" the Act'), for the implementation of Section 36 (3) of the Act:
§ 1
Subject matter
This decree regulates the manner and conditions of registration and testing and operation of historical vehicles and sports vehicles.
§ 2
Basic concepts
For the purposes of this decree:
(a) a document certifying that the vehicle complies with the technical conditions and requirements laid down by the International Federation of Historical Vehicles - Fédération Internationale des Véhicules Anciens (hereinafter referred to as the International Organisation of FIVA); 1) replaces the technical licence of the road motor vehicle and trailer;
(b) by the holder of a national authority in the field of historical vehicles, a legal person, (2) who is authorised by the international organisation FIVA to assess compliance with the requirements laid down by the technical regulations of that international organisation when holding meetings in the Czech Republic;
(c) by the holder of a national authority in the field of sports and historical vehicles, with the exception of motorcycles, a legal person, (3) which has been authorised by the International Automotive Federation - Fédération Internationale de ľAutomobile (FIA) to assess compliance with the requirements laid down by the technical regulations of this international organisation in the organisation of sports competitions of sports and historical vehicles in the Czech Republic,
(d) by the holder of a national authority in the field of sports and historical vehicles which are motorcycles, a legal person, (4) which has been granted authorisation by the International Motorcycle Federation - Fédération Internationale de Motocyclime (FIM) to assess compliance with the requirements laid down by the technical regulations of this international organisation when organising sports and historical competitions of sports and historical motorcycles in the Czech Republic.
§ 3
Testing of historical vehicles and sports vehicles
(1) The testing of historical vehicles and sports vehicles shall be carried out at the expense of the operator of such vehicles at the places and dates specified by the national authority holder, with the agreement of the Ministry, with the exception of sports vehicles referred to in paragraph 3.
(2) The testing shall be carried out through a regional testing committee designated by a legal person who is granted national authority by the international organisation FIVA. The Regional Testing Commission shall be at least five members and shall be represented by at least one member of the national organisation involved in international organisations for historical vehicles and shall have a membership base in the region. The President of the Regional Test Committee shall be appointed by the Ministry on a proposal from the national authority holder.
(3) The testing of sports-related vehicles shall be carried out by a legal person who is granted national authority by an international organisation FIA or FIM by means of regular annual testing in accordance with national sports regulations.
(4) Testing in the case of a historical vehicle or a sports-historic vehicle shall replace the technical inspection and shall be valid until 31 May of the following calendar year.
§ 4
Registration of a historical vehicle and a sports-historic vehicle
(1) A legal person who is granted the national authority of the International Organization of FIVA on the basis of testing of a historical vehicle or a sports-historical vehicle by the relevant regional testing committee shall issue a certificate of a historical vehicle certifying its authenticity.
(2) A historical vehicle or a sports-historic vehicle shall only be registered at the request of its operator, which shall accompany the application.
(a) identification of the historic vehicle;
(b) a valid certificate of carrying out testing of a historical vehicle or a sports-historic vehicle as indicated in the historical vehicle certificate;
(c) evidence of insurance against liability from the operation of an historic vehicle;
(d) proof of a residence permit or asylum in the Czech Republic, unless the operator of a historical vehicle or a sports-historic vehicle is a citizen of the Czech Republic.
(3) The operator of a historic vehicle or a sports-historic vehicle shall submit an application for registration of that vehicle (5) and the required documents to the Ministry. The Ministry shall issue a registration for a historical vehicle, assign a special registration mark for a historical vehicle (6) and issue a certificate of registration for a road motor vehicle and trailer. 7) The issue of a special registration mark for a historical vehicle shall be entered in the historical vehicle licence at the same time.
(4) Where an operator intends to operate more than one historical vehicle or a sports-historic vehicle under one special registration mark for a historic vehicle, it shall submit the application to the register together with the prescribed documents for all such vehicles. The Ministry shall issue a summary registration of all such vehicles. The Ministry shall assign to the applicant one special registration mark for a historic vehicle which it shall enter in all the licences submitted for such vehicles and issue a certificate of registration for such vehicles of a road motor vehicle and trailer.
(5) Where an operator intends to operate another historical vehicle or sports-historic vehicle and has already been assigned a special registration mark for existing historical vehicles, it shall submit to the application for the extension of the registration of another vehicle under that special registration mark the documents provided for in paragraph 2 for the registration of that additional vehicle.
§ 5
Operation of historical vehicles and sports vehicles
(1) A historical vehicle may only be operated on the road on the basis of a registration pursuant to Section 4 and with a valid test as indicated in the historical vehicle licence.
(2) When operating an historic road vehicle, its operator shall carry a certificate of the historical vehicle and a certificate of registration of the road motor vehicle and trailer.
(3) A sports-historic vehicle can only be used on the road on the basis of a permit issued by the Ministry in the framework of sports competitions for sports-historic vehicles organised by the national authority for the relevant category of sports-historical vehicles.
§ 6
Transitional provision
The certificates of historical vehicles issued before the entry into force of this decree, as well as the plates of the special registration plate - permanently handling, allocated to historical vehicles before that date, shall expire on 30 June 2003.
§ 7
Efficacy
This Decree shall take effect on 1 July 2002.
