GOVERNMENT REGULATION
of 20 December 2012
amending Government Decree No. 86 / 2011 Coll., on Technical Requirements for Toys
The Government orders pursuant to Article 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts, as amended by Act No. 205 / 2002 Coll. and Act No. 34 / 2011 Coll., ("the Act ') to implement § § 2 (d), § 11 (1), (2) and (9), § 11a (2), § 12 and 13 of the Act:
Government Regulation No. 86 / 2011 Coll., on Technical Requirements for Toys, is amended as follows:
1. footnote 1 shall read:
"(1) Directive 2009 / 48 / EC of the European Parliament and of the Council of 18 June 2009 on the safety of toys. Commission Directive 2012 / 7 / EU of 2 March 2012 amending, for the purposes of adapting to technical progress, Part III of Annex II to Directive 2009 / 48 / EC of the European Parliament and of the Council on the safety of toys. ';
2. In Article 17 (4), the words "toys for which the certificate has been rejected or cancelled in the past 'are replaced by" toys for which the certificate has been refused or toys for which the certificate has been revoked'.
3. In Paragraph 20, the following paragraph 5 is inserted after paragraph 4:
"(5) The Authorised Person and its persons carrying out or responsible for carrying out conformity assessment activities shall carry out such activities at the highest level of professional credibility and required technical competence in a specific field and shall not be subject to any incentives, influence or pressure, in particular financial ones, which may affect their judgement or the results of their conformity assessment, in particular by persons or groups of persons interested in the results of such activities."
Paragraphs 5 to 9 shall be renumbered paragraphs 6 to 10.
4. In Article 24 (1), the words "under this Regulation 'are deleted.
5. In Annex No 2, Part III, point 12, under the heading "cadmium ', in the second column, the number" 1,90' is replaced by "1,3 ', in the third column, the number" 0,5' is replaced by "0,3 'and in the fourth column, the number" 23' is replaced by "17 '.
6. In Annex No 2, Part V., point 2, the third sentence is replaced by the following: "The toy shall comply with the safety requirements after cleaning in accordance with this point and with the manufacturer's instructions."
7. In Annex 3, point 3, the dot is replaced by a colon at the end of the sentence.
8. In Annex 6, Part II, point 3.1, the words "required conformity marking referred to in the legislation 'are replaced by the words" CE marking pursuant to Section 13 of this Regulation'.
9. In Annex 7, point 8, first and second sentences, the word "surrender 'shall be inserted after the word" refused'.
Efficacy
This Regulation shall take effect on 20 July 2013.
