amending Act No. 155 / 1995 Coll., on Pension Insurance, as amended, and Act No. 582 / 1991 Coll., on the Organisation and Implementation of Social Security, as amended
Parliament has decided on this law of the Czech Republic:
Amendment to the Pension Insurance Act
Act No. 155 / 1995 Coll., on Pension Insurance, as amended by Act No. 134 / 1997 Coll., Act No. 289 / 1997 Coll., Act No. 224 / 1999 Coll., Act No. 18 / 2000 Coll., Act No. 118 / 2000 Coll., Act No. 132 / 2000 Coll., Act No. 220 / 2000 Coll., Act No. 116 / 2001 Coll., Act No. 188 / 2001 Coll., Act No. 353 / 2001 Coll., Act No. 168 / 2005 Coll., Act No. 198 / 2002 Coll., Act No. 85 / 2004 Coll., Act No. 261 / 2002 Coll., Act No. 362 / 2004 Coll., Act No. 362 / 2003 Coll., Act No. 424 / 2003 Coll., Act No. 425.
1. In Article 11, the sentence "For the period of insurance referred to in paragraph 1 (a), for persons referred to in Article 5 (1) (a) to (d) and (f) to (k) and (v), and in paragraph 2, the term" the duration of their legal relationship with a view to participation in insurance shall also be deemed to have elapsed for the persons referred to in Article 5 (1) (a) and (f) to (k) and (v), and in paragraph 2, the condition referred to in Article 8 shall also be deemed to have been met if the termination of that relationship had not otherwise been terminated; the condition of payment of the insurance shall be deemed to be met. '
2. In Article 16 (3), after the second sentence, the sentence "Reimbursement of a salary, salary or other income attributable to an actuarial basis under the special legislation17) or gross earnings due in the case referred to in the fifth sentence of Article 11 (2) in the calendar months for which it was due shall be included in the assessment basis. ';
3. In the first sentence of Article 16 (4), the words "and the periods referred to in (j) 'shall be inserted after the words" monthly earnings'.
4. In the second sentence of Article 16 (4), the words "in the third sentence of Article 16 (3) 'are replaced by the words" in the fourth sentence of paragraph 3'.
5. In Paragraph 16 (4), at the end of the dot, point (j) is replaced by the following:
"(j) for which, in the case referred to in the fifth sentence of Paragraph 11 (2), compensation for salary, salary or other income attributable to the assessment basis for the determination of premiums under the special legislature17 has not been granted by the court."
6. In Article 30 (1) (b), the words "or a partial invalidity pension shall not be paid to him for the reasons set out in Article 46 (1) (c) or Article 46 (2) 'are deleted.
7. Paragraph 42 (5) is deleted.
8. In Part Four, Title Three, Part Three, including the title and footnotes No 22 and 23, is deleted.
9. In the second sentence of Paragraph 55 (2), the words "during the procedure for declaring a person to be dead shall be inserted after the word" pension 'if the person concerned is entitled to a payment of a widow's, widower's or orphan's pension. "
10. In Paragraph 55, at the end of paragraph 2, the sentence "The period according to the first sentence shall also not apply for the period during which the proceedings for the annulment of the legal relationship establishing participation in insurance took place (Paragraph 11 (2), fifth sentence)."
11. in Paragraph 56 (1), the third sentence shall be replaced by a semicolon at the end of point (b) and the words "for the period to run shall apply mutatis mutandis."
12. Paragraph 56 (3) is deleted.
Paragraphs 4 and 5 shall be renumbered paragraphs 3 and 4.
13. In the first sentence of Paragraph 59 (1), the words "or 3 'are deleted.
14. Paragraph 59 (3) is deleted.
15. in Paragraph 76 (1), fifth sentence, "31 December 2005" is replaced by "31 December 2010."
16. § 80a and 80b are deleted.
Amendment of the Act on the organisation and implementation of social security
Act No. 582 / 1991 Coll., as amended by Act No. 590 / 1992 Coll., Act No. 37 / 1993 Coll., Act No. 160 / 1993 Coll., Act No. 238 / 2000 Coll., Act No. 93 / 1998 Coll., Act No. 140 / 1999 Coll., Act No. 133 / 1999 Coll., Act No. 155 / 2000 Coll., Act No. 159 / 2000 Coll., Act No. 220 / 2000 Coll., Act No. 238 / 2000 Coll.
1. Article 42 shall be deleted;
2. Paragraph 53 (3) is deleted.
Paragraph 4 shall become paragraph 3.
3. In Article 53 (3), the semicolon is replaced by a dot and the words "in the event of failure to fulfil the obligations referred to in paragraph 3, payment of a partial invalidity pension may always be stopped 'are deleted.
4. In Paragraph 90, the words "paragraphs 1, 2 and 4 'are deleted.
Transitional provisions
1. If the amount of the partial invalidity pension has been adjusted in accordance with Paragraph 46 (1) (b) of Act No. 155 / 1995 Coll., as in force on the date preceding the date of application of this Act, the amount of the partial invalidity pension shall be adjusted from the nearest instalment due after the effective date of that Act to the amount which would have been due if such adjustment had not taken place.
2. If the payment of the partial invalidity pension has been stopped pursuant to § 46 (1) (c) of Act No. 155 / 1995 Coll., as in force on the date preceding the date of its effectiveness, the payment of the partial invalidity pension shall be renewed from the nearest instalment due after the effective date of that Act at the amount specified in § 46 (1) (a) of Act No. 155 / 1995 Coll., as in force on the date preceding the effective date of that Act.
Efficacy
That law shall take effect on the first day of the calendar month following its publication.
