on popular control racing committees
The Government of the Czech Socialist Republic orders pursuant to § 14 paragraph 3 of the Act of the Czech National Council No. 116 / 1971 Coll., on Committees and Commissions of People's Control:
Establishment of folk control racing committees
(1) The People's Control Racing Commission (hereinafter referred to as "the Racing Commission") is established in enterprises, other organisations and establishments (hereinafter referred to as "organisations"), managed by the authorities of the Czech Socialist Republic, where optimal conditions are created for this, and after the approval of the Government of the Czech Socialist Republic.
(2) When selecting the organisations in which the race committee is to be set up, it shall be assessed in particular whether the setting-up of the race committee requires an economic or other social interest and whether both cadres and other conditions for its activities are appropriate.
(1) The proposal to establish a race committee is being prepared in cooperation with the competent authorities of the Communist Party of Czechoslovakia, the Revolutionary Trade Union Movement, the Socialist Youth Union and the Head of Organisation (hereinafter referred to as the "authorities referred to in Section 2 (1)").
(a) the Committee of People's Control of the District National Committee (the District National Committee in the Capital of Prague or the National Committee of the City of Brno, Ostrava and Pilsen), if it is an organisation managed or managed by that National Committee, a national committee of lower degrees, or an organisation of secondary management;
(b) the Committee of People's Control of the Regional National Committee (National Committee of the City of Prague), if it is an organisation managed or managed by that National Committee, or an organisation co-managed by the Committee of People's Inspections of the Czech Socialist Republic.
(c) The Committee of People's Control of the Czech Socialist Republic, when it comes to the organisations of the central management for which it has reserved it.
(2) In order to prepare a proposal for the establishment of a race committee in a centrally managed organisation referred to in paragraph 1 (a) and (b), the committee of popular control of the national committee within the area of which that organisation is located shall be responsible.
(3) Proposals for consent to the establishment of racing committees are submitted to the Government of the Czech Socialist Republic by the Committee of People's Control of the Czech Socialist Republic.
(1) When the Government of the Czech Socialist Republic has given its assent, the race committee shall set up a popular control committee referred to in Article 2 (1) (hereinafter referred to as the "competent committee of the people's control"), which shall also appoint a chairman, Vice-President and at least five other members of the race committee. The number of members shall be determined taking into account the size of the organisation and the complexity of the control tasks.
(2) The members of the race committee are selected from a collective of employees of the organisation or from pensioners who previously worked in the organisation. 1) Membership of the race committee shall be incompatible with the function of the head of the organisation and its representative, as well as with the function of the staff of the expert control unit of the organisation; A member of the race committee may also not be a member of an organisation that has concluded a material liability agreement for the values entrusted to it. 2)
(3) The competent committee of popular control shall, after consulting the authorities referred to in Article 2 (1), withdraw a member of the race committee if he fails to fulfil his duties properly or for other serious reasons.
(4) The appointment and withdrawal of members of the race committee shall be made public in the organisation.
(1) If the conditions for the operation of the race committee cease to exist, it shall be cancelled by the competent committee of popular control after consulting the authorities referred to in Article 2 (1).
(2) For the measure referred to in paragraph 1, the Committee of People's Control of the District or Regional National Committee shall seek the approval of the Committee of People's Control of the Czech Socialist Republic, which shall inform the Government of the Czech Socialist Republic of the cancellation of the race committee.
Activities of racing commissions
(1) The Racing Commission shall carry out an inspection of the economic activity and the performance of the tasks of the organisation in which it was set up. In doing so, it shall in particular:
(a) performance of the economic plan of the organisation, in particular the tasks set out in the State Plan for the Development of the National Economy of the Czech Socialist Republic;
(b) the efficiency of production, the promotion of rationalisation and cost-effectiveness of work, energy, materials and funds;
(c) compliance with the specified quality of the products or services provided by the organisation, where appropriate;
(d) the protection and use of assets owned by a socialist organisation;
(e) respect for labour discipline;
(f) the performance of the organisation's tasks in the labour care sector.
(2) The Racing Commission shall check how the relevant services of the organisation handle complaints, notifications and initiatives of citizens and organisations and whether they implement the necessary measures to remedy them. 3) The Racing Commission itself also accepts complaints and notifications which either advance to the organisation or directly examine them, if their seriousness so requires, or if there are other reasons. It shall keep its own records of the complaints and notifications received.
(1) The racing committee shall work according to the control plan. It is based on the needs of the organisation, on the thematic control tasks set out by the Committee of People's Control of the Czech Socialist Republic, as well as on the topics of control tasks applied by the relevant Committee of Human Control. It also makes use of comments and suggestions from workers and their organisations.
(2) The draft control plan will be discussed by the racing committee before it is adopted with the authorities referred to in Article 2 (1) and with the relevant committee of popular control.
(3) The Racing Commission shall inform the competent committee of the People's Inspection and Collective Workers of the Organisation of its activities at least once a year.
(1) The racing committee shall proceed in the performance of the inspection and in the evaluation of the facts established, independently of the management of the organisation. It shall ensure that its findings are objective and that corrective measures are effective.
(2) The race committee shall meet as necessary but at least once a month. It is able to act if an absolute majority of its members are present. The agreement of an absolute majority of the members of the committee present shall be required for the validity of the resolution.
(1) The competent Human Control Committee shall direct and provide methodological assistance to the race committee.
(2) The Racing Commission is responsible for its activities to the competent Committee of People's Control.
(1) The Racing Commission transfers its control knowledge to the Communist Party of Czechoslovakia for use in the exercise of the right of control.
(2) The racing committee cooperates with the relevant competition authorities of the Revolutionary Trade Union Movement and the Socialist Youth Union, uses their knowledge for their control activities and informs them of their findings as necessary.
The Racing Commission is providing mutual assistance. They shall cooperate, as appropriate, with the popular control committees, the other control authorities and the control services of the superior authorities.
Approval of racing commissions
(1) The Racing Commission and its mandated members are entitled to all the tasks required to carry out the inspection in the organisation, in particular may require:
(a) to allow them access to all the facilities and facilities of the organisation;
(b) that the documents, materials and documents required are submitted to them within the time limits and that they are provided with true and complete oral or written information on the facts or explanations as to the causes of the defects found.
(2) If the members of the race committee prove themselves by a special mandate, they must be presented with the required documents containing facts constituting professional, economic or state secrets. The specific mandate shall be issued by the competent committee of popular control.
(3) The Racing Commission shall be entitled to add to the participation in the inspection after consultation of the authorities referred to in Article 2 (1) to the staff of the organisation and the pensioners who previously worked in the organisation; In carrying out the inspection activities, the co-workers shall be authorised to belong to the members of the race committee, within the scope of the mandate of the race committee concerned.
(1) The Racing Commission is entitled to remedy
(a) to draw attention to the organisation's leaders to the shortcomings identified and to encourage them to be removed;
(b) require the management organisation to ensure, without delay, the removal of detected defects and their causes, unless this has been done following a warning under the previous provision and if it is suspected that an offence, offence or offence has been committed in order to notify the competent authorities,
(c) in the event of a breach of labour discipline or of damage to property in socialist property, initiate the management organisation or, where appropriate, of a superior body to draw the consequences of the relevant rules against guilty persons. 5)
(2) The authorisation referred to in paragraph 1 shall also be the responsibility of the chairman of the race committee and the authorisation referred to in paragraph 1 (a) to the authorised members of the race committee.
Furthermore, the Racing Commission shall be authorised to:
(a) participate in control actions carried out in the organisation as decided by its manager, as well as in periodic reviews of the management and evaluation of the economic performance of the organisation;
(b) require the head of the organisation to ensure that serious defects are investigated, beyond the possibilities of the race committee, and to inform the racing committee of the results and the measures taken;
(c) propose to the competent committee of popular controls the suspension of an illegal decision or an illegal activity and, if there is a risk of damage, an economic decision or an economic activity;
(d) request, where necessary, the support of the competent committee of the People's Control, or, after consultation with it, a superior authority or other competent State authority and propose to it that a deeper control be carried out within the organisation.
Common and final provisions
The organisation shall carry out administrative work on a timely and free-of-charge basis for the racing committee, create the necessary conditions for its action and also pay the necessary costs in kind for its activities. 6)
If the staff of the organisation fail to comply with the obligation imposed on them by § 11 of this Regulation and § 14 (1) and (2) or the obligation to report pursuant to § 14 (3) of Act No. 103 / 1971 Coll., on People's Control, the race committee may initiate the competent committee of People's Control to impose an order fine under § 15 of Act No. 103 / 1971 Coll., on People's Control.
This Regulation shall enter into force on the day of its publication.

1) The selection of the members of the race committee and their legal situation shall be governed in particular by the provisions of Sections 17, 19, 20 (1), 22 and 23 of Act No. 103 / 1971 Coll., on People's Control, and by the provisions of Sections 16 (3) and (4) of the ČNR Act No. 116 / 1971 Coll., on Committees and Human Control Committees.
2) Section 176 of the Labour Code.
3) Government Decree No 150 / 1958 of the Ú. l., on the handling of complaints, notices and incentives of workers.
4) The legal situation of the co-workers of the race committee is governed in particular by the provisions of Sections 18, 19 (1) and (3), 22 and 23 of the Act No. 103 / 1971 Coll., on People's Control, and by the provisions of Sections 16 (3) and (4) of the ČNR Act No. 116 / 1971 Coll., on Committees and Human Control Committees, and by the provisions of Section 124 of the Labour Code.
5) § 76 et seq. of the Labour Code and, where applicable, the relevant disciplinary orders, and § 185 et seq. of the Labour Code.
6) The obligations of the organisation, its officials and staff related to the control activities of the race committee are laid down in the provisions of Section 14 of Act No. 103 / 1971 Coll., on People's Control.
