Regulation of the Minister for Interior
of 7 March 1950
setting up an Advisory Council for Community Enterprises.
In agreement with the Minister of Finance, the Minister of the Interior hereby orders, pursuant to § 29 of Act No. 199 / 1948 Coll., on Municipal Enterprises:
Establishment of the Corps.
An Advisory Council for Municipal Enterprises (hereinafter referred to as "the Corps') shall be set up at the Ministry of the Interior.
The powers of the Corps.
(1) The College supports the work of the Ministry of Interior:
1. in the provision of advisory, accounting and review services in municipal matters,
2. providing assistance to national committees in the establishment of municipal enterprises, particularly in economically weak regions;
3. monitoring the development of municipal enterprises and facilitating experience.
(2) The College shall carry out its tasks under paragraph 1 in particular by providing and evaluating the basis for both theoretical and practical solutions to the issues of communal entrepreneurship and by carrying out specific work, such as investigations, surveys, etc., as directed by the Ministry of Interior.
(3) The competence of the College does not apply to professional supervision carried out by the competent central (regional) authorities established under the nationalisation rules, after similar supervision by the competent ministry in cases where such authorities have not been established under the nationalisation rules [Paragraph 15 of Act No 199 / 1948 Coll. and Sections 58 to 61 of Decree-Law No 10 / 1949 Coll., implementing the Act on Communal Enterprises and issuing their status (Statute of Municipal Enterprises)].
(4) The College presents its good views, ideas and proposals to the Ministry of the Interior. It also gives him copies of all the minutes of its meetings and reports on its activities.
Corps authorities.
(1) The College shall exercise its powers, both in plenary session and in its constituents:
(a) the President and Vice-President;
(b) regional committees, one for the Czech countries and one for Slovakia;
(c) the Commission.
(2) Concept and office work for the College is provided by the Ministry of the Interior.
The composition of the Corps.
(1) The College shall consist of the President, Vice-President, full members and advisory members. Each member shall have an alternate to represent him in the event of his or her absence. Advisory members shall not be entitled to vote.
(2) The President and Vice-President are appointed and removed by the Minister for the Interior.
(3) They shall be represented in the College by one representative, who shall be a full member:
1. the State Office of Planning, the Ministry of Interior, Finance, Information and Information, Industry, Agriculture, Internal Trade, Transport, Technology, Labour and Social Welfare and the Supreme Accounting Audit Office; the Slovak Planning Office, the delegation of the Interior, Finance, Information and Information, Industry and Trade, Agriculture, Transport, Technology, Labour and Social Welfare and Nutrition and the highest control court in Bratislava;
2. Investment Bank, National Enterprise, Zivnostenska Bank, National Enterprise, Central Council of Trade Unions and Central Council of Cooperatives; the Regional Institute of Investment Bank, National Enterprise in Bratislava, Slovak Tatrabana, National Enterprise, Slovak Trade Council and Slovak Council of Cooperatives;
3. regional national committees and central national committee of the capital of Prague.
A maximum of 10 persons active in public, political or economic life may be other full members.
(4) Proper members of the Corps representing the authorities (paragraph 3 (1)) are appointed and withdrawn by those authorities. The other full members of the Corps shall be appointed by the Minister of the Interior, acting on a proposal from the relevant institution, institution or national committee, if they are representing them. The Home Secretary also removes them. The provisions on the appointment and withdrawal of regular members of the Corps shall also apply to their alternates.
(5) The Advisory Members and their alternates are appointed and removed by the Minister of the Interior, two of the conceptual officials of the Ministry of the Interior and the delegation of the Interior.
Regional Committees.
(1) Each Regional Committee shall be composed of the President, its Deputy Director, six members of ordinary and two members of advisory. Each member shall have an alternate to represent him in the event of his or her absence. Advisory members shall not be entitled to vote.
(2) The Chairman of the Regional Committee for Czech Countries shall be the Chairman of the Corps; Vice-President of the Regional Committee for Slovakia. The chairmen of the Regional Committees shall each appoint a deputy from among the full members of the committee responsible.
(3) The Minister of Interior shall appoint the full members of the Regional Committees and their alternates from among the ordinary members of the Corps or their alternates on a proposal from the Plenary Session of the Board. The advisory members of the Regional Committees and their alternates shall be appointed by the Minister of Interior from among the Advisory Members of the Corps or their alternates. The Minister for the Interior shall also dismiss the members of the Regional Committees and their alternates.
(4) A member of the Regional Committee for Czech countries is present at the meeting of the Regional Committee for Slovakia and vice versa.
(5) The Chairman of the Regional Committee may invite other members of the College, representatives of the central offices, national committees, communal undertakings, national undertakings or central directorates of national undertakings to attend its meetings, if this is appropriate for the agenda.
(6) The two Regional Committees may be convened for joint meetings.
(7) The Regional Committee for Czech Countries usually meets in Prague, the Regional Committee for Slovakia usually meets in Bratislava.
The Commission.
(1) A commission of between three and five members may be set up for individual fields of communal business or to discuss certain groups of questions.
(2) The Commission shall elect a Regional Committee, the two Regional Committees at a joint meeting, including from outside the members of the College. At the same time, the President of the Commission shall be appointed, but he shall be a member of the Corps.
The scope of the plenary session.
The Plenary Session shall consist of:
(a) propose the full members of the Regional Committees;
(b) to discuss essential matters in the field of economic entrepreneurship of national committees and matters which it has reserved itself;
(c) to provide essential guidelines for the activities of the components of the Corps;
(d) discuss reports on the activities of regional committees and commissions;
(e) to take a decision on the Rules of Procedure of the College and its constituents.
The role of the President and Vice-President of the Corps.
(1) The President of the College shall convene, as appropriate or at the invitation of the Ministry of the Interior, a plenary session of the College or a joint meeting of the two Regional Committees, determine the agenda for their meetings, manage their meetings and sign the minutes of those meetings. It shall report to the Ministry of Interior at least once a year or at any time at its request on the activities of the Corps. It deals with the normal affairs of the Corps.
(2) The Vice-President of the College shall represent the President in his duties. Under the authority of the President of the Corps, he may perform one of his duties, in particular to deal with the normal affairs of the Corps in Slovakia.
The competence of the Regional Committees and their Presidents.
(1) It is for the Regional Committees to discuss all matters falling within the competence of the College, unless they are responsible to the plenary session or to the President under this Regulation. Regional committees shall address matters of regional importance. It is for the joint meeting of both regional committees to discuss matters of national importance.
(2) The Regional Committees may entrust certain matters to the Commission on a case-by-case basis.
(3) The Chairman of the Regional Committee shall convene, as appropriate or at the invitation of the Ministry of Interior, a meeting of the relevant Regional Committee, determine the agenda for the meeting, manage the meeting and sign the minutes of the meeting. It shall report to the plenary session and the Ministry of the Interior on the activities of the Regional Committee and the relevant commissions at least once a year or at any time at its call. It shall also deal with the normal affairs of the Regional Committee.
Commission competence.
The Commission shall discuss the matters entrusted to them by the relevant Regional Committee, after the case of the two Regional Committees in a joint meeting. They shall also carry out the work required by the Chairman of the Regional Committee.
Meetings of the Corps and its forces.
(1) The Plenary Session of the Corps and the Regional Committees are competent to act and to act if more than half of the full members (alternates) are present, counting the President (Vice-President). If this number is not reached at a specified hour, the meeting shall be held an hour later and shall be capable of acting and deciding if at least one fifth of the full members are present.
(2) The Commission may act and decide in the presence of at least one half of its members.
(3) The approval of an absolute majority of the voting members present shall be required for the validity of the resolution. The chairman shall vote. In the event of a tie, the proposal for which the President has voted shall be deemed to have been adopted.
Performing functions.
(1) The President and Vice-President of the College, if they are not public officials or officials, will promise to the hands of representatives of the Ministry of the Interior to exercise and maintain official, manufacturing and commercial secrecy their office conscientiously. The same shall be promised by members of the Corps, their alternates and members of commissions which are not public officials or officials, to the hands of the Chair (Vice-President) of the College.
(2) Members of the Corps, their alternates and members of the commissions are required to attend the meeting at the invitation.
(3) The functions of the President and Vice-President of the College, its members and its commissions are honorary. The final expenses of the members (alternates) shall be borne by the offices, institutes, institutions and national committees representing them. The final expenses of the President, the Vice-President and those members (alternates) appointed from among those active in public, political and economic life and members of the commissions shall be borne by the Ministry of the Interior.
(4) The Ministry of the Interior may, in agreement with the Ministry of Finance, award individual remuneration to members of the Corps (commissions) for special works which go beyond their normal scope.
Efficiency.
This Regulation shall enter into force on the day of its publication.
