on temporary jurisdiction in matters belonging to juridical and kmetsky courts.
The Provisional National Assembly of the Czechoslovak Republic decided on the following Act:
(1) It is up to 31 December 1946 to give the main trial of crimes and crimes ordered under the law in force to the juridical courts, the Court of First Instance.
(2) The main hearing shall be held before the College of four Judges, one of whom shall preside.
(1) The provisions of Title XVIII of the Code of Criminal Procedure of 23 May 1873, No 119 of the Code of Criminal Procedure and the provisions of Section 338, paragraphs 2 and 3 and of Section 339 of the Code of Criminal Procedure apply to the main proceedings and appeals against the judgments delivered therein.
(2) If the defendant does not enjoy the right to establish a lawyer, he should be set up under the jurisdiction of the defendant (§ 281, § 3 of the Code of Criminal Procedure) for the main trial of the lawyer by authority.
Until 31 December 1946, the main case for crimes and offences referred to in Article 1 of the Law of 30 May 1924, No 124 Coll., on the change of jurisdiction of criminal courts and the liability for the content of forms in the cases of perjury, deprivation and abuse of honour, as amended by Article 39 of the Law of 28 June 1933, No 108 Coll., on the protection of honour, the College of Three Judges without the participation of tribunals.
This Act takes effect on 1 January 1946 and applies in the Czech and Moravian-Silesian countries; to be carried out by the Minister for Justice.
