DECLARATION
of 18 October 2018
amending Decree No. 268 / 1999 of the Ministry of Defence Coll., which, for the purposes of the formalities, determines who is considered to be an executive flyer and which service is a service of a special nature or a special degree of danger, and the procedure for payment of the formalities, as amended
The Ministry of Defence provides pursuant to § 133 (2) and § 143 (12) of Act No. 221 / 1999 Coll., on professional soldiers, as amended by Act No. 272 / 2009 Coll.:
Decree of the Ministry of Defence No. 268 / 1999 Coll., which, for the purposes of the service requirements, determines who is considered to be an executive flyer and which service is a service of a special nature or a special degree of danger, and the procedure for payment of the service requirements, as amended by Decree No. 458 / 2002 Coll., Decree No. 335 / 2008 Coll., Decree No. 367 / 2008 Coll. and Decree No. 351 / 2014 Coll., is amended as follows:
1. Paragraph 2, including the title and footnote 1, reads as follows:
Service of a specific nature or degree of hazard
A service of a specific nature or degree of hazard shall be understood as a service of a soldier assigned to a post
(a) air traffic controllers;
(b) the Executive Paratrooper;
(c) pyrotechnics;
(d) a firefighter who carries out dangerous work;
(e) divers carrying out special underwater work;
(f) firefighters,
(g) related to the performance of explosives;
(h) carrying out activities at a special place of work in the underground;
i) established by the Defence Minister in Military Intelligence pursuant to the Act on Intelligence Services of the Czech Republic 1),
(j) involved in the exercise of the activities of a member of the Special Forces in the performance of the tasks of the Special Forces of the Army of the Czech Republic; or
(k) military police officers under the Military Police Act;
in the exercise of which the activities for which the soldier is subject to a special surcharge pursuant to Article 68c (1) of the Act continue to prevail, even if he does not receive it in order to qualify for another more favourable surcharge.

2. Article 3, including the title, reads:
Procedure for the payment of service charges
(1) The service allowance shall be paid by the 11th day of the calendar month for the current calendar month.
(2) Departure, severance and death shall be paid on a one-off basis by the 11th day of the calendar month following the calendar month in which the entitlement was established. "
Efficacy
This Decision shall enter into force on 1 November 2018.
