DECLARATION
of 28 July 2017
on technical requirements for constructions for the performance of forest functions
The Ministry of Agriculture provides pursuant to Section 194 (b) of Act No. 183 / 2006 Coll., on Territorial Planning and Construction Regulations (Construction Act), as amended by Act No. 350 / 2012 Coll.:
Subject matter
(1) This decree sets out the technical requirements for the performance of forest functions, such as forest road constructions, construction on other roads for forest transport1), construction of byline and rafters, and construction for the treatment of forest land water regime.
(2) The specified technical requirements apply regardless of whether the construction is located in the forest (2).
Definition of terms
(1) For the purposes of this decree, for the construction of forest roads and for the construction of other forest transport routes:
(a) through the forest, for the purpose of the transport accessibility of forests and their connection to roads, local or special purpose roads for the transport of timber, residues or wood chips and for the transport of persons, materials or machinery for forest management;
(b) by the spatial arrangement of the forest road, a set of design elements of the forest road, in particular the width of the crown of the forest road, radii of direction arches and longitudinal and transverse inclination of the forest road;
(c) technical equipment of the forest road road, drainage of the forest road, objects on the forest road, switches and defences, forest warehouses, connection of the forest road to roads, local or special purpose communication, connection of other routes for forest transport or neighbouring land to the forest road, road signs, detention or guide safety equipment;
(d) the forest route for the year-round operation of the forest route allowing for the year-round operation by its spatial layout and technical equipment;
(e) a forest route for seasonal operation of the forest route allowing for seasonal operation during periods with lower precipitation or frost periods by its spatial layout and technical equipment;
(f) other routes for forest transport, non-road routes, in particular road haulage and technology lines;
(g) by the road of the forest road, the strengthening of the forest road, which, by its width and load capacity, allows the operation of a set for the removal of timber; the forest road with the road is a reinforced forest road; the forest road without road is an unpaved forest road,
(h) a road with a rounded cover with a concrete, asphalt, paved, of stoneware assembled by a binding agent or a road of panels;
(i) by drainage of the forest path, a set of products, structures or landscapes for the non-harmful transfer and drainage of surface water from the forest road body and from the surrounding land and for their protection against the harmful effects of groundwater;
(j) the evasive extension of a single-striped road with a lane width allowing the safe avoidance of anti-driving vehicles or the circumvention of standing vehicles;
(k) seawater open through the seabed in the crown of the forest path;
l) by means of a pass, a building object with a vertical aperture of up to and including 2 m, used to transfer surface water flow across the forest road body,
(m) an economic pass through a building object with a perpendicular clearance of the hole up to and including 2 m, used to convert surface water flow under the connection of other forest transport routes or adjacent land into a forest road;
(n) in the forest warehouse, the area of the forest road, used for the treatment, storage or loading of wood, residues or wood chips and for the storage of forest management materials or techniques;
(o) a roll-over or field treatment for turning vehicles.
(2) For the purposes of this decree, the following definitions shall apply for the construction of the bystander and of the drains:
(a) by paying for byproducts and drains of buildings for the prevention or reduction of flood damage or accelerated erosion in the water catchment areas, in byproducts and in drains;
(b) a bright water flow with a small water catchment area, with sudden and significant changes in flow and steep flow waves which release and move flooding from the watercourse;
(c) tear down a natural terrain body, groove or pothole, created by an excessive concentration of erosion by the activity of concentrated surface water effluent.
(3) For the purposes of this decree, for structures for the treatment of forest land water regime:
(a) a construction for the treatment of the water regime of forest soils by a waterwork under another legislation (3), intended for the drainage of contaminated forest soils, the regulation of the water level of the ground water, the supply of irrigation water at a time of drought or the removal of water from flooded areas after flooding;
(b) the contamination of forest soils by excessive moisture of forest land not complying with natural habitat ratios and at the same time damaging forest crops or making it difficult to restore or establish forest areas caused by water coming from surface or groundwater or retained on forest land.
Requirements for forest road construction and construction on other forest transport routes
(1) The route of the forest path is proposed in such a way that, in particular:
(a) make the maximum area of the forest accessible by transport;
(b) meet the requirements of proper forest management and forest protection;
(c) as little as possible disturb the spatial layout and stability of forest areas; and
(d) ensure a uniform, smooth and safe ride at the design speed through mutual compliance between directional and height ratios.
(2) The forest road for year-round operation is always equipped with a road, efficient and technically efficient drainage of the forest road and is equipped with switches. Overcoming small watercourses on the forest road for year-round operation is not ensured by the fords.
(3) The forest route for seasonal operations is provided by the road in the case of insufficiently loading and dewatering ground, it is always equipped with effective and technically efficient drainage of the forest path and is equipped with switches.
(4) The maximum value of the longitudinal slope of the forest road in the case of construction of a new forest road with a design speed of 30 km / h is 12%, for design speed of 20 km / h 14%.
(5) The transverse slope of the road and the plains of the forest path is roof-shaped or one-sided. The minimum value of the transverse slope of the road and the forest road is 3,0% in the case of the construction of a new forest road or the change of the construction of an existing forest road on a reinforced forest road with a road with a tinted cover and 3,5% in other forest roads.
(6) The seams shall be inclined towards their axis in the forest roads with a longitudinal inclination of more than 6%, unless they are fitted with a ground with a rounded cover.
(7) The smallest vertical clearance of the pass in the forest road body is 510 mm. The minimum vertical clearance of an economic pass up to 8 m is 400 mm, otherwise 510 mm. The lowest longitudinal slope of both the pass and the economic pass is 0,5%.
(8) The connection of a forest road to a road or local communication shall be made by a wide exit at the point of connection of at least 6 m, a length of at least 25 m and a road equipped with a road. The connection of the forest road to the purpose communication shall be carried out by a high-speed downhill at the point of connection of at least 6 m, at least 25 m in length and with similar reinforcement as that provided by the subsequent purpose communication. The exemption from the AGL does not apply to the AGL.
(9) The switches are designed and set up in the number 1 to 2 switches per km of forest road in places with a good view of the next course of forest road.
(10) The switch shall be made at least 25 m long and shall have the same structure as the forest road. Intersections of forest roads, separate departures to other forest routes or adjacent land, forest warehouses or other extended places in the forest route shall also be used as a switch, provided that they comply with the technical requirements for exit.
(11) At the ends of impassable forest roads longer than 100 m, a display shall be designed and established, provided that it is not possible to use separate steps to other forest routes or adjacent land, forest warehouses or other extended areas to rotate the wooden transport combination. The panel is performed as a circular or reversing.
(12) Capture security devices shall not be required for forest roads except for a bridge, supporting wall and pass with a vertical front wall if the height of the crown of the adjacent forest road is above the terrain, the watercourse or the surface of the bridged infrastructure or obstacles greater than 2 m.
(13) For passes and economic passes on other forest transport routes, the provisions of paragraph 7 shall apply mutatis mutandis.
(14) The development of project documentation for forest road constructions and for construction on other forest transport routes shall be carried out in accordance with the standards contained in the relevant Czech technical standard (4), the compliance of which shall be considered to comply with the requirements of the relevant provisions of this Decree.
Requirements for construction of bystander and rafters
(1) The essential elements of the original route of the bristle or ravine shall be maintained as far as possible. The construction must not impede the use of neighbouring land and allow maintenance work on the landscaped areas as well as care for non-covered areas.
(2) If water significantly or permanently blends or deepens the riverbed of bristles or rafts, their resistance increases
(a) by reducing the longitudinal gradient of the bottom and stabilising it by means of transverse construction structures, in particular passports, thresholds, steps, slides or players;
(b) fortifications, in particular the bottom or the stalk of slopes; or
(c) by adjusting the dimensions of the buoyancy bed or ravine to reduce its load.
(3) The design flow corresponds to its periodic design level of protection, which depends on the value of the area protected from flooding. It is always considered where and why the most historically documented flood level was reached.
(4) The closed flow profile shall be designed and implemented only in justified cases. Pressure flow through closed flow profile is not permitted; at least 500 mm high clearance is required above the design flow level Q100. The flow into the closed flow profile shall be designed and carried out with appropriate protective measures against the inclusion of the closed flow profile by drains and repayments. The closed flow profile shall be designed and implemented so that it can be cleaned.
(5) The pipe and cable lines are placed in the housing at the point of interbreeding with unprepared buoys and placed at least 1 400 mm below the surface of the bridle bed. If, at the point of crossing with an unprepared bridgehole, a groove is drawn for the pipe or cable line, it shall be filled with powder and, after compaction at the bottom and in the slopes of the bridgeboard, shall be fitted with fortifications.
(6) The masts of electrical power overhead lines and communication overhead lines shall be located at a distance of at least 6 m from the shore line of the bust.
(7) The processing of project documentation for the construction of bystander and rafters shall be carried out in accordance with the standards contained in the relevant Czech technical standard (5), the compliance of which shall be considered to comply with the requirements of the relevant provisions of this decree.
Construction requirements for the adaptation of forest land water regime
(1) For each construction for the treatment of the water regime of forest soils shall be evaluated
(a) local terrain conditions, in particular the slope of the territory;
(b) the pedological nature of forest land;
(c) the causes of adverse forest water regime;
(d) the state of performance of forest functions, in particular damage to forest areas;
(e) the degree of forest management limitations, in particular restoration, protection and rearing of forest areas; and
(f) the economic efficiency of such construction and subsequent maintenance.
(2) The routes of draining and irrigation ditches shall be conducted according to local terrain conditions, in particular the slope of the territory, and taking into account the distribution of forest areas, in particular their stability to rife winds.
(3) The draining and irrigation ditches are designed and carried out with a depth of at least 600 mm and a gauge of at least 30 m, unless otherwise specified by calculation. In doing so, account shall be taken of the seed requirements of forest trees and of the species and age composition of forest crops.
(4) The draining ditches shall be designed and carried out with a longitudinal inclination such as to avoid reaching the deflection rate of water.
(5) The sprinklers shall be designed and implemented according to the position and intensity of the irrigation water source.
(6) The pipe and cable lines are placed in the housing at the point of crossing with the draining and irrigation moats and placed at least 700 mm below the surface of the bottom of the moat in the case of pipe lines and communication cables or at least 1000 mm below the surface of the moat in the case of power electric cables. If, at the point of crossing with the draining or irrigation moat, the groove is deep for the pipe or cable line, it shall be filled with powder and, when it is compacted at the bottom and in the slopes of the moat, be fitted with fortifications.
The Ministry of Agriculture will allow free access to the text of the Czech technical standards mentioned in this decree.
Exemptions from the technical requirements for forest performance structures
Under the conditions laid down in § 169 of the Building Act, an exemption from the provisions of § 3 (4), (9) and (11), from § 4 (5) and (6) and from § 5 (6) may be granted where justified.
Transitional provision
According to this decree, the construction works for which the documentation or project documentation was processed and submitted to the construction office at the earliest on the date of entry into force of this decree.
Repeal
Decree of the Ministry of Agriculture No. 433 / 2001 Coll., laying down technical requirements for constructions for the performance of forest functions, is repealed.
Efficacy
This Decision shall enter into force on 1 January 2018.
