DECLARATION
of 16 May 2006
amending Decree No. 197 / 2004 Coll., implementing Act No. 99 / 2004 Coll., on the Pond, the exercise of fishing law, the Fisheries Guard, the Conservation of Marine Fishery Resources and amending certain laws (Fisheries Act)
The Ministry of Agriculture provides, pursuant to Section 32 of Act No. 99 / 2004 Coll., on Pond, the exercise of fishing law, the fishing guard, the conservation of marine fishery resources and the amendment of certain laws (Law on Fisheries):
Decree No. 197 / 2004 Coll., implementing Act No. 99 / 2004 Coll., on the Pond, the exercise of fishing law, the fisheries guard, the conservation of marine fisheries resources and the amendment of certain laws (Fisheries Act) is amended as follows:
1. In Paragraph 3 (1), the words "and lipan 'are deleted.
2. in Article 3, the following paragraph 2 is inserted after paragraph 1:
"(2) For the purposes of this decree, the fish of the salmon shall also be considered to be limestone (Thymallus thymallus). '
Paragraphs 2 and 3 shall become paragraphs 3 and 4.
3. In Article 3 (3), the words "they were made up of obstacles or technical equipment which make it impossible or restrict the natural migration of fish 'are replaced by the words" they were visible in the field (for example, structures, technical installations, natural formations or other objects)'.
4. in Article 4 (2) (a), the word "accurate" shall be deleted;
5. In Article 7, the sentence "Where users of fishing areas are evaluated for the common validity of issued allowances or where a person is a user of more than one fishing area, the maximum number of annual allowances issued with a common validity on several areas may be added. 'is added at the end of paragraph 3.
6. In Article 7, the following paragraph 4 is inserted after paragraph 3:
"(4) The issue of year-round allowances may be replaced in full or in part by the issue of short-term allowances by the conversion referred to in Annex 3a. ';
Paragraph 4 shall become paragraph 5.
7. In Article 10 (4), the words "is a fishing operator, a representative of a fishing operator or a fishing guard or 'shall be inserted after the words" which'.
8. Paragraph 10 (5) and paragraphs 8 and 9 are deleted.
Paragraphs 6 and 7 shall become paragraphs 5 and 6.
9. In Paragraph 10 (5), the words "Second and Others' are replaced by" Next ', the words "may be issued' are replaced by the words" to be issued 'and the words "earlier' are replaced by the words" previously issued '.
10.Paragraph 10 (6) reads as follows:
"(6) A fishing ticket shall be issued to a stranger if proven to be
(a) previously issued by a fishing pass;
(b) another document certifying that he had already held a fishing ticket,
(c) a certificate of qualification as referred to in paragraph 3; or
(d) a fishing licence, licence or similar document issued in the State of which he is a citizen. "
11. in Article 11 (2) (m) and (3) (j), the word 'Oncorhyncus' is replaced by 'Oncorhynchus';
12. Article 12, including the title and footnote 4, reads:
Daily fishing times in the calendar year in the fishing zone
[Paragraph 13 (11) (d) of the Law]
(1) The daily fishing times for trout fisheries are:
(a) in January and February from 7 a.m. to 5 p.m.
(b) in March from 6 am to 18 pm,
(c) in April from 6 am to 20 pm,
(d) in May from 6 am to 21 pm,
(e) in June and July from 5 am to 22 pm,
(f) in August from 6 am to 22 pm,
(g) in the month of September from 7 am to 20 pm,
(h) in October from 7 am to 19 pm,
(i) in the months of November and December from 7 am to 17 pm.
(2) The daily fishing periods for fish in the non-trout fishing zone are:
(a) in January, February, November and December from 7 a.m. to 18 p.m.
(b) in March from 5 a.m. to 21 p.m.
(c) in April, September and October from 6 a.m. to 22 p.m.
(d) in May, June, July and August, from 4 to 24 hours.
(3) The daily fishing periods provided for in paragraph 1 (a), (b) and (i) and in paragraph 2 (a) and (b) are given in the Central European Time, the daily fishing periods provided for in paragraph 1 (c) to (h) and in paragraph 2 (c) and (d) are given in the summer time (4).
4) Act No. 54 / 1946 Coll., on Summer Time. '.
13. in Article 13 (2) (a) (3), "(Barbus meridionalis-petennyi)" is replaced by "(Barbus petenyi)."
14. in Paragraph 13 (3):
"(3) From 1 January to 15 June, they shall be defended in the non-trout fishing zone:
(a) sprat (Aspius aspus),
(b) candola (Stizostedion lucioperca),
(c) catfish (Silurus glanis),
(d) pike (Esox lucius). '
15. Paragraph 14 (3) reads:
"(3) The authorised fishing methods, the authorised technical means of fishing and their use in the fishing zone are set out in Annex 7."
16. In Paragraph 14 (4), the first sentence is deleted and in the third sentence, the word "boats' is replaced by" vessels'.
17. in Paragraph 16 (1):
"(1) In a non-trout fishing area, the following is permitted:
(a) hunting on a set or on a swim;
(b) fishing for sea or deep water during the period from 16 June to 31 December;
(c) fly-fishing or fly-fishing; or
(d) bonnet fishing between 16 June and 31 December. "
18. In Article 16, paragraphs 2 to 4 are deleted.
Paragraphs 5 to 7 shall be renumbered paragraphs 2 to 4.
19. in Article 16 (3), the words "and lipan" shall be deleted, the words "in paragraph 5" shall be replaced by "in paragraph 2" and the words "and lipan or their combination" shall be deleted;
20. In the second sentence of Article 16 (4), "paragraphs 5 and 6 'are replaced by" paragraphs 2 and 3'.
21. In Article 17 (1), the words "salmon and lipan fish" shall be deleted in the introductory phrase.
22. in Article 17 (1) (c):
"(c) in the case of fishing for fish other than salmonids, hunting on a set-up or on a swim shall also be permitted only on plant-origin."
23. In Article 17, paragraphs 2 and 3 and paragraphs 5 to 7 are deleted.
Paragraph 4 shall become paragraph 2 and paragraphs 8 to 10 shall become paragraphs 3 to 5.
24. in Paragraph 17 (2):
"(2) In the event that a pike, fat, bass, catfish, bola or candate is caught on a trout fishery, this fish shall not return to the trout fishery. '
25. In Paragraph 17 (3), the words "and lipan or their combination" shall be deleted.
26. in Article 17 (5), "paragraphs 8 and 9" shall be replaced by "paragraphs 3 and 4";
27. The following Annex 3a is inserted after Annex 3:

28. Annex 7 reads as follows:
"Annex No 7 to Decree No 197 / 2004 Coll.
Authorised fishing methods, authorised technical means of fishing and their use in fishing in the fishing zone.
I. Allowed ways of fishing for fish on a hook
A. Hunting on laid, swimming.
1. Hunting on a set, swimming in fishing areas outside the trout
No more than 2 lines shall be used for hunting on a set or on a swimmin. When hunting on a set, the movement of the trap is not actively influenced by the person conducting the hunt. When fishing for swimming, the person carrying out the hunt may actively influence the movement of traps. There are no more than 2 straight hooks on each hook or 1 double hook or triple hook. Multi-crochet systems with a maximum of 3 hooks (one, two or three hooks) may also be used for hunting on animal bait. The bait shall only be used between 16 June and 31 December. Salmonidae, eel, protected species and fish below the smallest fishing rate shall not be used as bait fish. When fishing, the fishing crew shall maintain a distance between them of at least 3 m, unless they agree to a smaller one.
2. Hunting on a set, swimming in trout fishing areas
No more than 2 lines shall be used for hunting on a set or on a swimmin. When hunting on a set, the movement of the trap is not actively influenced by the person conducting the hunt. When fishing for swimming, the person carrying out the hunt may actively influence the movement of traps. There are no more than 2 hooks on each hook. Only plants of plant origin shall be used for hunting. When fishing, the fishing crew shall maintain a distance between them of at least 3 m, unless they agree to a smaller one.
B. Trawling.
1.A. Trawling in off-trout fishing areas
1 line held in the hand in the course of the fishing shall be used in the course of the fishing; another line is not set. The hunt consists of actively leading the pitfalls through the aquatic environment. One artificial or natural trap shall be used for the trap. It has a maximum of 3 hooks (one, two or three hooks) according to its design. An artificial fly hunt shall also be considered as a catch if the trap is equipped with accessories to increase irritability for fish, such as a rotating diaper or propeller. In the course of fishing, the fishing crew shall maintain a distance between them of at least 20 m, unless they agree to a smaller one.
1.B. Deep-sea fishing in off-trout fishing zones
Deep-sea trawl shall be fished from a moving vessel using a 1-way line in which 1 trap is drawn at any depth of water; another line is not set. One artificial or natural trap shall be used for the trap. It has a maximum of 3 hooks (one, two or three hooks) according to its design. When hunting, care shall be taken to avoid endangering the health, life or property of other persons.
2. Trawling in trout fishing areas
1 line held in the hand in the course of the fishing shall be used in the course of the fishing; another line is not set. The hunt consists of actively leading the pitfalls through the aquatic environment. One artificial trap shall be fitted with a maximum of 1 hook (one, two or three hooks). An artificial fly fishing with accessories to increase irritability for fish, such as a rotating diaper or propeller, shall be considered as a catch. In the course of fishing, the fishing crew shall maintain a distance between them of at least 20 m, unless they agree to a smaller one.
C. Artificial aim hunt.
1. Artificial fly fishing in fishing areas outside trout and trout
When fishing for artificial fly, use shall be made of 1 line which is held in the hand when fishing; another line is not set. There are no more than 3 hooks on the hook. The trap shall be thrown on by means of a fly rope or line, where the carrying function is provided by a ball or other float or other load. An artificial fly is considered to be a trap imitating insects or other organisms. The bait is not equipped with accessories that increase irritability for fish, such as a rotating diaper or propeller. In the course of fishing, the fishing crew shall maintain a distance between them of at least 20 m, unless they agree to a smaller one.
D. Fly fishing.
1. Fishing by fly fishing in fishing areas outside the trout
In the case of fly fishing, 1 line shall be used which is held in the hand of the catch; another line is not set. There are no more than 2 straight hooks or 1 double hook or triple hook. The trap shall be thrown on by means of a fly rope or line, where the carrying function is provided by a ball or other float or other load. Live or dead insects are also used for the ambush. The bait is not equipped with accessories that increase irritability for fish, such as a rotating diaper or propeller. In the course of fishing, the fishing crew shall maintain a distance between them of at least 20 m, unless they agree to a smaller one.
E. Chirping hunting.
1. Fishing in fishing areas outside trout
In the case of jawline fishing, 1 horizontal net shall be used, the area of which does not exceed 1 m2. Chirping fishing shall not be combined with fishing according to points A, B, C or D. In hunting, the fishing crew shall maintain a distance of at least 3 m between each other unless they agree to a smaller one.
II. Authorised technical means of fishing
1. A line consisting of a rod, usually a reel, a string or a line and a hook or an artificial trap, or other accessories.
2. Lime lamps, vessels, floating inflatable fishing gear intended for fishing for fish, echolot, treadmill, larch, tank, hook remover, scale, stands or holders, chips, flaps, loads, spatters and other means. The use of these means shall be specified by the user of the area under closer conditions of exercise of the fishing right. ';
29. In Annex No 12, the table "Clothing components of the professional uniform of staff of the public administration of fisheries' is replaced by the following table:

Efficacy
This Decree shall take effect on 1 July 2006, with the exception of Article I (1), (2), (12), (14), (15), (17) to (26) and (28), which shall take effect on 1 January 2007.
