on the conduct of tests under the Weapons and Ammo Act
The Government orders pursuant to § 32, § 33 paragraph 5 and § 34 paragraph 7 of Act No. 90 / 2024 Coll., on weapons and ammunition:

INTRODUCTORY PROVISIONS
§ 1
Subject matter
This Regulation provides for
(a) the rules for the designation of test Commissioners for proficiency tests and comic trials;
(b) the level of remuneration of the Examination Commissioner for carrying out the proficiency test and for taking part in the Comic Test Committee;
(c) the highest possible level and the content of the operator's applicable costs recorded in the test range for which a comic test is held;
(d) the manner and extent of the demonstration of knowledge in the theoretical part of the proficiency test and the comitology examination;
(e) the scope and manner of demonstrating knowledge, competences and skills in the field of safe arms and ammunition management procedures in the practical part of the proficiency test and the comic test;
(f) the scope and method of carrying out target shooting in the practical part of the proficiency test and the comic test;
(g) the types and types of weapons which may be used in the practical part of the proficiency test and the comic test;
(h) the organisational and test rules for the proficiency test and the comma tests;
(i) the scope and method of demonstrating knowledge, competence and skills in the theoretical part of the examination of the examiner;
(j) the scope and manner of demonstrating knowledge, competences and skills in the areas covered by the Examination Commissioner's activities in the practical part of the examination of the Examination Commissioner;
(k) the types and types of weapons that may be used in the practical part of the examination of the examiner;
(l) the organisational and test rules for the examination of the Examination Commissioner;
(m) technical requirements and equipment requirements for the recorded test range;
(n) a record of the results of the proficiency test and of the comitology examination (the form); and
(o) an overview of the basic procedures for demonstrating knowledge of the safe management of arms and ammunition.

RULES FOR DETERMINING TEST COMPETITIVENESS TESTS AND COMISON TESTS AND DETERMINING THE AMOUNTS OF DEPARTMENTS AND APPLICABLE COSTS
§ 2
Designation of test Commissioners for proficiency tests
(1) The Regional Directorate of the Police of the Czech Republic (hereinafter referred to as the Regional Directorate of the Police) shall, as a general rule, designate the Examination Commissioner 10 working days before the date of the proficiency test. In designating the Examination Commissioner, the Regional Directorate of the Police shall proceed in the order of the list of Examination Commissioners, which shall be kept within its territorial competence; based on the entry in the Central Weapons Register. For the purposes of the next possible designation, the examination commissioner who conducted the proficiency test shall be placed at the end of the list of test Commissioners.
(2) If the probationary commissioner refuses to pass the proficiency test, the Regional Directorate of Police will refer the rejection to the file and will designate the new examiner in the order of the examination commissioner. The examination commissioner who refuses the designation for the proficiency test shall be placed at the end of the list of test Commissioners as well as the examiner who conducted the proficiency test.
(3) If the Examination Commissioner is unable to take part in the examination, he shall notify the Regional Police Directorate without undue delay, which shall refer it to the file and designate the new Examination Commissioner in the order in the list of test Commissioners. For the purposes of the next possible designation, a test commissioner who is unable to take part in a proficiency test shall not be included at the end of the list of test Commissioners.
§ 3
Designation of test commissioners for comic trials
For the purpose of participating in the Comic Test Committee, the Examination Commissioner shall designate an examination commissioner from the list of professional persons authorised to perform the Comic Test Police Presidium of the Czech Republic ("Police Presidium '); Paragraph 2 shall apply mutatis mutandis.
§ 4
Remuneration of the Examination Commissioner for carrying out the proficiency test and for attending the Examination Committee
(1) The Examination Commissioner shall be remunerated by the Examination Commissioner for carrying out the proficiency test and for attending the Comic Test Committee, which shall include:
a) a flat-rate reward of CZK 3,500 for participating in such a test,
(b) a remuneration of CZK 350 for each applicant for the issue of an arms licence participating in the theoretical part of such a test; and
(c) a reward of CZK 350 for each applicant for the issue of an arms licence who is participating in the practical part of such an examination.
(2) Where the probationary commissioner is a payer of value added tax, he shall notify the Regional Directorate of the Police or the Interim Presidium before carrying out the proficiency test or the comitology examination for which he was designated. In such cases, the remuneration of the examiner shall be increased by value added tax.
(3) The remuneration of the Examination Commissioner shall be paid by the Regional Police Directorate or the Police Presidium designated by the Examination Commissioner for the proficiency test or the Comprehensive Examination, within 1 month of the date of its implementation, if the Regional Police Directorate or the Interim Presidium is aware of the information necessary for the execution of the payment, or within 1 month of the date of receipt of the Communication from the Examination Commissioner on the information necessary for the execution of the payment.
Applicable costs of operator registered test range
§ 5
The applicable costs incurred by the operator of the recorded test range at which the comic test is held are the actual costs incurred by the operator of the recorded test range.
(a) rental of the training room;
(b) rental of firearms;
(c) lending of protective equipment;
(d) rental of short ball and long ball weapons;
(e) the targets used; and
(f) spent ammunition.
§ 6
(1) The applicable costs of the operator registered with the shooting range shall be borne by the prices in force at the time of the comic test published by the operator registered with the shooting range, subject to the maximum set out in paragraph 2.
(2) The price charged for transactions related to the performance of the comitology test must not be higher than the normally charged prices for similar transactions provided by the operator of the recorded test range to ordinary customers.
(3) Price averages over the last 3 months shall be considered as commonly charged prices. The price charged for the performance related to the performance of the comitology test may be increased to the level of the increased price list, but not more than 15% of the prices normally charged, if there has been a continuous increase in the operator's price list during the last 3 months.
§ 7
(1) The entitlement to meet the applicable costs of the operator registered with the shooting range applies to the Police Presidium.
(2) In the requirement to meet applicable costs, the operator registered with the test shooting range shall indicate, in addition to the data identifying the natural or legal person, the address of the place of business or the registered office, or, where applicable, the address for delivery and signature, the designation of the comic test with which the applicable costs are associated, the type and amount of the applicable costs, the number of units, the unit price, the total amount of the applicable costs and the bank connection.

TEST OF COMPETITION
§ 8
Instructions and commands of the Examination Commissioner
The Examination Commissioner shall direct the course of the proficiency test and give instructions and commands to the applicants for the issue of the arms authorisation, which shall be clear, understandable and not contrary to the principles of safe handling of weapons and ammunition and the operating rules of the shooting range.
§ 9
Pre-competence test procedure
(1) Before starting the proficiency test, the probationary commissioner shall inform the applicant of the issue of the firearms authorisation in general with its conduct and, to the extent necessary, with the operating rules of the shooting range.
(2) The Examination Commissioner shall instruct the applicant to issue an armaments authorisation for the prohibition of use, during the proficiency test, of any unauthorised equipment which might adversely affect its regularity, without permission to leave the place of the proficiency test or interfere with its proper conduct. In the case of gross or repeated infringement of the rules set out in the sentence, the first examiner shall immediately terminate the proficiency test and the applicant for the issue of an armaments authorisation shall be assessed as "not proficient '.
(3) The applicant for the issue of an armaments licence may apply for the possibility of using a medical device in the proficiency test at the latest before it begins. The need to use a medical device shall be documented by the applicant for the issue of an armaments authorisation. The examiner shall not allow the use of a medical device if its use could adversely affect the regularity of the proficiency test or the operating rules of the shooting range prevent it.
§ 10
Writing in the form
For the entry in the form set out in Annex 1 to this Regulation, the probationary commissioner and the applicant for the issue of an armaments authorisation shall use typewriters ensuring an indelible record.
§ 11
Identification and status of the applicant for the issue of an arms licence
(1) Prior to the start of the proficiency test, the probationary commissioner shall verify the identity of the applicant for the issue of the armaments authorisation, in particular by checking the list of applicants for the issue of the armaments licence applied for for the proficiency test to be transmitted to him by the Regional Police Directorate and by submitting an identity document. If the applicant for the issue of an armaments licence does not demonstrate his identity in a reliable manner, even for the possible synergies of the Regional Police Directorate, the probationary commissioner will not allow him to carry out the proficiency test, the applicant for the issue of an armaments licence does not come forward for the date of the proficiency test and may reapply.
(2) In particular, the Examination Commissioner will verify whether the applicant for an armaments authorisation does not prevent the proper performance of the proficiency test in his medical condition or other circumstances which could adversely affect his ability to perform the test. If circumstances are found that could adversely affect the safety of carrying out the proficiency test, the probationary commissioner shall not allow the applicant for the issue of an armaments licence, the applicant for the issue of an armaments licence shall not come forward and may reapply.
Theoretical part of the proficiency test
§ 12
(1) Before commencing the theoretical part of the proficiency test, the probationary commissioner shall inform the applicant of the issue of the armaments authorisation with its conduct and the manner in which the correct answers and corrections are to be identified.
(2) The theoretical part of the proficiency test takes the form of a written test which is carried out in the form of a selection of 1 correct response from 3 possible answers for each test question. The written test is passed
(a) 17 of the test questions relating to knowledge of arms and ammunition law, the verification of firearms and ammunition and the criminal aspects of arms and ammunition;
(b) of 5 test questions from knowledge of weapons and ammunition teaching;
(c) of 5 test questions from knowledge of the principles of safe arms and ammunition management; and
(d) three test questions from knowledge of the medical minimum.
(3) The Examination Commissioner shall call upon the applicant to issue an armaments permit to select a random test file in such a way that the applicant to issue an arms licence does not know its number in advance. The number of the selected test file shall be entered by the applicant for the issue of an armaments authorisation in the appropriate box on the form.
(4) The test files referred to in paragraph 3 shall be forwarded to the on-the-spot examination commissioner by the Regional Police Directorate. On completion of the theoretical part of the proficiency test, the probationary commissioner shall return the test files to the Regional Police Directorate, which shall check their completeness.
(5) The time limit for answering test questions shall begin to run at the same time for all applicants for the issue of arms authorisation; the start is determined and the instruction to start writing the answers is given by the examiner.
(6) The examination commissioner shall determine the place and time for the familiarisation of the applicant for the issue of an armaments licence with the result of the theoretical part of the proficiency test.
(7) The applicant for the issue of an arms licence writes the answers in the assessment table in the form. The answers indicated otherwise shall not be taken into account.
(8) The Examination Commissioner shall supervise the course of the theoretical part of the proficiency test. In the case of gross or repeated non-compliance with the rules laid down for the theoretical part of the proficiency test, the examiner shall immediately terminate the proficiency test and the applicant for the issue of the armaments authorisation shall be assessed as "non-profit '.
§ 13
(1) The applicant for the issue of an armaments authorisation shall submit the form together with the test file to the Examination Commissioner after having written down the replies. No adjustments may be made to the responses recorded in the form after the form has been submitted.
(2) Following the surrender of the forms to all applicants for the issue of an armaments licence but no later than after the time limit, the probationary commissioner shall terminate the theoretical part of the proficiency test.
§ 14
Evaluation of the theoretical part of the proficiency test
(1) Immediately after evaluation of the answers, the examiner shall indicate the wrong answers in the form and indicate the correct solution; for registration, use means of typing in a colour different from those of the applicant for the issue of an armaments authorisation. The examination commissioner shall record in the form the number of test questions correctly answered and shall then indicate the assessment of the theoretical part of the proficiency test whether the applicant for the issue of an armaments authorisation was assessed as "benefited 'or" failed'.
(2) An applicant for the issue of an armaments licence is assessed by "benefit" in the theoretical part of the proficiency test, provided that at least a minimum number of test questions are answered correctly within the specified time limit.
(3) The result of the theoretical part of the proficiency test shall be declared simultaneously by the Examination Commissioner for all applicants for the issue of an armaments licence. The probationary commissioner shall inform the applicants of the issue of the armaments authorisation for further training.
(4) Following the announcement of the outcome of the theoretical part of the proficiency test, the Examination Commissioner shall, upon request, allow the applicant for the issue of an armaments authorisation to consult the form and the corresponding test file in order to compare its erroneous responses and the correct solution.
(5) The examination of the professional competence of an applicant for the issue of an armaments licence, which has been assessed in its theoretical part by the "non-profit 'level, shall be terminated by the examiner, the applicant shall not perform the practical part of the proficiency test and shall be assessed overall by the" non-profit' level.
(6) The unsuccessful applicant for the issue of an armaments licence shall confirm the knowledge of the result of the proficiency test with his signature on the form and may leave the place where it is held. If the unsuccessful applicant for the issue of an armaments authorisation refuses to confirm his signature by familiarising himself with the result, the examiner shall indicate this together with the reason for the refusal to sign the form.
Practical part of the proficiency test
§ 15
The practical part of the proficiency test shall be performed by the applicant for the issue of an armaments licence on the same day as the theoretical part. In exceptional and justified cases, the examiner may allow the practical part of the proficiency test to be carried out on another day. The reason for carrying out the practical part of the proficiency test on another day shall be indicated by the examiner on the form.
§ 16
(1) Before commencing the practical part of the proficiency test, the probationary commissioner shall verify whether the applicant for the issue of an armaments licence has been assessed in its theoretical part by a "benefit 'degree.
(2) The probationary commissioner shall inform the applicants of the issue of the arms authorisation with the principles of safe handling of arms and ammunition and the instructions and commands they shall use during the practical part of the proficiency test.
Safe handling of arms and ammunition
§ 17
(1) In order to demonstrate knowledge, capabilities and skills in the field of safe arms and ammunition management procedures, the applicant for the issue of an arms licence shall, as instructed by the Examination Commissioner, demonstrate himself in practice and, where necessary, supplement the demonstration procedure with a word description
(a) control of the weapon in order to determine its condition;
(b) preparation of the weapon for its partial disassembly and composition to the extent necessary for the cleansing of the weapon;
(c) the procedure for the preparation of weapons and ammunition for firing;
(d) the procedure for detecting and eliminating a defect in the weapon or ammunition during the shooting; and
(e) the exit procedure.
(2) The activities referred to in paragraph 1 shall be carried out by the applicant for the issue of an armaments authorisation gradually, as instructed by the test commissioner with a short ball gun and a long ball gun.
(3) A specific short ball gun and a long ball gun shall be designated by the probationary commissioner of the weapons referred to in Article 43 (4) and (5) to the applicant for the issue of an arms authorisation.
(4) For the demonstration of the activities referred to in paragraph 1, school ammunition not containing bulletins, impactor assemblies or matches shall be used as ammunition.
(5) An overview of the basic procedures for demonstrating knowledge of the safe management of arms and ammunition is set out in Annex 2 to this Regulation.
§ 18
(1) The Examination Commissioner shall establish a safe direction for the applicant for the issue of an armaments authorisation and entrust him with a weapon in order to demonstrate the procedures for the safe handling of arms and ammunition referred to in Article 17 (1).
(2) Procedures which are not the mandatory content of the practical part of the proficiency test, or those not listed in Annex 2 to this Regulation, may be awarded to applicants for the issue of an armaments authorisation by the Examination Commissioner, but their failure to perform, incorrect description or improper demonstration does not justify the assessment of the applicant for the issue of an armaments authorisation by the "failed."
§ 19
Evaluation of demonstration of safe arms and ammunition management procedures
(1) An applicant for the issue of an armaments authorisation is "benefit" when demonstrating the procedures for the safe handling of arms and ammunition within the practical part of the proficiency test, provided that he demonstrates to a sufficient extent the procedures for the safe handling of arms and ammunition, with a short ball and a long ball gun, and complements them, where appropriate, with a verbal description.
(2) The Examination Commissioner shall evaluate the applicant for the issue of an armaments authorisation in the demonstration of safe arms and ammunition procedures as part of the practical part of the proficiency test by "not beneficial 'if the applicant:
(a) to a sufficient extent, not demonstrate the handling of safe arms and ammunition procedures;
(b) infringes the principles of the safe management of arms and ammunition to such an extent that it immediately endangers or would in practice threaten the safety of persons; or
(c) in a gross or repeated manner, infringes the principles of safe handling of arms and ammunition.
(3) In violation of the principles of safe handling of arms and ammunition referred to in paragraph 2 (b) and (c), the examiner shall immediately terminate the proficiency test.
(4) Immediately after the completion of the demonstration of safe arms and ammunition procedures, the probationary commissioner shall indicate in the evaluation form the demonstration of safe arms and ammunition procedures as part of the practical part of the proficiency test whether the applicant for the issue of the arms authorisation has been assessed as "benefited 'or" failed'.
(5) The examination of the professional competence of the applicant for the issue of an arms licence, which has been assessed "failed 'in the practical part of the proficiency test, shall be terminated by the examiner and shall not be conducted by the applicant for target shooting and shall be assessed overall by" failed'.
(6) The unsuccessful applicant for the issue of an arms licence shall acknowledge the result of the demonstration of safe arms and ammunition procedures as part of the practical part of the proficiency test by signing the form and may leave the place of test. If the unsuccessful applicant for the issue of an armaments authorisation refuses to confirm his signature by familiarising himself with the result, the examiner shall indicate this together with the reason for the refusal to sign the form.
Target shooting
§ 20
An applicant for the issue of an arms licence, which has been assessed by the "benefit 'grade in the demonstration of safe arms and ammunition procedures, shall conduct a target shooting.
§ 21
(1) The probationary commissioner will inform the applicants for the issue of an armaments licence who continue the practical part of the proficiency test, with the organisation of the shooting, including the method of notification of the weapon defect, and, if necessary, the principles of safe handling of weapons and ammunition, and the instructions and commands to be used.
(2) A specific short ball gun and a long ball gun to carry out target shooting shall be designated by the probationary commissioner of weapons referred to in paragraphs 4 and 5 of Paragraph 43.
(3) Target shooting shall be carried out by the applicant for the issue of an armaments authorisation individually in accordance with the principles laid down in the operating rules of the shooting range and under direct supervision and in accordance with the instructions and commands of the test commissioner.
(4) The use of protective equipment is governed by the operating order of the shooting range. An applicant for the issue of an armaments authorisation shall also be authorised to use a medical device for target shooting, unless its use is prevented by the operating rules of the shooting range; the need for its use shall be demonstrated by the applicant for the issue of an armaments authorisation.
(5) Only an applicant for an authorisation to issue weapons whose permanent or long-term medical condition requires the use of the support may use a long-term ball gun when shooting at a target. The weapon support shall not allow for stable fixation or aiming. The support of short ball guns during target shooting is not permitted.
§ 22
Target shooting
(1) Target shooting shall be carried out in a standing position or sitting position with the applicant for the issue of an armaments licence, the permanent or long-term health condition of which does not permit the conduct of the standing shooting.
(2) The target shall be fired using single-shot balls and paper or target devices to print a series of rated shots, including the graphical form of the target with marked hits.
(3) Prior to the start of the assessed shooting, the applicant for the issue of an arms licence shall be entitled to verify the accuracy of the shooting of the weapon, namely 3 shots from a short ball gun and 3 shots from a long ball gun.
(4) The time limit for carrying out the target shooting begins with the order of the test commissioner for the shooting and is interrupted between the last shot from one type of weapon and the switch to another type of weapon.
(5) Upon completion of the post-shooting inspection, the applicant for the issue of an armaments authorisation shall present a weapon to the test Commissioner in such a way as to enable him to carry out visual inspection of the chamber of charge or, where appropriate, of the chamber of ammunition or of the chamber of ammunition. The presentation of the weapon shall be carried out with a weapon in a safe direction. If the weapon is equipped with a removable container, it shall be submitted for inspection of its outcome, provided that the examiner so determines.
§ 23
Cease fire
(1) In the event of a technical defect on the weapon or ammunition, the applicant shall suspend the issue of the arms authorisation for the shooting and ensure that it is removed in cooperation with the test Commissioner. After the defect has been removed, the examiner shall order the continued shooting or re-execution of the target shooting if the defect may have had an impact on the part of the target shooting so far. The time during which the defect is removed shall not be counted against the time limit for target shooting. If the defect is not remedied, the probationary commissioner shall provide another weapon referred to in paragraphs 4 and 5 of Section 43 and order the re-execution of the target shooting; the applicant for the issue of an arms licence is entitled to verify the accuracy of the shooting of this weapon with 3 shots.
(2) In the event of an interruption of the shooting due to an obstacle on the part of the applicant for the issue of an authorisation, the applicant shall remove the obstacle created and complete the shooting under the direct supervision of the examiner, if circumstances permit. The time during which the obstacle is removed shall not be counted against the time limit for target shooting.
§ 24
Target shooting evaluation
(1) Target impact means the impact of the target by a bullet into the area of the marked circle, including tangent contact of the circle.
(2) The Examination Commissioner assesses the applicant for the issue of an armaments permit in target shooting in the practical part of the proficiency test by "not beneficial" if the applicant:
(a) within the set time limit, at least the minimum number of hits in the target is not achieved;
(b) infringes the principles of the safe management of arms and ammunition to such an extent that it immediately endangers or would in practice threaten the safety of persons; or
(c) in a gross or repeated manner, infringes the principles of safe handling of arms and ammunition.
(3) In violation of the principles of safe handling of arms and ammunition referred to in paragraph 2 (b) and (c), the examiner shall immediately terminate the proficiency test.
(4) Immediately after the end of the target shooting, the probationary commissioner will indicate in the form the number of hits from a short ball gun and from a long ball gun. A target marked with the action of the applicant for the issue of an arms licence shall be attached to the form only if there is doubt as to the intervention in the target; the reason for the attachment of the target shall be indicated by the examiner in the form.
(5) The probationary commissioner shall indicate in the form of the target shooting assessment as part of the practical part of the proficiency test whether the applicant for the issue of an armaments authorisation has been assessed as "benefited 'or" not'.
§ 25
Overall assessment of proficiency test
(1) An applicant for the issue of an armaments licence is assessed overall in the proficiency test by the degree "benefit" if it is assessed by the degree "benefit"
(a) in the theoretical part of the proficiency test;
(b) demonstration of safe arms and ammunition procedures within the practical part of the proficiency test; and
(c) during target shooting within the practical part of the proficiency test.
(2) The Examination Commissioner shall indicate in the form the overall assessment of the proficiency test whether the applicant for the issue of an armaments licence has been assessed by a "benefit" or "benefit." The examination commissioner shall indicate in the form his name, surname, place and date of the proficiency test and sign it.
(3) The overall assessment of the proficiency test shall be announced by the Examination Commissioner on an ongoing basis.
(4) The applicant for the issue of an armaments authorisation shall confirm his / her signature on the form to be familiar with the result of the proficiency test. If the applicant refuses to confirm his signature with the result, the examiner shall indicate this together with the reason for the refusal to sign the form.
(5) Completed forms of all applicants for arms authorisation shall be transmitted by the Examination Commissioner to the Regional Police Directorate without undue delay after completion of the proficiency test.

COMMUNICATION TEST
§ 26
Organisation and conduct of the comic test
(1) At least one representative of the Ministry of the Interior, the Police Department or the Regional Police Directorate and at least one Examination Commissioner shall be a member of the Comic Test Committee. The Police Presidium shall appoint the Chairman of the Comic-Test Committee.
(2) The conduct of the comitology examination shall be governed by and by the instructions and commands of the applicant for the issue of an armaments authorisation, by the Chairman of the Examination Board or, under his authority, by another member; the instructions and commands shall be clear, understandable and not contrary to the principles of safe handling of arms and ammunition and the operating order of the shooting range.
(3) The examination committee shall decide on the evaluation of the applicant for the issue of an armaments licence for the comitology examination by a simple majority.
(4) Unless otherwise specified, the provisions of Part Three shall apply mutatis mutandis to the content content, organisation and conduct of the comitology test.
§ 27
Place of the comic test
In the absence of a comic test at a shooting range operated by an exempted public body, the Police Presidium shall allow the performance of a comic test at one of the registered test guns in such a way as to ensure their regular rotation.

TEST OF THE TEST COMMISSION
§ 28
Content of the theoretical part of the examination of the examiner
(1) The theoretical part of the examination of the examiner shall take the form of:
(a) a written test to be carried out in the form of a selection of 1 correct response from 3 possible responses to each test question; and
(b) an oral interview.
(2) The written test shall consist of:
(a) 34 test questions from knowledge of arms and ammunition legislation, verification of firearms and ammunition and criminal aspects of arms and ammunition;
(b) 10 test questions from knowledge of weapons and ammunition teaching;
(c) 10 test questions from knowledge of the principles of safe arms and ammunition management; and
(d) 6 test questions from knowledge of the medical minimum.
(3) The oral interview in which the applicant for appointment as Examination Commissioner answers questions asked by the Examination Board is aimed at verifying knowledge, competences and skills from areas whose knowledge is verified by a written test.
