THE LAW
of 14 June 2012
amending Act No. 634 / 1992 Coll., on Consumer Protection, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 634 / 1992 Coll., as amended by Act No. 217 / 1993 Coll., Act No. 40 / 1995 Coll., Act No. 104 / 1995 Coll., Act No. 110 / 1997 Coll., Act No. 356 / 1999 Coll., Act No. 36 / 2008 Coll., Act No. 151 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 227 / 2004 Coll., Act No. 214 / 2003 Coll., Act No. 439 / 2003 Coll., Act No. 119 / 2004 Coll.
1. in Paragraph 1 (1), including footnotes 1, 1a, 2, 31 and 32:
"(1) This law implements the relevant European Union1), following directly applicable European Union31), 32), and provides for certain conditions of business (1a) relevant to consumer protection, public administration tasks in the field of consumer protection and consumer authorisation, consumer associations (2) or other legal persons based on consumer protection.
1) Directive 2005 / 29 / EC of the European Parliament and of the Council on unfair commercial practices towards consumers in the internal market and amending Council Directive 84 / 450 / EEC, Directives 97 / 7 / EC, 98 / 27 / EC and 2002 / 65 / EC of the European Parliament and of the Council and Regulation (EC) No 2006 / 2004 (Directive on unfair commercial practices). Council Directive 69 / 493 / EEC on the approximation of the laws of the Member States relating to crystal glass. Directive 94 / 11 / EC of the European Parliament and of the Council on the approximation of the laws, regulations and administrative provisions of the Member States relating to the labelling of materials used in the essential parts of footwear sold to consumers. Council Directive 87 / 357 / EEC on the approximation of the laws of the Member States relating to products the true nature of which is not identifiable and which therefore endanger the health or safety of consumers. Directive 2008 / 122 / EC of the European Parliament and of the Council on consumer protection in relation to certain aspects of temporary accommodation (timeshare) contracts, long-term recreational products, resale and exchange.

31) Regulation (EU) No 1007 / 2011 of the European Parliament and of the Council of 27 September 2011 on textile fibre names and related labelling of the material composition of textile products and repealing Council Directive 73 / 44 / EEC and Directives 96 / 73 / EC and 2008 / 121 / EC of the European Parliament and of the Council.
32) Regulation (EC) No 765 / 2008 of the European Parliament and of the Council of 9 July 2008 laying down requirements for accreditation and market surveillance relating to the marketing of products and repealing Regulation (EEC) No 339 / 93. "
2. in Article 2, points (g) to (i) are deleted;
Points (j) to (s) shall be renumbered as points (g) to (o).
3. in Article 10 (1), point (b) shall be deleted;
Point (c) shall be renumbered (b).
4. In Article 23 (1), "and 15 'is replaced by" and 16';
5. In Article 23, the following paragraph 14 is inserted after paragraph 13:
"(14) The Czech Trade Inspection Centre shall supervise compliance with the obligations or requirements laid down by the directly applicable European Union Regulation governing textile fibre names and associated labelling of the material composition of textile products31). The supervisory procedure shall also be governed by the directly applicable European Union Regulation laying down market surveillance requirements concerning the placing on the market of products (32). ';
Paragraphs 14 and 15 shall become paragraphs 15 and 16.
6. In Paragraph 24 (1), the word "or 'shall be deleted at the end of point (c).
7. in Article 24 (1), the following point (d) is inserted after point (c), including footnote 33:
"(d) manufacture, import, market, offer or sell textile products not labelled in accordance with the directly applicable European Union regulation on textile fibre names and related labelling of the material composition of textile products31), or textile products not accompanied by commercial documentation under this directly applicable European Union33); or
33) Article 14 (3) of Regulation (EU) No 1007 / 2011 of the European Parliament and of the Council of 27 September 2011 on textile fibre names and related labelling of the material composition of textile products and repealing Council Directive 73 / 44 / EEC and Directives 96 / 73 / EC and 2008 / 121 / EC of the European Parliament and of the Council. '
Point (d) shall be renumbered as point (e).
8. In Article 24 (10) (c), "and (d) 'is replaced by" to (e)';
9. in Article 28a, points (a) to (c) are deleted;
Points (d) to (f) shall be renumbered as points (a) to (c).
Repeal
The following shall be deleted:
1. Decree of the Ministry of Industry and Trade No. 92 / 1999 Coll.
2. Decree No. 9 / 2005 Coll., amending Decree No. 92 / 1999 Coll., laying down the method of labelling textile products with data on the composition of the material.
3. Decree No. 509 / 2006 Coll., amending Decree No. 92 / 1999 Coll., laying down the method of labelling textile products with material composition, as amended by Decree No. 9 / 2005 Coll.
4. Decree No. 317 / 2007 Coll., amending Decree No. 92 / 1999 Coll., laying down the method of labelling textile products with the material composition, as amended.
5. Decree No. 236 / 2010 Coll., amending Decree No. 92 / 1999 Coll., laying down the method of labelling textile products with the material composition, as amended.
6. Decree of the Ministry of Industry and Trade No. 93 / 1999 Coll., laying down procedures for quantitative analysis of binary textile fibre mixtures.
7. Decree No. 510 / 2006 Coll., amending Decree No. 93 / 1999 Coll., laying down procedures for quantitative analysis of binary textile fibre mixtures.
8. Decree No. 318 / 2007 Coll., amending Decree No 93 / 1999 Coll., laying down procedures for the quantitative analysis of binary textile fibre mixtures, as amended by Decree No. 510 / 2006 Coll.
9. Decree No. 237 / 2010 Coll., amending Decree No. 93 / 1999 Coll., which lays down procedures for quantitative analysis of binary textile fibre mixtures, as amended.
10. Decree of the Ministry of Industry and Trade No. 94 / 1999 Coll., laying down procedures for quantitative analysis of three-component textile fibre mixtures.
Efficacy
This Act shall take effect on the day of its publication.
