Government Regulation
of 19 October 1948
implementing certain provisions of the State Court Act.
The Government of the Czechoslovak Republic orders pursuant to the Act of 6 October 1948, No. 232 Coll., on the State Court:
§ 1.
(1) By the end of October each year, the Regional National Committees shall submit proposals to the Ministry of Justice to appoint judges from the people for the next calendar year.
(2) For the judges of the people, each regional national committee shall propose at least 15 of the persons living in its district, of which one third of the persons of the law of the experts. A person who has completed his studies at the Faculty of Law of a national university shall be regarded as a person of the law by successful composition of all theoretical state examinations or the achievement of a doctorate in law.
(3) Within the time limit referred to in paragraph 1, the Ministry of Defence shall submit proposals to the Government for the appointment of judges from the people of military persons in active service.
§ 2.
(1) It is for the judges of the people who have carried out their duties, if they do not reside in the place where the national court was sitting, to replace the actual costs incurred, at the maximum amount equal to the public transport means of regular services of the 2nd carriage class or 2nd carriage class, as well as the compensation for bed and board in the highest amount of 100 CZK per day.
(2) In addition to the reimbursement of the final costs referred to in paragraph 1, the judges of the people shall be liable for the presentation fees, namely:
1. if the session is not more than five hours, the amount of 60 CZK;
2. If the meeting lasted more than five hours, the amount of 100 Kns per day of the meeting.
(3) If the judge of the people proves that he has been reduced by a salary (service salary) by an amount higher than that of the present salary, he shall be entitled to the supplement up to the amount of the salary lost (service salary).
§ 4.
(1) Until such time as the Regional National Committees (Section 43 of the Act) operate, they shall submit proposals pursuant to Paragraph 1 (1) of the Regional National Committees and the internal mandates.
(2) For the judges of the people, each national committee and authority shall propose at least 15 of the districts of each county court, of which one third of the persons of the law of the experts.
(3) Proposals for the appointment of judges from the people for the remainder of the calendar year 1948 shall be submitted by the Regional National Committees and by the delegation of the Interior to the Ministry of Justice within the time limit specified by it.
§ 5.
This Regulation shall enter into force on the day of its publication; they shall be carried out by the Minister of Justice in agreement with the Ministers of National Defence, Interior and Finance.
