DECLARATION
of 28 July 2017
amending Decree No. 474 / 2000 of the Ministry of Agriculture Coll., laying down requirements for fertilisers, as amended
The Ministry of Agriculture shall determine, pursuant to Articles 3 (5) and 4 (9) of Act No. 156 / 1998 Coll., on fertilisers, soil aid substances, aids and substrates and on agrochemical testing of agricultural soils (Fertilisers Act), as amended by Act No. 9 / 2009 Coll. and Act No. 61 / 2017 Coll.:
Decree No. 474 / 2000 Coll., laying down requirements for fertilisers, as amended by Decree No. 401 / 2004 Coll., Decree No. 209 / 2005 Coll., Decree No. 271 / 2009 Coll. and Decree No. 131 / 2014 Coll., is amended as follows:
1. In Annex 1, Part 2, the following is inserted after the current text:
"(d) organic fertilisers and substrates used in the manufacture of waste water treatment plants

Methods of sampling and determination of microbiological analyses shall be carried out in accordance with the principles set out in AHEM 7 / 2001 and AHEM 1 / 2008. ';
Note 5:

2. In Annex 3, the heading "Fertilizer type 'is replaced by the following: 3. Mineral fertilisers, which, as a type-determining component, contain only micro-nutrients, the following table is inserted:

3. In Annex 3, under Table (a), the following heading is inserted:
"(b) Fertilisers containing only one trace nutrient."
4. In Annex No 3, in Part Type of fertiliser: 4. Calcium and magnesium fertilisers under the table are supplemented by the sentence "Fertilizers corresponding to types 17.1.1 - 17.2.2 are considered to be of type and in granular form if granules, after mixing in water, fall into particles with a size distribution corresponding to the type concerned."
5. In Annex 3, the words "separated digestat 'shall be replaced by the words" rigid digestat; digestat assembly' in Part Type of fertiliser: 5.
6. In Annex No 3, in Part Type of fertiliser: 5. Organic and organo-mineral fertilisers in the seventh column, the words "solid post-separation" are replaced by the words "; in the case of digestor - separation, the proportion is solid post-separation."
Technical Regulation
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
Efficacy
This decree shall take effect 30 days after its publication.
