DECLARATION
of 31 August 2015
amending Decree No. 52 / 1997 Coll., laying down requirements to ensure safety and health at work and safety of operations in the disposal of main mining works, as amended
According to § 6 (6) (a) of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and State Mining Administration, the Czech Mining Authority provides:
Decree No. 52 / 1997 Coll., laying down requirements to ensure safety and health at work and safety at the disposal of main mining works, as amended by Decree No. 32 / 2000 Coll., Decree No. 592 / 2004 Coll. and Decree No. 176 / 2011 Coll., is amended as follows:
1. Paragraph 11 (1) reads as follows:
"(1) The safety zone of the organisation shall determine on the surface around the liquidated main mine. The size of the safety zone shall be determined taking into account in particular the state and manner of disposal of the main mine and the mining, geological, hydrogeological and geotech situation in its immediate vicinity. ';
2. Paragraph 11 (4) reads as follows:
"(4) The organisation shall submit a proposal to the General Building Office for a decision on the protection zone. The establishment of the safety zone and the submission of the proposal to the general building office shall also be notified by the organisation to the municipal authority of the municipality with extended scope. A copy of the decision authorising the liquidation of the main mining works shall be sent by the district mining office to the competent general construction office and the municipal office of the municipality with extended scope. ';
3. In Paragraph 16 (3), "extraordinary 'is replaced by" serious'.
This Decree shall take effect on 1 October 2015.
