THE LAW
of 10 July 2024
amending Act No 90 / 2016 Coll., on conformity assessment of specified products when making them available on the market, as amended, and Act No 424 / 2023 Coll., on accessibility requirements for certain goods and services
Parliament has decided on this law of the Czech Republic:
Amendment of the Act on conformity assessment of specified products when making them available on the market
Act No. 90 / 2016 Coll., on conformity assessment of specified products when making them available on the market, as amended by Act No. 183 / 2017 Coll., Act No. 265 / 2017 Coll., Act No. 526 / 2020 Coll., Act No. 299 / 2021 Coll., Act No. 374 / 2021 Coll., Act No. 431 / 2022 Coll. and Act No. 87 / 2023 Coll., is amended as follows:
1. In Part Two, Title I, the following Section 8 is inserted after Section 7, including the title and footnote 20:
Machinery
(1) Where a directly applicable European Union regulation in the field of machinery (20) refers to a national authority, that authority in the Czech Republic is the supervisory authority.
(2) If the directly applicable European Union regulation in the area of machine tools refers to a language designated or requested by a Member State, this language is the Czech language in the Czech Republic.
(3) The Ministry of Industry and Trade (hereinafter referred to as the Ministry) fulfils the obligations laid down in Articles 6 (9), 7 (3) and 20 (8) of the directly applicable European Union machinery regulation.
20) Regulation (EU) 2023 / 1230 of the European Parliament and of the Council of 14 June 2023 on machinery and repealing Directive 2006 / 42 / EC of the European Parliament and of the Council and Council Directive 73 / 361 / EEC. '
2. In Section 48b, the words "Ministry of Industry and Trade (" Ministry ')' are replaced by the words "Ministry '.
Transitional provisions
1. Machinery placed on the market before 20 January 2027 in accordance with Government Regulation No. 176 / 2008 Coll., on technical requirements for machinery, as amended, may be made available on the market after that date.
2. EC type-examination certificates and quality assurance system approvals issued in accordance with Government Regulation No. 176 / 2008 Coll., as amended, shall remain valid until their expiry.
Amendment to the Act on requirements for accessibility of certain goods and services
Act No. 424 / 2023 Coll., on the accessibility requirements of certain goods and services, is amended as follows:
1. In Article 21 (1), the words "pursuant to Article 20 (1) which does not meet the accessibility requirements' shall be inserted after the words" the product '.
2. Paragraph 21 (2) is deleted.
Paragraphs 3 and 4 shall become paragraphs 2 and 3.
3. In Article 21 (2), the text "Article 21 (2) 'is replaced by" Article 20 (3)'.
4. In Article 21, the following paragraph 3 is inserted after paragraph 2:
"(3) Where the supervisory authority receives information on the progress of another Member State towards a product that does not meet the accessibility requirements and where the supervisory authority finds that the procedure of another Member State is justified, it shall prohibit the making available on the market of that product or decide on its withdrawal from the market. It shall immediately inform the European Commission and the other Member States through the information and communication system of this measure and of any additional data relating to the non-compliance of the product with the accessibility requirements. ';
Paragraph 3 shall become paragraph 4.
5. In Paragraph 21 (4), "2 'is replaced by" 3'.
EFFECTIVE
That law shall take effect on the day following its publication, with the exception of the provisions of:
(a) Part Two, which shall take effect on 28 June 2025; and
(b) Part Three, which shall take effect on 20 January 2027.
