DECLARATION
of 2 June 2005
implementing certain provisions of Act No. 96 / 1993 Coll., on Construction Savings and State Support of Construction Savings and on the Addition of the Act of the Czech National Council No. 586 / 1992 Coll., on Income Taxes, as amended by the Act of the Czech National Council No. 35 / 1993 Coll.
The Ministry of Finance (hereinafter referred to as "the Ministry of Finance") provides, pursuant to § 11 (7), § 13 (7) and in agreement with the Ministry of Interior pursuant to § 11 (8) of Act No. 96 / 1993 Coll., on Construction Savings and State Support of Construction Savings and on the Addition of the Act of the Czech National Council No. 586 / 1992 Coll., on Income Taxes, as amended (hereinafter referred to as "the Act"):
Subject matter
This decree provides:
(a) the deadline, the method of filing and the formalities for the application of the building savings bank for an annual advance of State aid for the construction savings (hereinafter referred to as "State aid"), including the way in which it is corrected or supplemented;
(b) the method of repaying State aid to the building economy;
(c) the manner in which the building savings bank's application for modification of the data relating to participants in the building savings (hereinafter referred to as the participant) registered in the information system is submitted and the details of the application made by the building savings bank;
(d) the technical and organisational conditions for comparing information system data with data maintained in the population registration information system.
Deadline, method of submission and details of the application by the building savings bank for an annual advance on State aid, including the way in which it is corrected or supplemented
(Paragraph 11 (7) of the Law)
(1) The building savings bank applies for an annual advance of State aid (hereinafter referred to as the "application") to the Ministry at the dates set out in Annex 1 to this Decree.
(2) The application is submitted by the building savings bank in two data files by electronic means. The first dataset contains data on participants under the law, the second dataset is accompanying and contains a quantification of the total required advance State aid and bank connections.
(3) The repair or addition of the application is submitted by the building savings bank in the same way and with the same requirements as the application. The repair or addition of the application by the building savings bank shall be submitted by the dates set out in Annex 1 to this Order.
(4) Where, within the same time limit, a correction or addition of an application is made at the same time as the application, or a correction or addition of another application, the building savings bank shall merge with the application, or a correction or addition of a further application, and submit it in the same way and with the same formalities as the application.
(5) The organisational and technical conditions for the transmission of data by building savings banks to the Ministry are set out in Annex 2 to this Decree.
Method of recovery of State aid for construction savings
(Paragraph 13 (7) of the Law)
(1) In return for State aid pursuant to Article 13 (3) of the Act, the building savings bank returns State aid to an account determined by the Ministry. In return for State aid, the building savings bank provides the Ministry with information on the State aid recovered. Information on the State aid recovered, which contains data on the participants under the law, is provided by the building savings bank in two data files. The first data file contains data on participants by law, the second data file is accompanying and contains information concerning the beginning and end of the reference period.
(2) The organisational and technical conditions for the transmission of data by building savings banks to the Ministry are set out in Annex 2 to this Decree.
Method of submission and details of the application by the building savings bank to amend the data relating to participants registered in the information system
(Paragraph 13 (7) of the Law)
(1) An application for a change to the data relating to participants registered in the information system is submitted by the building savings bank in an electronic way. The data file shall contain data on participants under the law and shall be transmitted as part of the information on the State aid recovered pursuant to Article 3 (1).
(2) The organisational and technical conditions for the transmission of data by building savings banks to the Ministry are set out in Annex 2 to this Decree.
Technical and organisational conditions for comparing information system data with data maintained in the population information system
(Paragraph 11 (8) of the Law)
(1) The comparison of information system data with data maintained in the population records information system (hereinafter referred to as "data comparison") shall be made electronically on the basis of the data transmitted.
(2) The subject of data transmission by the Ministry of the Interior when comparing data is the data referred to in Section 11 (6) of the Act in the data files.
(3) The transmission of data by the Ministry of Interior to the Ministry of Interior when comparing data is carried out by data data on the results of data comparison in data files.
(4) The data on the results of the data comparison shall be transmitted by the Ministry of Interior to the Ministry of Interior within 20 calendar days of receipt of the data referred to in paragraph 2. In the event that part of the information system data is compared with the data kept in the population registration information system, the deadline for the transmission of data on the results of the comparison shall be 15 calendar days from the date on which the data were received by the Ministry of Interior.
(5) Data sets with data referred to in paragraphs 2 and 3 shall be transmitted via a data box. The technical conditions for the transmission of data in data files are set out in Annex 3 to this Decree.
Efficacy
This Decree shall take effect on 1 July 2005.

Organizational and technical conditions for the transmission of data to the Ministry by building savings banks
1. Organisational Conditions
1.1. Subject matter of data transmission
The transmission of data to the Ministry is subject to data in the data files pursuant to § 2 (2), § 3 (1) or § 4 (1) of this Decree. Data shall be recorded in the information system database.
1.2. Data transmission
Data are transmitted by means of electronic data transmission. The building savings bank shall transmit the data pursuant to § 3 (1) or § 4 (1) of this Decree at the dates specified in the operational documentation of the information system.
1.3. Data recipient
The recipient of the data transmitted shall be the Ministry.
2. Technical conditions
2.1. Method of transmission of data files
Data files are transmitted by means of electronic data transmission.
2.2 Name of data files
All data for each processing operation submitted by the building savings bank shall be transmitted in data files whose names have the following structure:

2.3 Structure of data files
All data files transmitted are in xml format. The detailed structure of the data files transmitted is described in the operational documentation of the information system.
The following conditions shall be complied with for the participant's own data:
(a) the ISO Latin-Standard ISO / IEC8859-2 code page is used,
(b) each entry is on a separate line, each line is terminated by an EOL,
(c) the length of the items in the record is variable;
(d) the separator "î124;" shall be after each item;
(e) numerical entries are entered without left-hand zeros;
(f) items that need not be filled in shall be recorded as blank, i.e. in the form of "ZV124; ZV124;"

2.4. Processing regime for data transmitted

Technical conditions for data transmission when comparing data
1. Method of transmission of data files
Data files are transmitted by the Ministry of the Interior through the data box. Upon completion of the data comparison, the Ministry of the Interior shall transmit the data files with the results of the comparison to the Ministry via the data box.
2. Structure of data files
All data files transmitted are in xml format. The detailed structure of the data files transmitted is described in the operational documentation of the information system.
3. Processing mode of transmitted data files
The data file processing mode is described in detail in the information system operational documentation.
