Ministry of Foreign Affairs
The Ministry of Foreign Affairs states that on 15 November 1995 the Agreement between the Government of the Czech Republic and the Government of the Republic of Bulgaria on cooperation on the quarantine and plant protection section was signed in Prague.
The Agreement entered into force on 11 May 1996 on the basis of Article 13 thereof. The Convention between the Government of the Czechoslovak Socialist Republic and the Government of the People's Republic of Bulgaria on cooperation in the plant protection sector against pests, diseases and weeds of 1 November 1967, published under No 92 / 1969 Coll.
The Czech version of the Agreement is hereby published at the same time.
AGREEMENT
between the Government of the Czech Republic and the Government of the Republic of Bulgaria
on cooperation on the quarantine and plant protection sector
The Government of the Czech Republic and the Government of the Republic of Bulgaria, hereinafter referred to as "the Contracting Parties',
managers wishing to intensify cooperation on the quarantine and plant protection section,
in order to improve the protection of the territories of the States of the two Contracting Parties against the introduction of quarantine pests and to reduce the losses resulting from their operation,
and to facilitate trade and exchange of seeds, propagating material and goods of plant origin,
agree as follows:
For the purposes of this Agreement, quarantine harmful organisms shall mean pests, plant diseases and weeds declared as quarantine by the general legislation of the States of the two Contracting Parties annexed to this Agreement.
The competent authorities of the two Contracting Parties may amend or supplement the lists of quarantine harmful organisms.
Such amendments or additions shall be notified to the competent authorities of the other Contracting Party by diplomatic means and shall enter into force 60 days after such notification.
The competent authorities of the States of the two Contracting Parties shall each year, by 1 April at the latest, exchange information on the presence and spread of harmful organisms listed in the list of quarantine facilities of the other Contracting Party in their territory.
The Contracting Parties shall ensure that the competent authorities and the organisations of their States comply with the legislation of the State of the other Contracting Party on quarantine and plant protection when exporting and transit of seeds, seedlings and other goods of plant origin (hereinafter referred to as "goods subject to plant health inspection ') from the territory of the State of one Contracting Party to or through the territory of the State of the other Contracting Party.
The import, export and transit of consignments shall take place through border crossing points designated by the competent authorities of the States of the two Contracting Parties.
The Contracting Parties agree that when goods subject to plant health inspection are exported to the territory of the other Contracting Party, shavings, sawdust, paper, plastic and other materials on which harmful organisms are not propagated and which must be free from soil or other substrate shall be used as packaging material.
Means of transport used for the transport of goods subject to plant health inspection in the territory of the State of the other Contracting Party shall be thoroughly cleaned and disinfected as necessary.
Each consignment of goods subject to plant health inspection, exported from the territory of the State of one Contracting Party to or through the territory of the State of the other Contracting Party, shall be accompanied by a phytosanitary certificate issued by the authority of the quarantine and plant protection service confirming that the goods are harmful organisms considered to be quarantine in the territory of the State of the importer.
The plant health certificate accompanying the consignment must be the original and completed in English, French or Russian. The plant health certificate shall be valid for 20 days from the date of issue. Any repairs not carried out by the Phytoquarantine Service shall render it invalid.
The competent authorities of the two Contracting Parties shall have the right to lay down additional plant health conditions for the import of individual consignments.
When reexporting plants and plant products, the phytosanitary certificate for re-export shall be accompanied by the original phytosanitary certificate of the manufacturer's State.
If the presence of quarantine harmful organisms or any breach of the quarantine rules of the importing State is detected during the plant health inspection, the competent authorities of the States of the two Contracting Parties shall have the right to refuse the acceptance of the consignment or to destroy or order other appropriate measures, which they shall inform in writing the competent authorities of the State of the Contracting Party.
The competent authorities of the States of the two Contracting Parties shall, where possible, provide each other with technical, technical and other assistance in quarantine and plant protection under mutual arrangements.
The competent authorities of both Contracting Parties shall:
(a) exchange laws and other legislation relating to quarantine and plant protection at the latest two months after their date of issue;
(b) to report to each other on specialised journals, monographs and important publications from the quarantine and plant protection sectors published in their State.
In order to accelerate transport and reduce the risk of introduction of quarantine harmful organisms, plant health inspections may be carried out by the competent authorities of the State of one Contracting Party in the territory of the State of the other Contracting Party after mutual agreement.
The competent authorities of the State of the Contracting Party shall ensure, where necessary, the service room, optical equipment, laboratory supplies and other equipment necessary for the work carried out and shall ensure compliance with the labour safety rules.
The procedure and other conditions for plant health inspections shall be defined by the competent authorities of the States of the two Contracting Parties in a specific arrangement for each individual case.
The competent authorities of the States of the two Contracting Parties shall, if necessary, hold joint consultations to address practical issues related to the implementation of this Agreement.
The meetings will take place alternately in the Czech Republic and the Republic of Bulgaria. The date and place of the meeting shall be determined by mutual agreement.
The cost of the fare and the residence of its representatives shall be borne by the sending Contracting Party.
The competent authorities of the States of both Contracting Parties which will be gestors of the implementation of this Agreement shall:
- Czech Republic Ministry of Agriculture
- the Bulgarian Ministry of Agriculture and Food Industry of the Republic of Bulgaria.
The competent authorities of the States of the two Contracting Parties shall be in direct contact and may enter into implementing arrangements for the implementation of this Agreement.
The issues at issue that would arise in the implementation of this Agreement will be addressed by experts from the States of the two Contracting Parties. If the desired results are not achieved in this way, the issues at issue will be addressed by diplomatic channels.
The provisions of this Agreement shall not affect the rights and obligations of the States of the Contracting Parties arising from other international agreements which they have concluded.
This Agreement shall be subject to approval in accordance with the national legislation of both Parties and shall enter into force 30 days after the date of receipt of the later note of such approval.
This Agreement shall be negotiated for a period of 5 years and shall be extended automatically for another 5 years, unless one of the Contracting Parties denies it in writing six months before its expiry.
On the date of entry into force of this Agreement, the Convention between the Government of the Czechoslovak Socialist Republic and the Government of the People's Republic of Bulgaria on cooperation in the field of plant protection against pests, diseases and weeds (Sofia, 1 November 1967) will expire.
Dane in Prague on 15 November 1995 in two original copies, each in the Czech and Bulgarian languages, the two texts being equally authentic.
