on the reimbursement of postal charges for consignments in court proceedings.
The Constitutional National Assembly of the Czechoslovak Republic decided on this law:
Postal charges in court before ordinary courts.
Postage charges for judicial consignments in civil and criminal matters are paid in advance from the Treasury.
(1) In civil matters of law, the court must replace the advance payment paid by the person who initiated the proceedings by an action or an application, otherwise the person in whose interest or the main interest the proceedings are conducted.
(2) Several persons shall be liable by common and non-differentiated hands for the replacement of the compulsory.
(3) The preceding provisions shall not affect the provisions under which a person may, by way of compensation, claim compensation paid to a third party, in particular as part of the costs of the proceedings.
(1) The reimbursement of the postage paid by advance payment from the Treasury is calculated by an amount to be determined by the Government by a regulation.
(2) The staff of the Registry shall be responsible for calculating the reimbursement of the postal charges; the collection and recovery of the postal fee is subject to the rules governing the keeping of the money economy in courts and judicial offices.
Postage charges before extraordinary courts, referees and social insurance courts.
The provisions of Part One shall also apply to proceedings before extraordinary courts, to arbitration and to social insurance courts. However, in proceedings concerning the claims of insured persons before social insurance courts, the insurance company shall always be obliged to reimburse the postage.
Final provision.
This Law shall take effect on 1 January 1947; to be carried out by the Minister for Justice.
