amending Decree No 341 / 2014 Coll., on the approval of technical competence and on technical conditions for the operation of vehicles on the road
The Ministry of Transport provides, pursuant to § 91 (1) of Act No. 56 / 2001 Coll., on the conditions of operation of vehicles on the road and amending Act No. 168 / 1999 Coll., on liability insurance for damage caused by the operation of a vehicle and on the amendment of certain related laws (Act on Insurance of Liability from the Operation of Vehicles), as amended by Act No. 307 / 1999 Coll., Act No. 411 / 2005 Coll., Act No. 226 / 2006 Coll., Act No. 170 / 2007 Coll., Act No. 297 / 2009 Coll., Act No. 152 / 2011 Coll., Act No. 239 / 2013 Coll. and Act No. 63 / 2017 Coll.:
Decree No 341 / 2014 Coll., on the approval of technical competence and on technical conditions for the operation of vehicles on the road, is amended as follows:
1. in Article 3 (1) (b), the words "Article 2 of Directive 2002 / 24 / EC, relating to the type-approval of two or three-wheel motor vehicles and repealing Council Directive 92 / 61 / EEC, as amended (hereinafter referred to as" Directive 2002 / 24 / EC ")" shall be replaced by the words "directly applicable European Union provisions governing the approval of two or three-wheel vehicles and quadricycles and the surveillance of market12,";
Footnote 12 reads:
"(12) Regulation (EU) No 168 / 2013 of the European Parliament and of the Council of 15 January 2013 on the approval and market surveillance of two- or three-wheel vehicles and quadricycles, as amended. ';
2. In Article 3 (1) (c), the words "Annex II, Chapter A, to Directive 2003 / 37 / EC, on the type-approval of agricultural or forestry tractors, their trailers and interchangeable towed machinery, as well as their systems, components and separate technical units and repealing Directive 74 / 150 / EEC, as amended, hereinafter referred to as" Directive 2003 / 37 / EC ', shall be replaced by the words "a directly applicable European Union Regulation governing the approval of agricultural and forestry vehicles and the surveillance of market13)."
Footnote 13 reads:
"(13) Regulation (EU) No 167 / 2013 of the European Parliament and of the Council of 5 February 2013 on the approval and market surveillance of agricultural and forestry vehicles, as amended. '
3. in Article 4 (1) (b), the words "Article 2 (7) and Article 4 (1) of Directive 2002 / 24 / EC" shall be replaced by the words "the directly applicable European Union Regulation concerning the approval of two-, three-wheel and quadricycle vehicles and the surveillance of market12,";
4. in Article 4 (1) (c), the words "Article 2 (a) and Article 4 (1) of Directive 2003 / 37 / EC 'are replaced by the words" directly applicable European Union Regulation on the approval of agricultural and forestry vehicles and market surveillance (13)';

Vehicles, systems, components and separate technical units not covered by the relevant European Union provisions
(Paragraph 16 (9) of the Law)
The relevant provisions of the European Union shall not apply to:
(a) road vehicles of categories M, N and O designed and constructed for use by armed forces, civil protection, fire services and services responsible for maintaining public order;
(b) road vehicles of subcategory LZ;
(c) special vehicles of categories T4.1, T4.2, C, R and S when the manufacturer requests the approval of a non-harmonised type, as well as special vehicles of subcategories SS and SN,
(d) vehicles of category Z; or
(e) systems, components and separate technical units intended for vehicles referred to in (a) to (d). ';
6. Paragraph 8 (1) reads as follows:
"(1) For the determination of the technical requirements for road vehicles referred to in Article 7 (a), their systems, components and separate technical units, Annex 3 to this Regulation shall apply mutatis mutandis and the European Union provisions directly applicable to the approval of road vehicles of categories M, N and O. This does not apply to technical requirements whose application is hindered by operational technical reasons related to the activity carried out by the operators of such vehicles. In order to determine the technical requirements for road vehicles referred to in Article 7 (b), their systems, components and separate technical units, the European Union provisions directly applicable to the approval of two or three-wheel vehicles and quadricycles and the surveillance of the market12 shall apply mutatis mutandis). This does not apply to technical requirements whose application is hindered by operational technical reasons related to the activity carried out by the vehicle operators. For the purpose of establishing the technical requirements for road vehicles referred to in Article 7 (d), their systems, components and separate technical units, Annex 3 to this Regulation and the European Union provisions directly applicable to the approval of road vehicles of categories M, N and O, or the European Union Regulation directly applicable to the approval of two or three-wheel vehicles and quadricycles and to the supervision of the market12) shall apply mutatis mutandis. ';
7. In Article 8 (2), the word "proportionate 'shall be inserted after the word" mutatis mutandis';
8. In Article 9 (1), the word "road 'shall be inserted after the word" approval'.
9. Paragraph 9 (2) and (3) are deleted and paragraph 1 is deleted.
10. in Article 11 (1), the word "road" shall be inserted after the word "production."
11. in Article 11 (1), the part of the sentence after the semicolon, including the semicolon, shall be deleted;
12. Paragraph 11 (3) is deleted.
13. Paragraph 12 (2) and (3) are deleted and paragraph 1 is deleted.
14. in Article 13 (1), at the end of point (a), the comma shall be replaced by a dot and points (b) and (c) shall be deleted and the designation of point (a) shall be deleted;
15. in Paragraph 13, paragraph 3 is deleted;
16. in Article 14 (1), at the end of point (a), the comma shall be replaced by a dot and points (b) and (c) shall be deleted and the designation of point (a) shall be deleted;
17. in Paragraph 14, paragraph 3 is deleted;
18. In Article 15 (1), the words "categories M, N and O 'are inserted after the words" vehicles'.
19. in Article 16 (1), at the end of point (a), the comma shall be replaced by a dot and points (b) and (c) shall be deleted and the designation of point (a) shall be deleted;
20. Paragraph 16 (3) is deleted.
21. in Article 17 (1), the words "categories M, N and O and vehicles referred to in Article 7" shall be inserted after the words "vehicles" and the words "road" shall be deleted;
22. in Paragraph 17 (2), the word "road" shall be deleted;
23. in Paragraph 18 (1), at the end of point (a), comma shall be replaced by a dot and points (b) and (c) shall be deleted and the designation of point (a) shall be deleted.
24. in Paragraph 18 (4), part of the sentence after the semicolon, including the semicolon, shall be deleted;
25. In Article 19, paragraphs 4 and 5 are added:
"(4) Paragraphs 1 to 3 shall apply only to road vehicles of categories M, N and O, vehicles referred to in Section 7 and systems, components and separate technical units of such vehicles.
(5) The particulars of the list of approval documents and the method of extension and revision of type-approval at the time of approval of the international type are given in the decisions adopted under the international agreement. ';
26. in Paragraph 20 (1), the text "O and L" is replaced by "and O";
27. in Article 20, paragraph 2 is deleted;
Paragraph 3 shall become paragraph 2.
28. In Article 20 (2), the words "for vehicles of category L in Article 7 and Annex IV to Directive 2002 / 24 / EC, for vehicles of categories T, C, R and S in Article 6 and Annex III to Directive 2003 / 37 / EC 'are deleted.

(1) The approval mark shall be affixed to all road vehicles of categories M, N and O, their components and separate technical units and shall be as specified in Annex 3 to this Regulation and in the directly applicable European Union Regulations concerning the approval of road vehicles of categories M, N and O; this shall not apply to road vehicles pursuant to § 7 (a), their components and separate technical units.
(2) At the time of approval of an international type, the approval mark is affixed to all components of vehicles and separate technical units of vehicles and is indicated in decisions taken under an international contract.
(3) The approval mark for vehicles referred to in Article 7, their components and separate technical units shall be affixed to all vehicles, their components and separate technical units and shall be as set out in Annex 8 to this Regulation. '
30. Paragraph 22 (2) and (3) are deleted and paragraph 1 is deleted.
31. the following Section 22a is inserted after Section 22:
Approval of the non-harmonised type
(Paragraph 16 (9) of the Law)
(1) The approval of the non-harmonised type shall apply mutatis mutandis:
(a) Annex 3 to this Regulation and the provisions directly applicable in the European Union concerning the approval of road vehicles of categories M, N and O, where vehicles are approved in accordance with Section 7 (a), their systems, components or separate technical units;
(b) a directly applicable European Union Regulation governing the approval of two-, three-wheel and quadricycle vehicles and the surveillance of the market12), when vehicles are approved pursuant to § 7 (b), their systems, components or separate technical units;
(c) a directly applicable European Union regulation governing the approval of agricultural and forestry vehicles and market surveillance (13), where vehicles are approved under § 7 (c), their systems, components or separate technical units;
(d) Annex No 3 to this Regulation and the directly applicable European Union provisions governing the approval of road vehicles of categories M, N and O, or the directly applicable European Union Regulation concerning the approval of two or three-wheel vehicles and quadricycles and market surveillance (12) or the directly applicable European Union Regulation concerning the approval of agricultural and forestry vehicles and market surveillance (13), where vehicles are approved pursuant to Section 7 (d), their systems, components or separate technical units.
(2) Annex 5 to this Decree shall also apply mutatis mutandis to the approval of the non-harmonised type of systems, components and separate technical units intended for vehicles pursuant to Section 7.
(3) The provisions laid down in paragraphs 1 and 2 shall apply mutatis mutandis to the fixing of:
(a) the means of ensuring conformity of production of vehicles pursuant to Article 7, their systems, components and separate technical units with the approved type;
(b) the scope and content of the technical documentation;
(c) the method of verifying the conformity of production of vehicles pursuant to § 7, their systems, components and separate technical units with the approved type; and
(d) the scope and manner of verification of technical requirements. ';
32. in Paragraph 23 (3):
"(3) In order to determine the categories of activities of the technical services, the requirements for their instruments and other necessary technical equipment, the requirements for the premises required for the performance of the activities of the technical services, the requirements for the internal organisation and management system and the way in which the assessment of compliance with these requirements is carried out, appropriate application shall be made.
(a) a directly applicable European Union Regulation concerning the approval of two or three-wheel vehicles and quadricycles and market surveillance (12), where verified
1. at the time of approval of an international type of compliance with the technical requirements, systems, components or separate technical units of L-category vehicles,
2. at the time of approval of the non-harmonised type, the vehicles referred to in Article 7 (b), their systems, components or separate technical units, or
(b) a directly applicable European Union regulation governing the approval of agricultural and forestry vehicles and market surveillance (13) where verified
1. when approved by an international type of compliance with technical requirements, systems, components or separate technical units of vehicles of categories T, C, R and S;
2. when approving the non-harmonised type of compliance with the technical requirements by vehicles referred to in Section 7 (c), their systems, components or separate technical units;
(c) Annex 3 to this Regulation and the directly applicable European Union provisions governing the approval of road vehicles of categories M, N and O, or the directly applicable European Union Regulation concerning the approval of two-, three-wheel and quadricycles and market surveillance (12), or the directly applicable European Union Regulation concerning the approval of agricultural and forestry vehicles and market surveillance (13), where the technical requirements of the vehicles referred to in Section 7 (d), their systems, components or separate technical units are verified. ';
33. In Article 23, paragraphs 4 to 6 are deleted.
Paragraph 7 shall become paragraph 4.
34. The following Section 27a is inserted after Section 27, including the title and footnote 14:
Range of tests carried out by tachograph manufacturer
[Paragraph 28 (1) (d) of the Law]
The manufacturer shall carry out tests on units in vehicles and motion sensors according to the directly applicable European Union regulation governing the design, installation, use, testing and checking of tachographs 14) at least every 2 years.
14) Regulation (EU) No 165 / 2014 of the European Parliament and of the Council of 4 February 2014 on tachographs in road transport, repealing Council Regulation (EEC) No 3821 / 85 on recording equipment in road transport and amending Regulation (EC) No 561 / 2006 of the European Parliament and of the Council on the harmonisation of certain social legislation relating to road transport. '
35. in Paragraph 29 (6), the words "or hydrogen" shall be inserted after the words "liquefied natural gas."
36. in Paragraph 33 (1):
"(1) In order to establish the technical requirements for the design and condition of special vehicles of categories T4.1, T4.2, C, R and S when the manufacturer requests the approval of a non-harmonised type, and to establish the technical requirements for the design and condition of special vehicles of category Z not listed in Annex 13 to this Regulation, the directly applicable European Union Regulation concerning the approval of agricultural and forestry vehicles and the surveillance of market 13 shall apply mutatis mutandis. ';
37. in Paragraph 33 (2), the words "categories SS and SN" are replaced by the words "subcategories SS and SN and certain special vehicles of category Z."
38. in Paragraph 36 (3), "paragraph 6" is replaced by "paragraph 5."
39. in Paragraph 38 (5), the words "subcategories" shall be inserted after the words "T, C and";

45. Annex 2 shall read as follows:
"Annex No 2 to Decree No 341 / 2014 Coll.
Category of road and special vehicles
1. CATEGORY L: a description of L-category road vehicles and their additional subdivision are given in the directly applicable European Union Regulation concerning the approval of two or three-wheel vehicles and quadricycles and market surveillance (12).
Road vehicles of sub-category LZ are two-wheel and three-wheel vehicles and quadricycles which are constructively equivalent to road vehicles according to the first sentence and are designed and manufactured for use for armed forces, civil protection, fire service, public order maintenance and medical rescue services.
2. CATEGORY M: Motor vehicles designed and constructed primarily for the transport of persons and their luggage.
2.1. Category M1: vehicles of category M with a maximum of eight seating positions except the driver's seat. Vehicles belonging to category M1 shall not have space for standing passengers. The number of seating positions may be limited to one (i.e. driver seating position).
2.2. Category M2: vehicles of category M with more than eight seating positions except for the driver's seat and a maximum mass not exceeding 5 tonnes. Vehicles belonging to category M2 may have space for standing passengers in addition to seating positions.
2.3. Category M3: vehicles of category M with more than eight seating positions except for the driver's seat and with a maximum mass exceeding 5 tonnes. Vehicles belonging to category M3 may have space for standing passengers.
3. CATEGORY N: Motor vehicles designed and constructed primarily for freight transport.
3.1. Category N1: Vehicles of category N with a maximum mass not exceeding 3,5 tonnes.
3.2. Category N2: Vehicles of category N with a maximum weight exceeding 3,5 tonnes but not exceeding 12 tonnes.
3.3. Category N3: Vehicles of category N with a maximum mass exceeding 12 tonnes.
4. CATEGORY O: trailers designed and constructed for the transport of goods or persons and for the accommodation of persons.
4.1. Category O1: Vehicles of category O with a maximum mass not exceeding 0,75 tonnes.
4.2. Category O2: Vehicles of category Of a maximum weight exceeding 0,75 tonnes but not exceeding 3,5 tonnes.
4.3. Category O3: Vehicles of category Of a maximum weight exceeding 3,5 tonnes but not exceeding 10 tonnes
4.4. Category O4: Vehicles of category O with a maximum mass exceeding 10 tonnes.
Sub-categories of vehicles
Field vehicles
"Terrestrial vehicle 'means a vehicle classified in category M or N which has specific technical characteristics enabling it to be used outside normal roads. In the case of these categories of vehicles, the letter" G' shall be added to the letter and figure identifying the category of vehicle. The criteria for the classification of a vehicle in the subcategory "off-road vehicles' are given
in Section 4 of Part A Annex II to Directive 2007 / 46 / EC.
Special purpose vehicles
"Special purpose vehicle 'means a road vehicle of category M, N or O having specific technical characteristics for the performance of a function which requires a special arrangement and / or equipment. In the case of incomplete vehicles intended to fall within the subcategory of special purpose vehicles, the letter" S' shall be added to the letter and figure identifying the category of vehicle. The different types of special purpose vehicles are defined and listed in Section 5 of Part A of Annex II to Directive 2007 / 46 / EC.
Special purpose road vehicle
"Special purpose road vehicle 'means a vehicle classified in category M or N which has the specific technical characteristics referred to in points 2.1 and 2.2 of Part A of Annex II to Directive 2007 / 46 / EC. In the case of these categories of vehicles, the letter" G' shall be added to the letter and figure identifying the category of vehicle. In the case of incomplete vehicles intended to fall within the subcategory of special purpose vehicles, in addition to the letter and the figure identifying the category of vehicle, the letter "S 'shall be added as the second suffix.
5. CATEGORIES T, C, R and S: description of road vehicles of categories T, C, R and S and their additional subdivision are given in the directly applicable European Union Regulation on the approval of agricultural and forestry vehicles and market surveillance (13).
Special vehicles of subcategory SS are self-propelled work machines with their own power supply, design and equipment intended only for the pursuit of certain work activities. Self-propelled work machines are generally not intended for transport activities.
Special vehicles of subcategory SN are work machines carried only for the performance of certain work activities. These machines move on the road and form a whole with the vehicle. Their running gear (if fitted) is not in contact with the ground in the transport position. This category covers:
even replacement superstructures having the character of a work machine carried.
6. CATEGORY Z: Other vehicles which cannot be classified in any of the above categories. '

Method and form of transmission of data to the register of technical data of road vehicle types
1. For vehicles certified to be of a harmonised type, the manufacturer or the accredited representative shall ensure, where appropriate, that the vehicles are placed on the market (hereinafter referred to as "the transmitting person ') by electronic means, the transmission of data to the Ministry database to the extent provided for in Section 4 (3) of the Act accompanied by a declaration of conformity.
2. The Ministry shall assign a basic number for each new type of vehicle of the factory brand upon notification by the transferring person. Where there are more than one donor, the base number shall be assigned to each of them.
3. The transferring person shall ensure the transfer of data from the certificate of conformity for each new, not yet used combination of type, variant and version together with the approval number of the harmonised type. Each transfer thus created shall be marked with the assigned base number and sent to the Ministry database. The data transfer shall also be ensured by the transferring person for the same variant and version of the vehicle, where at least one indication has changed for the variant and version, for example, by extending the harmonised type approval.
4. The licence shall be printed on the basis of the original data. Details of data transfer to the Ministry database are published in the Transport Bulletin. '
